“Cardozo’S Foot”: The Chancellor’S Conscience And Constructive Trusts, H. Jefferson Powell

Law and Contemporary Problems

The "chancellor's foot" is a term coined by English legal scholar John Selden for the argument that equity is an unjustified and unfortunate interference in the regular course of the rule of law. Education And Community Development Among Nineteenth-Century Irish And Contemporary Cambodians In Lowell, Massachusetts, Peter N. Kiang Jun 1993

Education And Community Development Among Nineteenth-Century Irish And Contemporary Cambodians In Lowell, Massachusetts, Peter N. Kiang

New England Journal of Public Policy

As cities undergo dramatic demographic changes, schools become important sites of conflict between the interests of established and emerging communities. This article presents a case study of Lowell, Massachusetts, where the second largest Irish community in the country resided during the 1850s, and which is now home to the second largest Cambodian community in the United States. Analysis of nineteenth-century Irish community dynamics, particularly in relation to issues of public education in Lowell, reveals the significance of religious institutions and middle-class entrepreneurs in the process of immigrant community development and highlights important relationships to ethnicity, electoral politics, and economic development. …

Interest, Principle, And Beyond: American Understandings Of Conflict, Don Herzog Jan 1993

Interest, Principle, And Beyond: American Understandings Of Conflict, Don Herzog

Book Chapters

To understand U.S. foreign policy, we need to understand the concepts and categories that Americans bring to bear. After all, we see the world through our concepts and categories. They identify what's possible, what's desirable, indeed what's visible in the first place. There is simply no possibility of junking all our concepts, stepping outside them, and gaining an unmediated grasp of the world. Here, I offer a sketch of American understandings of conflict. Understandings, not understanding: even in the realm of foreign policy, Americans have long brought intriguingly different categories to bear, categories whose richness isn't captured by some standard …

History, Organization And Belief Among Cuban "Plantado" Political Prisoners, 1959-1993, William Raymond Yaworsky Jan 1993

History, Organization And Belief Among Cuban "Plantado" Political Prisoners, 1959-1993, William Raymond Yaworsky

UNLV Retrospective Theses & Dissertations

Anti-Castro activists began organizing guerrilla groups in the early 1960's to oppose the revolutionary government of Cuba. The perception that the new regime posed a threat to religion and pre-existing cultural values were among the motives for this activity. The findings of this study indicate that ideology and beliefs function to provide meaningful explanations to social life, and are not necessarily thin veils for self interest masquerading as principle. …
