Article V: The Comatose Article Of Our Living Constitution?, Robert G. Dixon Jr.
Article V: The Comatose Article Of Our Living Constitution?, Robert G. Dixon Jr.
Michigan Law Review
Capacity for steady--even startling-development and relative incapacity for formal change, are twin features of American constitutionalism often noticed but seldom analyzed conjointly. Even the most stalwart supporters of the status quo do not want an unamendable Constitution, but disagreement as to how change should be effected, and the scope of it, runs deep. Indeed, this is the central problem of Marbury v. Madison. That case was the effective innovator of judicial review, our "real" system for developmental constitutionalism. Interestingly, it also was one of the quite rare instances when a seemingly simple constitutional text was at issue (scope of Supreme …

The Supreme Court And The People, Everett Mckinley Dirksen
Michigan Law Review
There is only one circumstance, as I read the Constitution, which authorizes the federal government to intrude or interfere with the governmental structure of a state. That would occur under the provisions of section 4 of article IV, which, in pertinent part, state: "The United States shall guarantee to every State in this Union a Republican form of Government .... " This was the question, if indeed there was a federal question, to be determined in the earlier Baker v. Carr and the reapportionment cases. To rely on the fourteenth amendment for authority to establish by judicial decree a new …

Concordia Theological Monthly
We salute the new year of God's grace with three articles that deal with time and history. Marvin W. Anderson has addressed himself to a historical question about the origins of the Lutheran Reformation with reference to philological reforms associated with the name of Lorenzo Valla. David W. Lotz looks at the understanding of history associated especially with the name of Rudolf Bultmann. Oscar Cullmann speaks to the whole question of the historical character of the Gospels and the message the church offers to the world in this day.
Mankato State College: An Interpretative Essay, Donald B. Youel
Mankato State College: An Interpretative Essay, Donald B. Youel
MSU Authors Collection
The account of Mankato State College which follows is not a chronicle of events. It is rather a seeking for understanding of what happened: what led up to, what was part of, what followed, of what this part and that meant - for the College and for society. It is thus an essay. The tactic has been to look at the account from different perspectives: the developing program, the enrollment, students, the state governing board, administration and faculty. Inevitably such a procedure means going over the historic events again. But since there are always many facets to each significant happening …

Monopolies During The Reign Of James I., William Charles Thompson
Master's Theses
The Statue of Monopolies or 1624 occupies a prominent place in the economic history of England. It was the first national patent law to contain all the essentials, and thereby made a large contribution to England's later technical progress.
