Unavoidability In U.S. Privacy Law, Laura M. Moy

Why is U.S. privacy law structured the way it is, with a series of sectoral laws rather than a cross-sectoral law or laws? Why does U.S. privacy law protect information shared in certain contexts—such as information shared with an attorney, a healthcare provider, or a financial provider—rather than particular types of information? One possibility is that sectoral laws apply to contexts in which people typically share highly “sensitive” information containing intimate secrets or with the potential to harm them financially or psychologically.

The Effect Of Model Size On The Root Mean Square Error Of Approximation (Rmsea): The Nonnormal Case, Yunhang Yin

This study aimed to understand the effect of model size on the Root Mean Square Error of Approximation (RMSEA) under nonnormal data. We considered three methods for computing the sample RMSEA and the associated confidence intervals (i.e., the normal theory method [Browne & Cudeck, 1993], the BSL method [Brosseau-Liard, Savalei & Li, 2012], and the Lai method [Lai, 2020]). The performance of the three methods was compared across various model sizes, sample sizes, levels of misspecification, and levels of nonnormality. Jeffrey Gurock’s parents, his father, originally from Harlem and his mother from Brooklyn, were among the first people to move into Parkchester when it opened. His father was a firefighter and his mother was a bookkeeper. Gurock was born in 1949 and lived in Parkchester until he married in 1974. After living briefly in Cincinnati, Ohio, he returned to the Bronx and has been living in Riverdale ever since.

Gurock remembers Parkchester as predominantly Irish Catholic with many Italian and Jewish children. No Hispanics or African Americans were allowed to move in until 1968. While he recognizes this segregation now, …

The History Of Forensic-Science Evidence In Criminal Trials And The Role Of Early “Success” In Establishing Its Putative Reliability, Carrie Leonetti

This Article posits the history of forensic-science evidence plays a significant role in the unquestioning manner of its modern acceptance. It traces early high-profile forensic science “successes” and the public reactions to them. It argues the public perception of the “advances” of forensic science continues to play a role in the lack of scrutiny given to these disciplines in admissibility decisions today. It concludes, when it comes to forensic science, history should play a different role by serving as a critical warning rather than a congratulatory buttress.

Witchy Politics: Witches And Witchcraft As Political Tropes From Malleus Malleficarum (1487) To Les Sorcières De La République (2016) And The Mercies (2020), Mallaury Joëlle Marie Gauthier

The focus of this thesis are two recent novels featuring witches: Chloé Delaume’s Les Sorcières de la République(The Witches of the Republic, 2016) and Kiran Millwood Hargrave’s The Mercies (2020). The first is a futuristic dystopia set in 2062, during the witch trial of the Sibyl of Cumae. The second is a work of historical fiction based on witch trial records and set in seventeenth-century Finnmark (Norway). Both are feminist novels, and both emphasize the political valence of the witch as a gendered figure. This figure emerged from the misogyny of early modern demonology but acquired its contemporary contours …

Urban greenspaces are integral to the healthy functioning of a city. They provide heat relief, flood prevention, act as sites of community engagement and creation, and are home to charismatic flora and fauna, to name just a few of their roles. However, this importance has not translated to scholarly analysis. This thesis aims to address this shortcoming in several ways. Firstly, it introduces the typology of environmental entropy, a framework of analysis that recontextualizes greenspaces as blended landscapes, where nature and culture and human and nonhuman agency equilibrate. Locating Queer Possibilities: Lgbtq+ Folks Negotiating Community And Belonging In Idaho, 1969-2011, Rachel Taylor

Americans—regardless of their sexual orientation or home state—generally assume that Idaho is hostile towards queer folks. Linking rurality to homophobia and bigotry, they believe queer people are safer and happier in metropolitan settings with visible queer communities. However, the lived experiences of queer Idahoans reveal that LGBTQ+ people have built communities and found belonging around the state, even outside the state’s most populous city, Boise. Whereas queer people in urban areas like San Francisco historically emphasized the ways they differed from the straight public, queer Idahoans found safety and belonging by emphasizing their similarities with straight people. The United States’ immigration court system is located within the U.S. Department of Justice’s Executive Office for Immigration Review and operated under the power of the attorney general. Consequently, the attorney general can review and overrule decisions made by the Board of Immigration Appeals, the immigration appellate body. If the attorney general uses this authority, his decision cannot be reconsidered, and his opinion becomes precedent. Immigration courts are unique in that no other court system is located within or controlled by the executive branch. The Cuban Missile Crisis At Sea—Avoidance Of Nuclear War Not Left To Chance, Theodore Voorhees

Many contradictions emerge from the nine published accounts of the confrontation between the Soviet submarine B-59 and American antisubmarine-warfare units during the Cuban missile crisis of October 1962. Assessing those accounts reveals that no participant should be anointed as “the man who saved the world,” and that the peaceful conclusion of the confrontation should not be attributed to good luck.

Judging The Body: Disability, Class And Citizen Identity—A Case Study From An Ancient Greek Lawcourt, Justin L. Biggi

Journal of Gender, Ethnic, and Cross-Cultural Studies

This paper aims to showcase how one person's disabled identity—that of the unnamed defendant of the legal speech Lysias 24, who was accused of faking his disability to obtain social security payments—interacted with wider conceptions of citizen identity and citizenship in 5th century BCE Athens. This paper brings a much-needed intersectional approach to the speech: by viewing the speaker's disabled identity as shaped by his economical status (and vice-versa), this in turn shapes the way we can interpret his experience of citizen identity, as well as his sense of belonging to a citizen body. The Jesuit Colleges That Weren't: Conewago Latin School And Guadalupe College, Michael Rizzi

This article offers a brief history of two obscure and often overlooked Jesuit schools from the nineteenth century: the Conewago Latin School in Pennsylvania and Guadalupe College in Texas. Although neither school ever fully developed into a true institution of higher education, they began life similarly to other Jesuit schools of the 1800s, and under different circumstances they might have evolved, like those other schools, into true American colleges. The purpose of this historical sketch is to preserve the memory of these nearly forgotten Jesuit institutions.

This research seeks to analyze and understand the approach and treatment of victims of sexual assaults stories and accounts using case studies of the Holocaust and the Rwandan genocide. Research was conducted by collecting and reading first-hand accounts of survivors and their experiences of sexual assault, then analyzing the historical response following the events. The two case studies are synthesized and compared in this project to understand which attributes of political and social policy effected the reception of stories of victims and witnesses of rape and assault. While scholars have begun in recent years to give more attention to the Civil War in the Trans-Mississippi region (including the Indian Territory), few have attempted to provide nuanced and comprehensive explanations for the actions of native peoples who took part in the conflict. While the pre-removal era of Choctaw history has received copious attention, the thirty years between removal and the Civil War have received only sparse examination. Historians who have written about this period have typically either gone into very little detail about why the Choctaws sided with the Confederacy or they have identified only one or two …
