The purpose of this paper is to historicize contemporary gendered legal practices in the People’s Republic of China and to demonstrate that, despite rhetoric to the contrary, paternalistic assumptions rooted in Confucianism still inform the treatment of female prisoners today. Though China underwent massive political and economic shifts after the formation of the People’s Republic of China in 1949 and the death of Mao Zedong in 1976, certain longstanding societal principles were preserved in modern China, including long-held paternalistic stereotypes about the physical and mental fragility of women. Of all the claims in the Declaration of Independence, its surety about the existence of an intentional British “design to reduce” the colonists “under absolute Despotism” is perhaps the most questionable one to modern ears. Contemporary historians have largely dismissed such language, and the accompanying concerns about an alleged British plot to “enslave” its Atlantic possessions. However, this paper argues that such a view fails to properly consider the role of “the Irish precedent” of English imperial exploitation in sparking American resistance and rebellion. Pretrial Commitment And The Fourth Amendment, Laurent Sacharoff

Today, the Fourth Amendment Warrant Clause governs arrest warrants and search warrants only. But in the founding era, the Warrant Clause governed a third type of warrant: the “warrant of commitment.” Judges issued these warrants to jail defendants pending trial. This Article argues that the Fourth Amendment Warrant Clause, with its oath and probable cause standard, should be understood today to apply to this third type of warrant. That means the Warrant Clause would govern any initial appearance where a judge first commits a defendant—a process that currently falls far short of fulfilling its constitutional and historical function. Race And Republicanism In The Political Thought Of Simón Bolívar, Jeremy Cumplido
History & Classics Undergraduate Theses
This thesis examines how Simón Bolívar’s political thought on race, republicanism, and governance evolved during the Spanish American wars of independence. Early in his revolutionary career, Bolívar drew heavily from Enlightenment ideals, particularly those of Rousseau and Montesquieu, envisioning a future republic grounded in liberty, unity, and the rule of law. However, Bolívar’s initial writings reveal that he paid relatively little attention to the racial divisions that deeply fractured colonial society. Thus, his appeals for independence primarily focused on political subjugation and economic exploitation, reflecting both his Creole background and the broader colonial system’s blind spots.

We tend to live under the assumption that translations will always attempt to be faithful to their original texts, blindly believing in the infallibility of the translator. However, in doing so, we ignore how translation can be used to take advantage of the reader – how can one know that a change has occurred in a translated work if they have no knowledge of the text’s original language? History and storytelling are beautifully intertwined—every country, culture, community, and person has a tale of creation, conflict, and prosperity. The tragedy of stories, however, is that many things may never be recorded, may be lost in archives and memories, and may never be revisited again. Beginning August 2023, I’ve conducted archival research which centers around the connection and intersectionality between Indigenous peoples and Gettysburg College. Dorothy Day’s (1897-1980) life and work fell during a period of rapid social change in America. She lived as a bohemian radical and a self-proclaimed anarchist when she entered the political scene as a journalist for The Call. Disillusioned with hypocrisy and censorship on far-left socialist media, she explored and deepened her faith. Following conversion to Catholicism, Day founded the Catholic Worker. She worked to publish stories on as many different individuals as possible, even sometimes for her story, living alongside them for weeks. When aiding the poor directly, her approach was individual-based. She stressed financial freedom, and …

Georgia’S Deportation Of The Creeks And Cherokees: A Prelude To The Trail Of Tears, Sean Michael Ahearn Ii

This thesis follows the story of the forced deportation of two Native American groups, the Creeks and the Cherokees, from the state of Georgia. The Creeks were completely removed from Georgia by January of 1828, two years before Andrew Jackson’s 1830 Indian Removal Act, effectively commencing the removal of all Native Americans to lands west of the Mississippi River, now known as the Trail of Tears. William McIntosh, a Lower Creek chief, worked alongside his cousin, George Troup, the governor of Georgia from 1823 to 1827. McIntosh worked alongside Troup and negotiated land sale deals, known as the Treaties of …

The Pennsylvania Supreme Court just shot holes through the United States Supreme Court’s revanchist reading of precedent and history in to support overturning Roe in Dobbs. In Allegheny Reproductive Health Center, both the majority and the powerful concurring opinion explore the oppression inherent in both past and current conditions for women, concluding that ignoring that context makes rendering legal opinions affecting women’s rights either impossible or nonsensical. Can courts really do that? We think they not only can, but that they must.

The formation of exclusively Nisei organizations in the 1930s contributed to their rise in community leadership. When WWII began, these Nisei-led groups collaborated with the War Relocation Authority (WRA), which created a narrative of Japanese American compliance. This is evidenced in internment camp newspapers.

This paper explores the evolution of American foreign policy in the Balkans in the years preceding the Dayton Accords. Specifically, it examines the progression from America’s position of nonintervention and reluctance to engage to a role of leadership in ending the conflict. Key factors discussed include the inadequacy of early U.S. policies in the region, mounting pressure to end the violent conflict, the value placed on the NATO organization and relationship by the Clinton administration, and the unwavering commitment to keep American troops out of the conflict. This paper chronicles events surrounding the creation of the largest academic Japanese law library in the United States, while focusing on two extraordinary law faculty members at Columbia Law School and their successful fundraising efforts from the initial concept of building a Japanese law library through the establishment of permanent funding. It recounts others who tirelessly supported carrying through this arduous plan. It is about insightful visions, perseverance, and lasting personal relationships, as well as building a foreign law collection in the United States. It examines lessons to be learned.

Fashion, Freedom, And Feminism: The Transcendent Work Of Rosa Genoni And Her "Tanagra Dress" Reimagined, Christina Trupiano

The fashion industry itself is broad in scope and dependent upon numerous sub-industries to produce its garments. It is heavily dependent upon machinery of all kinds, yet unlike many industries today, it is still also largely reliant on manual labor, specifically minority women labor. This dependance upon manual labor correlates with its long history of worker exploitation and sweated labor. The concentration of exploitative labor practices in the fashion industry have made it a focal point in the ongoing struggle between workers and the downward pressure capitalism and industrialization placed on worker compensation, quality of life and job security.

This dissertation examines the advent of interstate banking in America during the second half of the twentieth century. To become the giants they are today, US financial institutions had to overcome, in fits and starts, the political limits on their geographical expansion across municipal, county, state, and national borders—and not always in that order. Faced with new competitors and harsh economic conditions, some bankers set their sights on expanding their markets to stay afloat. Many policymakers and regulators were responsive to this demand, hopeful that it could serve as a catalyst for economic growth. Challenging restrictions on interstate banking meant …
