Social Science And Segregation Before Brown, Herbert Hovenkamp
Social Science And Segregation Before Brown, Herbert Hovenkamp
Duke Law Journal
A wide variety of scholarship has addressed the law of race relations during the late nineteenth and early twentieth centuries. Much of that scholarship has presented the judicial record in the Gilded Age and Progressive Era cases as reactionary and somehow in violation of the basic principles of equality implicit in the American Constitution, particularly in the thirteenth, fourteenth, and fifteenth amendments. Professor Hovenkamp calls this view into question by examining the science and social science of that period and the use of scientific information in race relations cases. He concludes that late nineteenth and early twentieth century courts used …
Anti-Formalism In Recent Constitutional Theory, Mark V. Tushnet
Anti-Formalism In Recent Constitutional Theory, Mark V. Tushnet
Michigan Law Review
The focus in constitutional theory on judicial review rests on a much deeper political theory than the phrase "countermajoritarian difficulty" standing alone suggests. Majoritarian or democratic decision making is itself a solution to a set of problems that arise from a particular view of human nature and political action. In this Article, I identify, explicate, and criticize some recent developments in constitutional theory which are of interest to the extent that they reject that view of human nature and politics. I take as my focus important articles by Robert Burt, Robert Cover, Owen Fiss, Frank Michelman, and Cass Sunstein. I …

The Major Studies On Vincent De Paul, Carey J. Leonard C.M.
The Major Studies On Vincent De Paul, Carey J. Leonard C.M.
Vincentian Studies
The real Vincent de Paul, versus the legendary one, was not known for several centuries because his communities restricted his writings to themselves. This article categorizes and critiques the major works on him. It begins with the four institutional biographies from before the twentieth century by Louis Abelly, Pierre Collet, Michel-Ulysse Maynard, and Louis-Victor-Emile Bougaud. Twentieth century works are then evaluated, starting with those of Pierre Coste. Historical studies of the Church and spirituality during and after Vincent’s time place him in social, political, and ecclesial context. Other efforts examine how his works and spirituality may be applied to contemporary …

Verdict According To Conscience: Perspectives On The English Criminal Trial Jury 1200-1800, Thomas A. Green
Verdict According To Conscience: Perspectives On The English Criminal Trial Jury 1200-1800, Thomas A. Green
Books
This book treats the history of the English criminal trial jury from its origins to the eve of the Victorian reforms in the criminal law. It consists of eight free-standing essays on important aspects of that history and a conclusion. Each chapter addresses the phenomenon that has come to be known as "jury nullification," the exercise of jury discretion in favor of a defendant whom the jury nonetheless believes to have committed the act with which he is charged. Historically, some instances of nullification reflect the jury's view that the act in question is not unlawful, while in other cases …

The Charitable Endeavors Of Archbishop John Joseph Lynch, C.M., Gerald Stortz
Vincentian Studies
Archbishop John Joseph Lynch, C.M. successfully ran existing charities and founded new ones for Irish Catholic immigrants in Toronto. He partnered with the Society of Saint Vincent de Paul and delegated leadership of other charities to its members. Lynch was the main financial support of the House of Providence, which housed orphans and the elderly. He established the Saint Nicholas Home for Newsboys and the Notre Dame Institute, a home for working Catholic girls. He worked with the Saint John Temperance Society and the Toronto Savings Bank; the latter was supposed to help persons who were poor save money. Other …
