The Meaning Of "Under Color Of" Law, Steven L. Winter
The Meaning Of "Under Color Of" Law, Steven L. Winter
Michigan Law Review
The argument proceeds as follows. In Part I, I examine why the conceptual problem of who or what is "the State" is so intractable. In Part II, I present the historical evidence that establishes beyond doubt the pedigree and meaning of the phrase under color of law. I explain why Frankfurter would have indulged in such an obvious historical error to take the position he did. I suggest that, as was the case with the invention of modem standing doctrine, Frankfurter was here engaged in a stealthy, anachronistic campaign against the jurisprudence of the Lochner era - attempting to …

Fraternalism In Victorian Ontario: Secret Societies And Cultural Hegemony, Christopher J. Anstead
Fraternalism In Victorian Ontario: Secret Societies And Cultural Hegemony, Christopher J. Anstead
Digitized Theses
Between 1840 and 1901, Ontario witnessed a tremendous expansion of fraternal activity, as lodges became common features of urban society. This phenomenon derived from the link between secret societies and the viewpoint associated with the "Victorian middle class." Through an examination of provincial fraternal development, and a detailed consideration of lodges in two small towns, this thesis explores the connection between secret societies and hegemony in the particular setting of Victorian Ontario.;As the forces of industrialization and urbanization changed Ontario during the nineteenth century, the old hegemony of paternalism gave way to a new hegemony--the hegemony of respectability; as this …
Crime And Punishment In New Hampshire, 1812-1914 (Volumes I And Ii), Timothy Dodge
Crime And Punishment In New Hampshire, 1812-1914 (Volumes I And Ii), Timothy Dodge
Doctoral Dissertations
Changing definitions of crime accompanied the economic transformation of seacoast New Hampshire from a predominently agricultural, and rural society in 1812 to one that was mainly industrial, commercial, and urban by 1914. This dissertation analyzes a sample of 820 felony incarcerations (19.5%) of the total 4154 incarcerations recorded at the New Hampshire State Prison for the period 1812-1914. Court bills and indictments of Rockingham and Strafford County, New Hampshire are used to analyze felony convictions. Quantitative analysis involving 17 variables reveals that property crime was the most common conviction. Felony conviction rates per 100,000 population nearly doubled between 1812 and …

To Rend And Teare The Bodies Of Men: Theology And The Body In Demonic Possession; France, England, And Puritan America, 1550-1700, Julianne Siudowski Cooper-Forst
Doctoral Dissertations
During the Reformation, Protestants attempted to recast their theology in opposition to the Roman Catholic system. They succeeded in most areas. There was, however, one area of theology where this was not true: demonology and spiritual possession. Incidents of demonic possession rose during the second quarter of the sixteenth century, reached a crescendo by the first quarter of the seventeenth century, and except for a flurry or two, died out near the beginning of the eighteenth century. This dissertation examines the published materials relating to the physical phenomena of demonic possession in France, England, and Puritan America from the sixteenth …
Aberrant Mormon Settlers: The Homesteaders Of Highland, Utah, David T. Durfey
Aberrant Mormon Settlers: The Homesteaders Of Highland, Utah, David T. Durfey
Theses and Dissertations
This thesis is a history of the original thirty-seven homesteaders of Highland, Utah. It covers a period of about twenty-five years, 1875-1900. The study provides an example of a aberrant community which was not established in the same, distinctive style of settlement as the typical Mormon village. In addition it describes the relationship between the original residents and non-residents of Highland with the surrounding villages of Lehi, American Fork, and Alpine.
