This Article explores the development of the Clean Air Act of 1963, the first law to allow the federal government to fight air pollution rather than study it. The Article focuses on the postwar years (1945-1963) and explores the rise of public health medical research, cooperative federalism, and the desire to harness the powers of the federal government for domestic social improvement, as key precursors to environmental law. It examines the origins of the idea that the federal government should "do something" about air pollution, and how that idea was translated, through drafting, lobbying, politicking, hearings, debate, influence, and votes, …

Recently declassified British records reveal London’s misgivings about America’s 1987 reflagging and escorting of Kuwaiti tankers amid the Iran-Iraq War. This early case study illustrates the challenges of conducting coalition warfare in the Middle East, even with a close, cooperative partner. National-level differences revealed surmountable fissures in coordinating naval strategies and operations, yet the benefits of the relationship justified the friction encountered.

The French army’s 1940 campaign was disastrous, whereas the U.S. Marine Corps cracked the problem of making an opposed amphibious landing, keying victory over imperial Japan. But despite these military organizations’ different approaches, a closer examination reveals that the two services shared more in common in the problems they faced and the answers they developed than their operational results suggest.

This article tells the story of feminist activism and scholarship and how women have sought to overcome exclusion, marginalization, and silencing in both policy and law in pursuit of what the author describes as a transformative disarmament agenda. This dissertation is a study of how people experienced and gave meaning to the violent conflicts that transformed the U.S.-Mexico Borderlands from a multipolar region into one dominated by two modern nation-states. As multiple imperial and national projects converged here between 1821-1890, borderland violence became a central way in which local people interacted with and participated in nation- and state-making. Using archival evidence from both sides of the modern border, I examine how borderlands people used gendered, racialized, and familial ideologies to organize, understand, and politicize these conflicts as well as to reckon their shifting positions within emerging nation-states. Despite longstanding orthodoxy, the Constitution’s enumeration of congressional powers does virtually nothing to limit federal lawmaking. That’s not because of some bizarrely persistent judicial failure to read the Constitution correctly. It’s because the enumeration of congressional powers is not a well-designed technology for limiting federal legislation. Rather than trying to make the enumeration do work that it will not do, decisionmakers should find better ways of thinking about what lawmaking should be done locally rather than nationally. This project is a series of lesson plans for a 10^th grade US History class detailing the lessons of the Vietnam War and how they have and haven’t been used by President Obama in his decisions during the War in Afghanistan. The lesson plan uses Differentiation and Universal Design for Learning to accommodate every student in the class. This dissertation focuses on the constitutional politics of England, and then Britain’s, transatlantic empire in the seventeenth and eighteenth centuries, through the lens of Jamaica and New York. In those two colonies, as in the rest of the Atlantic empire, colonial elites and imperial authorities were in perpetual political conflict. In this dissertation, I explain why the conflict persisted without resolution. Historians, though they rarely answer this question, have described fundamental transatlantic clashes of interests, and I take these as my starting point. I argue that each side’s ideological and material interests interwove with and sustained one another, and were …

For more than two decades, Northern Ireland has suffered the high social cost of a violent political conflict. Debates over the nature of this conflict have been wide-ranging, but the dominant view is that the conflict is criminal rather than political in nature. This view holds that the violence is widespread terrorism, with the Irish Republican Army (IRA) seen as the chief protagonist. But while this view is dominant, it is not ubiquitous.
