The Meaning Of "Under Color Of" Law, Steven L. Winter

The argument proceeds as follows. In Part I, I examine why the conceptual problem of who or what is "the State" is so intractable. In Part II, I present the historical evidence that establishes beyond doubt the pedigree and meaning of the phrase under color of law. I explain why Frankfurter would have indulged in such an obvious historical error to take the position he did. I suggest that, as was the case with the invention of modem standing doctrine, Frankfurter was here engaged in a stealthy, anachronistic campaign against the jurisprudence of the Lochner era - attempting to …

When Lehi's Party Arrived In The Land, Did They Find Others There?, John L. Sorenson

A number of statements in the Book of Mormon text indicate the presence in Lehi’s promised land of peoples other than those descended from Lehi’s party. Reasons the topic is not addressed more explicitly in the record include a focus on the Nephites (and not on other people), a generic treatment of Lamanites, an a desire not to waste space on something obvious or insignificant. Clear evidence for the presence of others in substantial populations is present in the Book of Mormon. The demographic or cultural history of Lehi’s literal descendants must take into account these other groups.

The army of the Habsburg Monarchy was the central institution of the Habsburg state, and it embodied the ideal of non-national, dynastic rule. The army leadership was aware of the dangers of nationalism, but in the period between the end of the Napoleonic Wars and the revolutions of 1848, no attempt was made to overcome the danger of national disaffection. The revolutions of 1848 caused the army to remove Hungarian and Italian units from their homelands, but, despite the suspicion in which they were held, these troops fought well in the wars of 1859 and 1866. Schema Theory And Application For The Content Teacher, June Allen Carpenter Darling

Schema theory, research, and implications for the classroom were studied. Based on research, teacher resources, and curriculum demands, instruction was designed for a secondary teacher of United States History. During a workshop, four secondary teachers from three districts reacted to research and instruction. A video tape was developed showing schema theory concepts, related research, application for the content teacher, and reactions from secondary teachers. Implications for the content teacher are discussed.

Although the discipline of psychology, in its contemporary form, is only a century old, psychology's historical antecedents reach back to the beginnings of civilization. Whether defined as the study of the soul or the study of human faculties, as it was in earlier times, or as the study of consciousness, mind, or behavior, as it has been over the past hundred years, psychology has dealt with some of the fundamental questions and issues pertaining to the functions, processes, and mechanisms of human and animal nature.

One Hundred Years Of Harmful Error: The Historical Jurisprudence Of Medical Malpractice, Theodore Silver

In this Article, Professor Silver examines the origins of present-day malpractice law. He begins by noting that negligence and medical malpractice as the common law now knows them made their debut in the nineteenth century although their roots lie deep in the turf of trespass and assumpsit. He argues, however, that toward the turn of the century several episodes of linguistic laziness purported to produce a separation between negligence and medical malpractice so that the two fields are conventionally thought to rest on separate doctrinal foundations. Self-Determination, Minority Rights, And Constitutional Accommodation: The Example Of The Czech And Slovak Federal Republic, Claudia Saladin

Part I of this note will explore the concepts of self-determination and minority rights in international law and their development over time. This is particularly relevant to the countries of Central and Eastern Europe, because these concepts saw their first full flowering in the period during and following the First World War, when those countries gained their independence from the European powers. Part II will discuss the evolution of the constitutional relationship between the Czechs and the Slovaks from the constitution of the first Czechoslovak Republic to the current constitutional reforms of the CSFR. Preservation Of The Writing Approaches Of The Four Gospel Writers In The Joseph Smith Translation Of The Bible, Donald Joseph Miles

This thesis analyzes additions to the gospels in the Joseph Smith Translation of the Bible. To assess the appropriateness of the JST additions, the thesis examines Joseph Smith's additions to verify whether they parallel the approaches of the original gospel writers to their audiences. There is strong indication that material added to the King James Version by the Joseph Smith Translation is consistent with the approaches of the original gospels to their audiences. Chapter one shows that the JST Matthew, like the KJV Matthew, is concerned with showing that Jesus fulfills Old Testament prophecy. Chapter two finds that JST Mark …

The Book of Mormon gives only very brief information about a group of people called Mulekites. This article discusses the origin of this people as descendents of Zedekiah and Mulek and how they might have crossed the ocean to the New World. Sorenson then examines in detail the interaction between the Mulekite group and other groups of people as told in the Book of Mormon.

In some respects the new immigration history contrasts strongly with the old. Whereas the traditional was assimilationist and stressed the cultural contributions of the newcomers, the new is more often pluralist and focuses on cultural conflict. The old tended to describe individual accomplishment and, drawing upon readily available sources such as letters, speeches, diaries, and other qualitative sources, was unintentionally elitist; the new analyzes the relationships of the ethnic group (i.e., the masses of ordinary people of limited skills in communication) with elements of the receiving society, including other ethnocultural collectivities. This study provides a comprehensive theory of charismatic relationships which, consistent with the original meaning of the term charisma, emphasizes the followers' belief that their leader is attached to their perception of the divine. In that the process of theory development shows its application to several modern leader-follower relationships, analysts can use the theory to examine such relationships in a variety of social settings.
The theory was developed from an ideal type model based on Hasidism, a significant Jewish religious movement which centers on the zaddik. Literally, zaddik means "righteous" and is applied to an individual who is believed to …

This study argues for the mutual impenetration of logical, legal and scientific metaphors and attempts to determine the role played by them in the construction of theory. Specifically it attempts to discover the impact which the metaphors of topical logic may have had on the construction of American ideology.
Chapter 1 offers a brief discussion of logical metaphors and their relation to the social and intellectual settings which generate them.
