Searching For Terrorists: Why Public Safety Is Not A Special Need, Ric Simmons
Searching For Terrorists: Why Public Safety Is Not A Special Need, Ric Simmons
Duke Law Journal
In the wake of the terrorist attacks of September 11, 2001, local police across the country instituted blanket searches without individualized suspicion at various venues-including political protests, sporting events, subway platforms, and public ferries-all in an attempt to prevent further terrorist attacks. When evaluating these searches, courts rely upon the special needs doctrine, which allows the government to conduct a suspicionless search as long as the search serves a special need distinct from the goals of law enforcement. Over the past eight years, courts have struggled to determine whether and how the special needs doctrine applies to these searches, and …

Ovid Butler And The Founding Of Butler University, Sally Childs-Helton
Scholarship and Professional Work
Without Ovid Butler, there would be no Butler University today. The history of the man and the university are intimately and inextricably entwined; without Ovid Butler's vision, leadership, and financial support, the university may not have come into being, or survived its early years. One hundred and sixty years after it was chartered, Butler University today is a private, not-for-profit, comprehensive university located in Indianapolis, Indiana. Butler offers more than 65 majors from six colleges: Liberal Arts and Sciences, Education, Pharmacy, Business, Fine Arts, and Communication. Who Am I? Exploring Family And Identity In Contemporary American Fiction, Maximina J. Castillo
Who Am I? Exploring Family And Identity In Contemporary American Fiction, Maximina J. Castillo
Theses & ETDs
This thesis explores literary representations of family and the struggle for identity in contemporary American fiction. Characters find personality options within their families, but must also try to seek more positive models in the wider world. Focusing on six novels, the thesis deals with the process of developing a sense of self, the ways in which family identity creates a foundation, the limitations for each character, alternative models of identity outside the family, and what this process ultimately yields for the character. The first chapter, on Dorothy Allisons Bastard Out of Carolina (1992), considers the uncertainty of self that a …

"This Wilderness World": The Evolution Of A New England Farm Town, 1820--1840, Mary Babson Fuhrer
"This Wilderness World": The Evolution Of A New England Farm Town, 1820--1840, Mary Babson Fuhrer
Doctoral Dissertations
This dissertation uses the extraordinary conflict that roiled one rural town in central Massachusetts during the second quarter of the nineteenth century as a lens through which to observe communal relationships in transition. Using the Amish as a model, the dissertation identifies traditional communal social organization as agrarian, patriarchal, communal, homogeneous, localistic, and consensual -- as well as closed, conformist, and suspicious of difference and innovation. The dissertation argues that conflict arose in Boylston during the 1820s and '30s as these traditional relationships gradually gave way to more modern ways of belonging, associating, and envisioning one's place in the wider …
Relocation Revisited: Sex Trafficking Of Native Women In The United States, Sarah Deer
Relocation Revisited: Sex Trafficking Of Native Women In The United States, Sarah Deer
Faculty Scholarship
The Trafficking Victim Protection Act of 2000 (TVPA) signaled a comprehensive campaign by the United States (US) government to address the scourge of human trafficking in the US and abroad. The US rhetoric about sex trafficking suggests that the problem originates in foreign countries and/or is recent problem. Neither claim is correct. This article details the historical and legal context of sex trafficking from its origin among the colonial predecessors of the US and documents the commercial trafficking of Native women over several centuries. Native women have experienced generations of enslavement, exploitation, exportation, and relocation. Human trafficking is not just …

All Theses and Dissertations (ETDs)
In an historical analysis of Grimmelshausen and BeyΓÇÖs work the disinhibition created by the authorsΓÇÖ hidden identities and writing styles becomes an historical asset. The medium of fiction gave Grimmelshausen and Bey the freedom to shape their narratives as best fit their purposes. The historical usefulness of their texts is buried in their choices for deliveryΓÇöliterary device, character perspective, atmosphere, toneΓÇöand in the messages the authors deliver, intentionally or not.
Eugenic Sterilization In 20th Century Georgia: From Progressive Utilitarianism To Individual Rights, Stephen Michael Smith
Eugenic Sterilization In 20th Century Georgia: From Progressive Utilitarianism To Individual Rights, Stephen Michael Smith
College of Graduate Studies: Theses & Dissertations
The science of human breeding, known as eugenics, flourished in America in the first half of the 20th century. The movement's chief proponents included wealthy philanthropists, politicians, doctors, and young middle-class reformers. Sterilization for the purposes of removing defective genes from society was a critical part of the eugenics movement. Progressive reformers used eugenic doctrines combined with utilitarian political philosophy to divest individuals of the natural right to procreation. Involuntary sterilization legislation spread throughout the United States after the 1927 Buck v. Bell Supreme Court decision that gave judicial approval to involuntary sterilization, regardless of due process and equal protection …
