Many legal scholars have observed that the current Supreme Court is returning to the doctrines, values, and methods of reasoning that were employed between 1873 and 1937-the Lochner era and the era immediately preceding it.1 As it did during the Lochner era, the current Supreme Court elevates property rights over personal rights;2 strikes down major civil rights legislation;3 arrogates power to itself by ignoring legislative intent and administrative expertise;4 and relies on tradition instead evidence-based reasoning to interpret the law.5

The Color Of Disease: Race Science, Pandemic Influenza, And The Rise Of Epidemiology In The Segregated South, Andrew Kishuni

This thesis evaluates the relationship between race science and eugenics, statistical epidemiology and Southern public health thought, African American health, and the 1918-1920 influenza pandemic. Historians have neglected the flu as an important epidemiological event in Southern history and historiography. To demonstrate the significance of the flu, this thesis makes several arguments based on research from new qualitative and quantitative evidence. The chief argument is that African Americans suffered disproportionately compared to whites in the South, challenging the consensus that the flu affected both races equally. Segregation did not protect African Americans from the flu. In some cases, African Americans …

We have students use the Al Explainpaper to be able to read and understand journal articles as this is a common assignment in many core classes. In our experiences, students often struggle to understand the content of journal articles and then struggle to use the journal article as a source in their writing. The Al Explainpaper provides an opportunity for students to use the bot to better understand the journal article and have an opportunity to ask the program additional questions about the article. The act of restoring emotional reactions back to logical thinking are the core teachings of this paper. How do identity and citizenship interact? Puerto Rico’s current political status is that of an unincorporated, organized territory of the United States, under the shiny title of ‘Commonwealth.’ Although they have US Citizenship, Puerto Rican residents aren’t protected by the US Constitution. This source of dual identification, American and Puerto Rican, creates a unique circumstance where questions of identity, and belonging naturally arise. Mass public defiance of legal authority has a lengthy history in America, extending back to the nation’s founding. Indeed, the very existence of the United States is the result of the ultimate act of defiance against legal authority—the revolution against Great Britain. It hardly stopped there, however. Defiance of legal authority has persisted from the outset to the present. Examples include Shays’ Rebellion, defiance of the Supreme Court’s decisions in M’Culloch v. This article considers different applications of the Purchaser-Seller Rule that a plaintiff must satisfy to bring a Section 10(b) and Rule 10b-5 private action. The history and development of the Purchaser-Seller Rule under Supreme Court and lower federal court jurisprudence is considered, with emphasis on recent case law unduly constricting this Rule. In particular, the Second Circuit’s restrictions on Section 10(b) standing are addressed, focusing on that appellate court’s decision in Frutarom which adhered to an overly formulaic approach to Section 10(b) standing that is out of line with prior Second Circuit and Supreme Court precedent. Betty Ann McNeil profiles Louise de Marillac as “a prototype social worker whose social service interventions highlight how twenty-first-century social issues echo those of the seventeenth century.” In response to the political, religious, and social upheaval in seventeenth-century France, she and Vincent de Paul founded the Confraternities of Charity and the Daughters of Charity. These groups made innovative use of women’s leadership and organizational skills to provide the poor with quality care. McNeil explains how Louise’s “approach to serving people in need remains relevant for social work practitioners today.”

Located on both sides of the Polish-Belarusian border in north-eastern Poland, the Białowieża forest is the largest remaining remnant of the vast primeval forest that once covered most of Europe. It is also home to Europe’s biggest land animal—the European bison. Over the past century Polish governments, as well as modern-day Polish and European environmental groups, have promoted the forest as the “last European wilderness.” Even today, the public regularly protests and decries news of human encroachment on the forest. Therefore, violence is culturally relevant. We develop a method for creating a lexicon of all correctly spelled surnames in historical US records. We focus specially on the full-count 1850-1940 census records which include over 10 million unique spellings in the surname field. We use links across multiple census records to identify the correct spellings of the surname transcriptions.

This thesis examines how gender and ideas about gender affected early female mountaineers and rock climbers. The study focuses on female dress standards in the Victorian era, the relative equity of accomplishment between male and female mountaineers and climbers, the portrayal of female climbers in the media, and the misrepresentation of female motivations for climbing. By analyzing primary sources from female climbers and mountaineers, this paper uncovers how women challenged traditional gender roles and navigated the complexities of the male-dominated climbing community.

The Hangman, Not The Prince, Steve Hughes

For the first time, contemporary records of the 1870s, 1880s and 1890s, including interviews with George Maledon, have been used to document that George Maledon, known for almost 150 years as “The Prince of Hangmen,” was, despite his contentions, not the hangman for all of the murderers executed in Fort Smith, Arkansas, between 1873 and 1896. Rather, his legendary status came as a result of his manipulation of sensationalist reporters who came to Fort Smith to witness the hangings and whose stories were reprinted around the country.

The goal of this manuscript is to present and summarize several rare pediatric syndromes (Zellweger syndrome, Kartagener syndrome, Prader-Willi syndrome, Schinzel-Giedion syndrome, Fanconi anemia, Joubert-Boltshauser syndrome, Poretti-Boltshauser syndrome, and Langer-Giedion syndrome) who have been named after luminary "Swiss" physicians (pediatricians, pediatric neurologists, or pediatric radiologists) who recognized, studied, and published these syndromes. In this manuscript, a brief historical summary of the physicians is combined with the key clinical symptoms at presentation and the typical imaging findings.
