Michigan Journal of Environmental & Administrative Law

This paper examines, enunciates, and makes explicit a set of market principles historically relied upon by the Federal Energy Regulatory Commission (FERC) to regulate wholesale electricity markets as required under the Federal Power Act (FPA). These identified competitive market principles are supported by policy and legal foundations that run through a myriad of FERC orders and court decisions. This paper seeks to make that history and those implicit market principles explicit by distilling and organizing Commission Orders and court decisions. It concludes that five market principles, each with multiple subprinciples, can be identified as elemental to how FERC understands and …

The Paperwork Reduction Act (PRA) is an often-ignored law with a large impact. Federal agencies cannot ask the same questions of more than nine people or entities without submitting a proposed information collection to the White House Office of Management and Budget for review, a process that can take up to a year to complete. In an attempt to regulate the amount of paperwork foisted on the public, the PRA has created an enormous amount of paperwork for federal agencies—without any meaningful reduction in the paperwork burden faced by the public. Dmitry Shlapentokh’s article on Russian Eurasianism [Comparative Civilizations Review: No. 81. 9-29, 2019] contains a number of questionable statements without any attempt at documentation in support of his thesis. For example, in explaining why his version of “Eurasianism” was marginalized in the “West,” he states Western observers approached Russia from the perspective that “the triumph of American-type capitalism …shall be the omega point of all humanity, including Russia.”[emphasis in the original]. This dissertation presents a materialist inheritance of the idealist theory of universal history that descends from Immanuel Kant through Early German Romanticism to Walter Benjamin. I show that the division between the idealist and the materialist interpretations of universal history results from their methodologically distinct treatments of the problem of historical violence. Where idealism explains the conceptual coherence of historical processes in a specifically teleological unity (no matter how critically modified), materialist theories of universal history reject such a teleological model of conceptual necessity as historical unity not in order to disregard the issue of history’s coherence, but to articulate …

My mother Rosa Abramovna Kurtz-Dranov passed away in New Jersey in June 2003 after a long illness. She was 94. After the burial, I sat shiva, as is Jewish custom, for the first time in my life. (I did not sit for seven days, as required). As I was going through my mother’s papers — photos, letters, books, newspaper clippings — I stumbled upon a manuscript. That was her memoir, hand-written by her in New Jersey in 1987. It was an unexpected find; I had not known she was writing her memoirs.

During the era of federal assimilation policy, the Winnebago people asserted their cultural identity and history at every step of allotment and boarding school policy. From their distinct responses, Winnebago men and women defended their autonomy and sovereignty to federal intervention. By examining their unique opinions, a more cumulative understanding of the various tactics the Winnebago people used can be further explored. Gender, education, and generation shaped individual responses.
