Is Now The Time For Simplified Rules Of Civil Procedure, Paul V. Niemeyer Jan 2013

Is Now The Time For Simplified Rules Of Civil Procedure, Paul V. Niemeyer

University of Michigan Journal of Law Reform

Unfortunately, any objective evaluation of current federal civil process will inevitably lead to the conclusion that the process is functioning inadequately in its purpose of discharging justice speedily and inexpensively. One need only ask any trial lawyer whether he can try a medium-sized commercial dispute to judgment in a federal court in less than three years and at a cost of less than six figures. Is the iconic appellation of "making a federal case out of a dispute" not the ultimate condemnation of current judicial process in federal courts? Can we understand the private bar's flight from federal courts to …

Dignité/Dignidade: Organizing Against Threats To Dignity In Societies After Slavery, Rebecca J. Scott Jan 2013

Dignité/Dignidade: Organizing Against Threats To Dignity In Societies After Slavery, Rebecca J. Scott

Book Chapters

This chapter is not an attempt to join the fractious debate over philosophical first principles or juridical first usages of the term 'dignity'. Instead, it explores the tight connection between the institution of slavery and the giving of specific meanings to the concept of dignity, in particular times and particular places. To explore the dynamics of the intertwined process of creating and drawing upon meaning for the terms 'dignity' and 'slavery', I examine two historical movements that emerged after formal abolition.

Between Pulpit And Pew: The Supernatural World In Mormon History And Folklore, Curtis Ashton, Michael S. Van Wagenen, W. Paul Reeve

BYU Studies

In an address to a joint meeting of the Utah Historical Society and the Folklore Society of Utah in 1991, folklorist William A. Wilson applauded the two organizations for their cooperation over the previous twenty years and then urged even greater cooperation between history and folklore in Utah over the next twenty years. Between Pulpit and Pew serves as one benchmark for measuring just how seriously a rising generation of historians have taken Wilson's challenge. The editors, Paul Reeve and Michael Van Wagenen, are firmly planted in their chosen discipline, each with an impressive start to developing careers that explore …

Burn, Boil & Eat : An Intersection Analysis Of Stereotypes In The Most Influential Films Of All Time, Roslyn M. Satchel

LSU Doctoral Dissertations

This research builds upon the work of Entman & Rojecki (2001) in examining the ways the most influential movies use racial stereotypes in media frames. The results of this study contribute to the rather limited mass media research and body of knowledge regarding the media content that attracts the largest and most enduring audiences in the new media landscape. As ten of the films that have generated the most revenue, the movies in this sample constitute a genre of movies that are also a prime feature of on-going publishing, cable, internet, digital gaming, DVD, and movie sequel franchises. If, as …

Investigating "Experimentalism" : A Case Study Of The Tuba And Its Repertoire, Andrew Brian Larson

LSU Doctoral Dissertations

The extant repertoire for the tuba serves as a landmark for how the tuba was perceived at that moment in time by that composer. This document contains a brief analysis of the tuba “experiment” that has been ongoing since its invention. In addition, it contains a brief parallel case study of the saxophone and how this instrument, invented at about the same time as the tuba, has embraced experimentalism and modern performance. This document contains five major sections. The first provides a brief history of the tuba and its predecessors. The second introduces numerical data representing the performance frequency of …

Voices From The Coolest Corner Of Hell: A Content Analysis Of Slave Narratives In The Study Of Creolization In The Education Of 19th Century African American Slaves, Gina M. Rizzuto Jan 2013

Voices From The Coolest Corner Of Hell: A Content Analysis Of Slave Narratives In The Study Of Creolization In The Education Of 19th Century African American Slaves, Gina M. Rizzuto

LSU Doctoral Dissertations

The general argument made by Southern historian, Ulrich Bonnell Phillips in 1918, is that the plantation functioned as a type of school for the slave. Similarly, in 1976, Anthony Gerald Albanese examined the plantation system as an institution that conditioned the behaviors of both slaves and slave owners. I maintain that the plantation system was not only an educative agency that conditioned behaviors, but also a conduit for the creolization process. The focus of this study is creolization in the education of African American slaves in the nineteenth century. This is a mixed methods content analysis of African American slave …

Nixon And The Environment, Erwin Mauricio Escobar

Electronic Theses and Dissertations 2010 - 2019

the decades after World War II the United States became the most prosperous nation in the world. Yet, that prosperity and growth had a negative impact on the environmental quality of the nation. By the mid 1960s there was a rise in concern over environmental issues in the American public. Consequently, President Richard M. Nixon in his determination to give the American people what they sought decided to enact policies to bring the environmental crisis to an end. Among the environmental policies of the Nixon Administration was the Clean Air Act of 1970, a highly controversial piece of legislation that …

Using The Visual To "See" Absence, Nancy Carol Stein Jan 2013

Using The Visual To "See" Absence, Nancy Carol Stein

Electronic Theses and Dissertations 2010 - 2019

Thessaloniki, a city with an Ottoman, Byzantine, and Sephardic past, is located in the Balkan area of Macedonia, in northern Greece. Its history is the story of people who have come from someplace else. For several hundred years, the majority population of the city was comprised of Spanish speaking Sephardic Jews who contributed to all aspects of the development of the city. This significant presence is no longer visible unless one specifically knows where to look for its traces. It is not a history that has been silenced or erased, but rather obliterated. In this dissertation, I present the documented …

