Habeas, History, And Hermeneutics, Jonathan R. Siegel Jan 2021

Habeas, History, And Hermeneutics, Jonathan R. Siegel

GW Law Faculty Publications & Other Works

Supreme Court Justices Clarence Thomas and Neil Gorsuch recently proposed a radical shrinking of federal habeas corpus relief for state prisoners who are in custody pursuant to a final judgment of criminal conviction. They called for a return to the supposedly traditional principle that federal courts cannot grant habeas relief to such prisoners unless the state court that sentenced them lacked jurisdiction. This Article explains that (1) this supposedly traditional principle was not, in fact, a traditional principle of habeas, and (2) even if it were, Congress has displaced it by statute. Exploring the errors in the Justices’ arguments provides …

Barbara Powers: Witch Or Myth? The Last Case Of Witchcraft In South Carolina, Brandon Smith, Bobbie Jo Wimberly, Courtney Mcdonald Jan 2021

Barbara Powers: Witch Or Myth? The Last Case Of Witchcraft In South Carolina, Brandon Smith, Bobbie Jo Wimberly, Courtney Mcdonald

University of South Carolina Upstate Student Research Journal

Was an elderly woman from the upstate of South Carolina the last to be accused of and put on trial for witchcraft in the United States? In this paper, we investigate claims from an old letter sent to the president of South Carolina College to determine whether or not Barbara Powers was truly accused of witchcraft during a criminal trial. After thoroughly investigating census data, court records, marriage records, and other historical data in the named counties and those surrounding them, we were unable to determine conclusively if the trial was real or fabricated. Despite not knowing if the case …

Drag Magazine: A Study Of Community, Olivia Austin Jan 2021

Drag Magazine: A Study Of Community, Olivia Austin

Departmental Honors Projects

This research aims to understand the trans/drag community and its relationship to political activism and the lesbian and gay community in the 1970s and early 1980s. I aim to answer the following questions: How did Drag perceive the relationship between the gay/lesbian community and the trans/drag community? How did Drag function in the trans/drag community? How did Drag benefit its readers? Transgender individuals and drag queens were at the forefront of activism in the1960s during the Compton’s Cafeteria Riot and the Stonewall Inn Riots. Recently, there has been more attention to the critical transgender activism by Marsha P. Johnson and …

U.S. Race Relations And Foreign Policy, Susan D. Page Jan 2021

U.S. Race Relations And Foreign Policy, Susan D. Page

Michigan Journal of Race and Law

It is easy for Americans to think that the world’s most egregious human rights abuses happen in other countries. In reality, our history is plagued by injustices, and our present reality is still stained by racism and inequality. While the Michigan Journal of International Law usually publishes only pieces with a global focus, we felt it prudent in these critically important times not to shy away from the problems facing our own country. We must understand our own history before we can strive to form a better union, whether the union be the United States or the United Nations. Ambassador …

Russo-Ukrainian Patterns Of Genocide In The Twentieth Century, Amos Fox Jan 2021

Russo-Ukrainian Patterns Of Genocide In The Twentieth Century, Amos Fox

Journal of Strategic Security

Russo-Ukrainian relations in the 20th Century are dominated by genocide. Using Raphel Lemkin and Martin Shaw as a guide, one finds that Russo-Ukrainian relations during the 20th Century was a long period of genocidal action, linked by periods of punctuated genocides. These genocides included several political genocides that quelled Ukrainian nationalism and independence and kept it subjugated to Soviet Russia. Soviet Russia's genocide during the 20th Century was a carryover from Imperial Russia treatment of Ukraine, the arch of which carries over into today's relations between the two countries. Understanding this long period of genocide helps make sense of the …

Whose Line Is It Anyway? Rhetoric, Pathology, And The Jewish Race In Late Victorian England, Stephanie G. Pokras Jan 2021

Whose Line Is It Anyway? Rhetoric, Pathology, And The Jewish Race In Late Victorian England, Stephanie G. Pokras

Senior Independent Study Theses

This thesis examines how both late Victorian Anglo-Jews and Gentiles used rhetoric of race science and Jewish pathology to encode lines of difference, as well as the relationship between these discourses. My first chapter analyzes the role of Gentile discourse of disease and disability as the foundation of late Victorian anti-Semitism. My second chapter focuses on Jewish ‘expert’ engagement with race science. In this chapter, I argue that contrary to the dominant historical narrative, not only was the Jewish community engaged with race science, but their scholarly conversations were dynamic and diverse. Ideas about race and pathology became central to …

Fifty Years Ago, My Grandfather Won The Nyc Marathon And Changed New York History, Colin M. Kern

Capstones

In 1970, my grandfather won the first New York City Marathon. This piece of long-form narrative journalism tells the story of how that race grew into the largest race in the world, which fosters New York City's colossal running community. The article is accompanied by photos, an animation that breaks down the original New York City Marathon course, and gif's that compare running footwear from the '70s and today.

An Understanding Of Prisons, Race, And Class In The United States, Seth Ketchum Dec 2020

An Understanding Of Prisons, Race, And Class In The United States, Seth Ketchum

Honors Projects

After a summer of protests sparked by police brutality, the United States remains divided on this most important issue. This paper will seek to contextualize this country’s situation to explain that these protests stem from a history of inequality, in order to argue against claims that the protests are unjustified. With a multidisciplinary approach, we can begin to observe just how unequal this country is and understand what drives so many people to protest during the middle of a global pandemic.

Peak Oil, Progressivism, And Josephus Daniels, 1913–21, Roger Stern

Naval War College Review

Daniels’s time as Secretary of the Navy was activated by Progressivism and peak oil. To preserve the Naval Oil Reserve, Daniels ultimately resorted to seizing oil, always at a below-market price and sometimes without compensation at all. His campaign to save the Navy from both peak oil and the ostensible predations of “big oil” ended in fiasco—fuel-oil seizures led by armed Marines.

Faculty, Staff and Students Publications

The RYR1 gene, which encodes the sarcoplasmic reticulum calcium release channel or type 1 ryanodine receptor (RyR1) of skeletal muscle, was sequenced in 1988 and RYR1 variations that impair calcium homeostasis and increase susceptibility to malignant hyperthermia were first identified in 1991. Since then, RYR1-related myopathies (RYR1-RM) have been described as rare, histopathologically and clinically heterogeneous, and slowly progressive neuromuscular disorders. RYR1 variants can lead to dysfunctional RyR1-mediated calcium release, malignant hyperthermia susceptibility, elevated oxidative stress, deleterious post-translational modifications, and decreased RyR1 expression. RYR1-RM-affected individuals can present with delayed motor milestones, contractures, scoliosis, ophthalmoplegia, and respiratory insufficiency.Historically, RYR1-RM-affected individuals were …
