Third State Remedies In International Law, Jonathan I. Charney
Third State Remedies In International Law, Jonathan I. Charney
Michigan Journal of International Law
This article explores issues arising from third state enforcement of international law. Support for third state remedies may be found in law, practice, and the literature. It is not, however, definitively stablished. Third state remedies may appear at first glance to serve only the desirable goal of promoting rules of international law, but they may also produce negative side effects. The challenge to the international community is to design an effective third state enforcement regime that minimizes undesirable side effects.
Jurisdiction Over Foregin Flag Vessels And The U.S. Courts: Adrift Without A Compass?, Stefan A. Riesenfeld
Jurisdiction Over Foregin Flag Vessels And The U.S. Courts: Adrift Without A Compass?, Stefan A. Riesenfeld
Michigan Journal of International Law
Jurisdiction of a nation over vessels flying a foreign flag and over persons aboard such vessels should be a relatively simple and well settled matter. The sad fact, however, is that it is not. Moreover, the recent 1986 Maritime Drug Law Enforcement Act has added unnecessary and unexplainable confusion.

Reflections On State Responsibility For Violations Of Explicit Protectorate, Mandate, And Trusteeship Obligations, W. Michael Reisman
Reflections On State Responsibility For Violations Of Explicit Protectorate, Mandate, And Trusteeship Obligations, W. Michael Reisman
Michigan Journal of International Law
There is a rich body of law dealing with breach of treaty, its consequences and the procedural options it gives to the complying party. But violations of treaty obligations by a protecting state are procedurally different from violations between states in legal and political parity and negotiating at arm's length. The protected state or state under protectorate has, by definition, a restricted if not completely suspended competence to operate at the international level and hence is unable to protect its interests against violations by the erstwhile protector. Thus, it should be no surprise that international decision has suspended the operation …

Statutory Compilations Of Washington, Kelly Kunsch
Statutory Compilations Of Washington, Kelly Kunsch
Seattle University Law Review
This Article surveys the statutory compilations of Washington. Although Washington's laws have evolved through a gradual process, compilations of these laws have had a more sporadic development. This development culminated in the Revised Code of Washington (RCW), which has remained relatively uniform since its first publication in 1951. Still, familiarity with its antecedents remains important today.

The History Of The Early Members Of The Church Of Jesus Christ Of Latter-Day Saints In Preston, Lancashire, England, Paul Floyd Smart
The History Of The Early Members Of The Church Of Jesus Christ Of Latter-Day Saints In Preston, Lancashire, England, Paul Floyd Smart
Theses and Dissertations
This thesis outlines the setting for and establishment of the Church of Jesus Christ of Latter-day Saints in the British Isles. The intent is to identify and analyze who the early converts were that first embraced Mormonism in England, in and around Preston, Lancashire. The study describes the extant records, the social and economic family lifestyle, and religiosity of the Mormon converts from 1837, upon the Church's arrival in Britain, to approximately 1851.

The Dismantling Of De Jure Segregation In Louisiana, 1954-1974. (Volumes I And Ii)., Carroll Joseph Dugas
LSU Historical Dissertations and Theses
In the two decades between 1954 and 1974, the State of Louisiana progressed from a closed, white-dominated society to an open, multi-racial society with legal safeguards in place to assure equal protection and equal opportunity for all residents regardless of race or color. Prior to 1960, the vast majority of blacks were unable to vote, serve on juries, buy homes in decent neighborhoods, use publicly-owned facilities or frequent hotels, restaurants and other public accommodations. In addition to these humiliations, they were required to utilize inadequate "separate but equal" public parks, playgrounds, swimming pools, schools, waiting areas and correctional facilities until …

Pro Bono Publico: New Orleans Politics And Municipal Reform In The Progressive Era, 1912-1926. (Volumes I And Ii)., Terrence Walter Fitzmorris
LSU Historical Dissertations and Theses
Social prejudice and moral consideration did not form the basis of city politics and municipal reform in New Orleans during the Progressive Era. The Regular Democratic Organization, the so-called political machine and the civic reformers of New Orleans were more concerned with issues of expanding and centralized municipal authority, regulation of private and public corporations, completion and expansion of public services, "living wages" and decent working conditions for organized labor, equitable taxation and assessment rates for property holders, and city planning and development. Admittedly, the principal leadership of the municipal reform movement came from the "upper crust" of New Orleans …

The Future Of Liberal Legal Scholarship, Ronald K.L. Collins, David M. Skover
The Future Of Liberal Legal Scholarship, Ronald K.L. Collins, David M. Skover
Michigan Law Review
Earl Warren is dead.
A generation of liberal legal scholars continues, nevertheless, to act as if the man and his Court preside over the present. While this romanticism is understandable, it exacts a high price in a world transformed.
The following commentary is a reconstructive criticism written from the perspective of two liberals concerned about the future of "legal liberalism." We present our views as a commentary to emphasize their preliminary character; they represent our current assessment of where liberals stand and where they might redirect their energies.
The Foundations Of Saint Vincent De Paul, Jose M. Roman C.M.
The Foundations Of Saint Vincent De Paul, Jose M. Roman C.M.
Vincentian Studies
By tracing history of the Congregation’s establishments and houses, how they were made, and how they were supported, we can appreciate Vincent de Paul as an organizer and administrator and understand the Congregation’s development. Vincent’s principles for foundations were to never take the initiative in establishing them, to accept only stable ones, and to start with small ones to build up larger ones. He was careful to ensure that the Congregation and its works would be self-sufficient. Initiative for foundations came largely from bishops, but also from wealthy laity, teams of founders, and royalty. Foundations replicated the Congregation’s initial one, …

Smooth The Dying Pillow: Alaska Natives And Their Destruction [Original Paper], Stephen Conn
Smooth The Dying Pillow: Alaska Natives And Their Destruction [Original Paper], Stephen Conn
Conference papers
The policy for Native self-determination in Alaska developed by the Congress and the state has sought to replace a tribal model of governance with a body of legislation which confirms land rights without the direct political involvement of Alaska Native villages. However, the author argues, the absence of tribes as formal political structures has contributed to a loss of self-determination among Alaska Natives and to serious negative effects on Native village life.