Edith Wharton, Betty. Feuerberg Jan 2013

Edith Wharton, Betty. Feuerberg

Electronic Theses and Dissertations 2010 - 2019

Edith Wharton uses characterization in the primary three characters in The Age of Innocence to explore the aspects of her life. Early adulthood is represented by May Welland Archer, who was born into New York 400, where society suppressed an individual's emotions, aspirations, and freedoms. The intermediate phase of her life is depicted in Newland Archer, who tests the confining limits of the society to which he belongs and strives to understand the role of emotions in achieving personal satisfaction. Wharton rejected and craved the ties of the New York 400 in the final phase of her life as portrayed …

"A Spirit Of Benevolence", Jennifer L. Boxen

Electronic Theses and Dissertations 2010 - 2019

This thesis argues that the British Public Health movement did not begin in 1842 with Edwin Chadwick's publication, Report on the Sanitary Conditions of the Labouring Population of Great Britain (1842), or in 1848, with the subsequent passage of the Public Health Act. The beginning of the public health movement was instead the product of local initiatives such as the Manchester Board of Health, administered not by central government, but by members of the local community supported by predominantly philanthropic funding. The Manchester movement predated Chadwick's efforts by at least half a century and bore a greater resemblance to the …

Dubbin' The Literary Canon: Writin' And Soundin' A Transnational Caribbean Experience, Warren Harding Jan 2013

Dubbin' The Literary Canon: Writin' And Soundin' A Transnational Caribbean Experience, Warren Harding

Honors Papers

In the mid-1970s, a collective of Jamaican poets from Kingston to London began to use reggae as a foundational aesthetic to their poetry. Inspired by the rise of reggae music and the work of the Caribbean Artists Movement based London from 1966 to 1972, these artists took it upon themselves to continue the dialogue on Caribbean cultural production. This research will explore the ways in which dub poetry created an expressive space for Jamaican artists to complicate discussions of migration and colonialism in the transnational Caribbean experience.

In order to do so, this research engages historical, ethnomusicological, and literary theories …

Rethinking: The Understanding Of Learning And Assessment In The Millennial Generation, Joseph R. Stasio Jr. Jan 2013

Rethinking: The Understanding Of Learning And Assessment In The Millennial Generation, Joseph R. Stasio Jr.

AMTP Proceedings 2013

Much has been written and discussed about the challenges of educating members of the Millennial Generation. There is little agreement about which sentiment is more accurate; they are lazy, entitled and spoiled with little incentive to excel academically or they are different than other generations in learning styles and motivation. What does garner agreement is that changes in teaching approaches are warranted if improvement in learning is to be achieved. This paper explores some of these arguments and makes a case for a number of changes to achieve this end.

Integrating Disciplinary Literacy Into Middle-School And Pre-Service Teacher Education, Jaime Colwell, David Reinking

Teaching & Learning Faculty Publications

This case describes a summary of a formative experiment, a framework specific to educational design research, simultaneously conducted in a middle-school history classroom and a university social studies methods course. The purpose of the study was to refine an intervention to promote disciplinary literacy in history. The intervention provided middle-school students and pre-service teachers with explicit strategies to promote disciplinary literacy, while participating in a collaborative blog project engaging them in disciplinary literacy. Conclusions suggest practical consideration for implementation of disciplinary literacy into history. The case outlines the five phases of the formative experiment and briefly overviews modifications made during …

"Go, Going, Gone": Anti-Chinese Sentiment In Washington Territory, 1885-1886, Naomi Eide

History & Classics Undergraduate Theses

Unwilling to conform to the pressure set forth by the national government, the citizens of Washington Territory, during 1885 and 1886, united to purge the region of the Chinese through a systematic ethnic cleansing of two major territorial cities. Motivated by the desire to become active members of the federal government, Territorial leaders ignored the negative effects of population exclusion and led an active movement rallying around the cry that “the Chinese must go.” Not until the lawlessness of the rioters shut down the territorial government, did the political agitators acknowledge how outsiders perceived their drastic actions, realizing that the …

Videopoetry: Collaboration As Imaginative Method, Peter Lutze, James Armstrong, Laura Woodworth-Ney

Literacy, Language and Culture Faculty Publications and Presentations

Three Idaho professors (a poet, videographer, and historian) have been collaborating for eight years on a cross-disciplinary project called VideoPoetry, which integrates historical narration, narrative poetry, historical photographs, and videography into the video medium. To this point we've worked primarily on a specific program, Culture of Reclamation, which explores the culture of the early irrigated landscape communities in southern Idaho. In reflecting on our work-process, we’ve discovered that we’ve fundamentally changed as scholars as a result of our collaboration. This paper identifies the nature of our changes and documents instances of the ways in which we have been challenged to …

School Reform: Where Does Policy Come From? Where Should It Go?, Kim Karman Friel Dec 2012

School Reform: Where Does Policy Come From? Where Should It Go?, Kim Karman Friel

UNLV Theses, Dissertations, Professional Papers, and Capstones

Policy analysis helps to develop a greater understanding of societal problems and provide possible solutions for elected and non-elected government decision makers. Ultimately, the product of analysis is advice relating to public decisions and informed by social values. In light of the pressures placed on education by policy-makers concerning implementation of educational reform there are surprisingly few studies concerning the changing role of the federal government from a historical perspective. Looking at the past, with the present in mind, reminds us that the current shape of education was not inevitable.

This qualitative dissertation study analyzes the evolution of the intentions …
