Outsourcing The Law: History And The Disciplinary Limits Of Constitutional Reasoning, Helen Irving
Outsourcing The Law: History And The Disciplinary Limits Of Constitutional Reasoning, Helen Irving
Fordham Law Review
Debates about the use of history in constitutional interpretation find their primary nourishment in the originalism debate. This has generated a vast amount of literature, but also narrowed the terms of the debate. Originalism is a normative commitment wrapped in a questionable methodological confidence. Regardless of the multiple forms originalism takes, originalists are confident that the meaning (in the sense of intention) that animated the framing of the Constitution can be ascertained and, indeed, that they can ascertain it. The debate has largely focused, then, on whether modern-day scholars and jurists can ascertain original historical meaning or, alternatively, whether they …
The Global Architecture Of Financial Regulatory Taxes, Carlo Garbarino, Giulio Allevato
The Global Architecture Of Financial Regulatory Taxes, Carlo Garbarino, Giulio Allevato
Michigan Journal of International Law
This Article endeavors to broaden the analysis of available policy tools to address the problems created by financial crises and discusses how, in addition to direct regulation, certain tax measures having a regulatory nature may operate to address the so-called “negative externalities” often associated with those crises. There is a negative externality when an economic agent making a decision does not pay the full cost of the decision’s consequences. In such cases, the cost to society as a whole is greater than the cost borne by the individuals creating the economic impact. In practice, negative externalities result in market inefficiencies …
A Gadamerian Analysis Of Roman Catholic Hermeneutics: A Diachronic Analysis Of Interpretations Of Romans 1:17-2:17, Steven Floyd Surrency
A Gadamerian Analysis Of Roman Catholic Hermeneutics: A Diachronic Analysis Of Interpretations Of Romans 1:17-2:17, Steven Floyd Surrency
USF Tampa Graduate Theses and Dissertations
Catholic exegesis of scriptural and dogmatic statements has become rigid in the period following the Enlightenment. Gadamer’s account of philosophical hermeneutics, when applied to the Catholic situation, elaborates how Catholic exegesis might return to its premodern, freer form. Following Gadamer, I hold that to understand is to fuse the horizon of the old with today’s horizon using the preunderstandings that have been provided by the tradition while at the same time bringing the questions of today into dialogue with the text.
Examples of how Romans 1 and 2 have been interpreted historically serve to support this thesis. Origen reads Romans …

History, Governmental Structure, And Politics: Defining The Scope Of Local Board Of Health Power, Pekham Pal
History, Governmental Structure, And Politics: Defining The Scope Of Local Board Of Health Power, Pekham Pal
Fordham Law Review
Local boards of health often issue regulations that have broad effects that surpass the borders of the city or county to which they apply. Promulgation of such rules by board of health members appointed by the executive branch implicates separation of powers concerns; because such regulations may so extensively burden a locality’s citizens, it may be more appropriate for elected officials to adopt these regulations. Indeed, local businesses or other interested parties often bring suit challenging local board of health actions. Courts apply different analytical methodologies to review these challenges, which often leads to incongruent local health agency discretion for …

All Propaganda Is Dangerous, But Some Are More Dangerous Than Others: George Orwell And The Use Of Literature As Propaganda, Samantha Senn
All Propaganda Is Dangerous, But Some Are More Dangerous Than Others: George Orwell And The Use Of Literature As Propaganda, Samantha Senn
Journal of Strategic Security
The true battles of the Cold War between the United States and the Soviet Union were fought on the ideological front: pitting democracy and capitalism against totalitarianism and communism. The Office of Policy Coordination (OPC) of the Central Intelligence Agency (CIA) was formed in the late 1940s to help combat the spread of Communism across Europe and in the United States. Part of the “psychological warfare” included the use of propaganda. Around the same time, British author George Orwell had recently published Animal Farm and Nineteen Eighty-Four. Both novels, due to the anti-Communist overtones, were adopted by the OPC …

Liberating Genocide: An Activist Concept And Historical Understanding, Tony Barta
Liberating Genocide: An Activist Concept And Historical Understanding, Tony Barta
Genocide Studies and Prevention: An International Journal
From the outset, historians of genocide have seen themselves as activists. Among historians of colonial societies that is what distinguishes them most in relation to indigenous peoples. An ethnographic sensibility should be visible in any such study, and the more so when a question of genocide is raised. After all, if we do not have a sense of difference between peoples we fail the test of genocide at the first hurdle. And if we do not have an ethnographic sensibility towards our own cultures (including academic cultures) we will fail to make the most of our role in affecting deeply …

The Living Heritage Of Prepping, Julianna Marilyn Lindsay
The Living Heritage Of Prepping, Julianna Marilyn Lindsay
Student Theses and Dissertations
Within the prepping community there are a subgroup of preppers, homesteaders, and survivalists who to varying degrees base their behaviors and motivations on heritage connections. These connections are found in the form of heritage values which inform their actions. Prepping, survivalism, and homesteading are not a monolithic movement or even necessarily seen as a movement at all by participants who may share no connections with others involved in the same activities. Although preppers, homesteaders, and survivalists may display some of the same behaviors such as stockpiling food or other aspects of material and intangible culture, their motivations may vary widely. …

On The "Poverty Of Responsibility": A Study Of The History Of Child Protection Law And Jurisprudence In Nova Scotia, Ilana Luther
PhD Dissertations
This thesis presents a history of child protection law and jurisprudence in Nova Scotia. The thesis begins by examining the development of the first child protection statute in Canada, the Nova Scotia Prevention and Punishment of Wrongs to Children Act in 1882. The Act was developed amidst a climate of reform in late-19th century Halifax, at the urging of the Society for the Prevention of Cruelty to Animals. The Act, along with a number of other pieces of “domestic relations” legislation at the time, was focused on protecting children in poverty. With the passing of the Act, the legislature not …

Chateaubriand And His Influence On The Early French Romantics' Perspective On Nature, Kyra Kalina Sanchez Clapper
Chateaubriand And His Influence On The Early French Romantics' Perspective On Nature, Kyra Kalina Sanchez Clapper
Electronic Theses and Dissertations Archive
This work analyzes Chateaubriand's writings on America and compares them to Rousseau's philosophical writings on nature. In doing so, Iargue that Chateaubriand showed an exception interest in nature without human intervention - unlike Rousseau, who had an anthropomorphic approach to nature. By emphasizing Chateaubriand's nonanthropomorphic approach to nature, this paper rejects the monolithic view of FrenchRomanticism and contributes a deeper understanding of this important trend eighteenth century onwards. In order to arrive at a global picture of Chateaubriand's idea of nature, the primary source I will analyze are Chateaubriand's Atala, Voyage en Amerique, and Memoires d'outre-tombe and Rousseau's Discours sur l'origine …

Which Medicine? Medicine-Taking And Changing Sherpa Lives, Susan Heydon
HIMALAYA, the Journal of the Association for Nepal and Himalayan Studies
An increasing quantity of medicines, including medicines of different healing systems, have become available since the nineteen fifties to the mainly Sherpa inhabitants of the Mt. Everest region of Nepal. Considerable change and economic development has occurred in which this mountainous and remote area has become one of Nepal’s principal tourist destinations and people have gained access to education, health services, and modern means of communication. Many Sherpa travel regularly in Nepal and overseas, especially for work, education, or pilgrimage, or have migrated permanently. Focusing on oral histories, this article explores factors that have influenced people’s use of different medicines …
