Difference Made Legal: The Court And Dr. King, David Luban Aug 1989

Difference Made Legal: The Court And Dr. King, David Luban

Michigan Law Review

My aim in this essay is to contrast two legal retellings of the same event: a set of demonstrations sponsored by the Southern Christian Leadership Conference in Birmingham, Alabama in 1963 that led to the arrest and incarceration of Martin Luther King, Jr. One is the Supreme Court majority opinion in Walker v. City of Birmingham, sustaining King's conviction; the other, King's own defense of his actions in his Letter from Birmingham Jail I wish to show how the self-same event entails radically different legal consequences when it appears in different narratives, one the Supreme Court's official voice, the …

Theories Of Economic Regulation And The Development Of The Doctrine Of "Conspiracies In Restraint Of Trade" In The Labor Market., Edd Sidney Noell Jan 1989

Theories Of Economic Regulation And The Development Of The Doctrine Of "Conspiracies In Restraint Of Trade" In The Labor Market., Edd Sidney Noell

LSU Historical Dissertations and Theses

The purpose of this dissertation is to analyze the development of the doctrine of "conspiracies in restraint of trade" in the labor market by means of an application of two models of economic regulation. As heuristic devices, these models are utilized to explain the formation of English and American labor law in three different eras. The market failure model posits that labor market regulators seek to remedy unequal bargaining power and asymmetric information so as to achieve economic efficiency. This model's 'liberty and virtue' component emphasizes the normative end of character formation. According to the interest group model, organized labor …

The Dismantling Of De Jure Segregation In Louisiana, 1954-1974. (Volumes I And Ii)., Carroll Joseph Dugas Jan 1989

The Dismantling Of De Jure Segregation In Louisiana, 1954-1974. (Volumes I And Ii)., Carroll Joseph Dugas

LSU Historical Dissertations and Theses

In the two decades between 1954 and 1974, the State of Louisiana progressed from a closed, white-dominated society to an open, multi-racial society with legal safeguards in place to assure equal protection and equal opportunity for all residents regardless of race or color. Prior to 1960, the vast majority of blacks were unable to vote, serve on juries, buy homes in decent neighborhoods, use publicly-owned facilities or frequent hotels, restaurants and other public accommodations. In addition to these humiliations, they were required to utilize inadequate "separate but equal" public parks, playgrounds, swimming pools, schools, waiting areas and correctional facilities until …
