The patent system is in flux. Concerns abound about the imperfect fit between traditional patent rights and the Information Age, excessive numbers of patents, overbroad patent rights, poor patent quality, and allegedly exploitative actors, like so-called “patent trolls.” In response, courts, commentators, and Congress have proposed, debated, and sometimes adopted a series of reforms and changes to patent rights, patent doctrines, and patent institutions. The America Invents Act of 2011 (AIA) introduced the most significant changes to the patent system since 1952 and was even described by one commentator (hyperbolically, as we will see) as “the most significant overhaul to …

Partisan gerrymandering is the process of drafting state and congressional districts in a manner that gives one political party an advantage over another. The end goal is simple: help your party win more seats or protect existing ones. The tactic is as old as the United States. In 1788, Patrick Henry convinced the Virginia state legislature to draw the 5th Congressional District to pit his rival James Madison against James Monroe. The term “gerrymander” itself is a hybrid: in 1810, democratic Governor Gerry signed a partisan redistricting plan into law—one that contained a district that infamously looked like a salamander. …

Understanding by Design: Complete Collection
This unit focuses on human migration and is designed for use in a third grade classroom. It will take 5-6 weeks to complete. In the unit, students will explore historical and current examples of why people migrate to new communities, as well as the cultural implications in their own lives and in their new communities. Students will also have a chance to share their own cultural traditions and compare those with traditions around the world. Research and interview opportunities are also available to help students make deeper connections to the material.

Fourth Amendment doctrine is attentive to a wide range of interests, including security, informational privacy, and dignity. How should courts reconcile these competing concerns when deciding which searches and seizures are “unreasonable”? Current doctrine typically answers this question by pointing to interest aggregation: the various interests at stake are added up, placed on figurative scales, and compared, with the goal of promoting overall social welfare. But interest aggregation is disconnected from many settled doctrinal rules and leads to results that are unfair for individuals. The main alternative is originalism; but historical sources themselves suggest that the Fourth Amendment calls for …

The Yoruban people of modern-day Nigeria worship many deities called orichas by means of singing, drumming, and dancing. Their aurally preserved artistic traditions are intrinsically connected to both religious ceremony and everyday life. These forms of worship traveled to the Americas during the colonial era through the brutal transatlantic slave trade and continued to evolve beneath racist societal hierarchies implemented by western European nations. Despite severe oppression, Yoruban slaves in Cuba were able to disguise orichas behind Catholic saints so that they could still actively worship in public. I aim to excavate source material from the past and reinterpret its significance in the present through art. I merge history with the contemporary through acts of appropriation and material exploration, creating conditions for the viewer to grapple with colonial legacies in an affective space of visual experience.

Russian identity is a complicated subject. Discussions usually revolve around the extent to which Russia can be said to be European or not. The poet Alexander Pushkin, since the time of his death, has been a symbol of Russian identity and is seen to have articulated central components of Russian identity through works such as The Bronze Horseman and Eugene Onegin. However, Pushkin also addressed a critical era in the formation of Russian identity: the Time of Troubles. During this period Russian autocracy was strengthened and serfdom became further entrenched. True Americanism: Mexican-American And Irish-American Nationalism Through The Twentieth Century, Zachary Adams

In the years after World War I, Mexican Americans and Irish Americans consciously utilized the language and symbols of American patriotism to advance their social and political agendas. In doing so, they adopted and repurposed the rhetoric that a new wave of American nationalists, the True Americanists, sought to use to negate their very citizenship. True Americanists argued that the cultural obligations of United States citizenship required complete assimilation. With Mexican-American and Irish-American community leaders continuing to rely upon messages of shared ethnicity to garner and mobilize followers, their use of Irishness and Mexicanness ran afoul of this new nationalism. …

International And Domestic Drivers Of Military Shifts In Alaska, Peter K. Burkhart
Arctic and Northern Studies
Since WWII, Alaska has witnessed dramatic influxes and reductions in military personnel and funding. This thesis explores the drivers of these events. It applies two theories to analyze the trends: realist theory from international relations and the advocacy coalition framework from public policy. The thesis uses a case study framework and process-tracing to analyze three different time periods in Alaska's history: 1) World War II (1940-1945), 2) the early Cold War era (1950-1958), and 3) the immediate post-Cold War era (1993-1999). This thesis argues that the level of international threat accounts for the United States' decisions to increase or decrease …
