The "Loyalist Problem" In The Early Republic: Naturalization, Navigation And The Cultural Solution, 1783--1850, Emily Iggulden

Traditionally, studies of the Loyalists from the American Revolution highlight their wartime experience or explore their post-war experience as exiles in other areas of the British Empire. Instead, this study begins in 1783 and focuses on the majority of Loyalists who stayed in the United States after Independence. Using legal documents, personal correspondence, and popular newspapers the "Loyalist Problem in the Early Republic," analyzes the legal and cultural dimensions of citizenship from the Loyalist's perspective. It suggests that the Loyalists played a significant role in the legal and cultural formation of American citizenship and national identity. Additionally, it explores the …

Anti-Semitism And The Early Printing Press: A Study Of The Effect Of The Printing Press On Jewish Expulsions In Germany, 1450-1520, Amy O'Callaghan

At the end of the fifteenth century, the Holy Roman Empire saw a dramatic escalation in anti-Semitism that paved the way for one of the largest waves of Jewish expulsions in medieval history. The Jews were expelled from Endingen in 1470, Mainz in 1473, and following the case of Simon of Trent, the Trent Jews were banished in 1475 and the Jews of Pass au in 1479; by the end of the fifteenth century Mecklenburg, Magdeburg, Salzburg and Nuremberg had also succeeded in driving out their Jewish populations. This Thesis explores the question, "what are the politics of de-listing an endangered species?" The Yellowstone grizzly de-listing process offered environmental organizations a platform to provide the general public with a genuine opportunity to engage with the comments and positions, to the federal government. It contends that a symbolic consensus has been constructed about the American West, Yellowstone National Park and the grizzly bear and these constructed were strong enough to generate the majority of edited responses to the Fish and Wildlife Service during the de-listing process. Christianity And The Legal Status Of Abandoned Children In The Later Roman Empire, Joshua C. Tate

Late Roman imperial legislation relating to abandoned or exposed children has been the subject of much debate. Some have argued that the constitutions of Constantine relating to abandoned children marked a new Christian influence, and that the years between Constantine and Justinian merely refined and explained Constantine's legislation. This paper argues that the legislation of Constantine was not distinctly Christian in content, but that some Christian influence can be seen in the rhetoric of imperial constitutions beginning in the fifth century, and that Christian ideas seem to have affected both the substance and the rhetoric of Justinian's legislation. The poems in this thesis seek to explore the notion of uncertainty in terms of its value as both an intellectual and political position. Uncertainty is echoed both in subject matter and form. It serves not as a tool of conservatism, but as an opportunity towards empathy and expansion in a narrowing world; Ecology also plays a prominent role in both the poetry as well as the development of uncertainty and sustainability. The poems seek to broaden conceptions of ecology by drawing often disparate objects and concepts in proximity. These poems then exist in the anxiety of trying to understand …

In The Trenches: Searches And The Misunderstood Common-Law History Of Suspicion And Probable Cause, Fabio Arcila
Scholarly Works
A detailed analysis of the common law during the Framers’ era, and of how it reflected the Fourth Amendment’s restrictions, shows that many judges believed they could issue search warrants without independently assessing the adequacy of probable cause, and that this view persisted even after the Fourth Amendment became effective. This conclusion challenges the leading originalist account of the Fourth Amendment, which Professor Thomas Davies published in the Michigan Law Review in 1999.

"Swallowing Mexico Without Any Grease": The Absence Of Controversy Over The Feasibility Of Annexing All Mexico, 1847--1848, Timothy Evans Buttram

This study contributes to the historiography of the "all Mexico" movement by showing that America's ability to annex its southern neighbor was never a part of the all Mexico debate. The thesis argues that common American perceptions of the United States and Mexico during the Mexican-American War undermined any grounds on which to challenge the achievability of annexation. Chapter I shows that no politician, regardless of his stance on the value of absorbing Mexico, questioned the feasibility of doing so. Chapter II then demonstrates that portrayals of the United States and Mexico in American newspapers supported confidence in the American …

Time Reversal, Brian E. Anderson, Michele Griffa, Paul A. Johnson, Carene Larmat, Timothy J. Ulrich

This article provides an historical overview of Time Reversal (TR), introduces its basic physics, addresses advantages and limitations, and describes some applications of this very active research area of acoustics. In the Geophysics Group at the Los Alamos National Laboratory, we conduct studies of TR of elastic waves in solids. Our work includes application of TR to nondestructive evaluation of materials, as well as to earthquake source characterization, and ground-based nuclear explosion monitoring. We emphasize the term elastic waves here to underscore that we include both compression and shear waves, in contrast to purely acoustic waves that are only compressional.

Wetlands regulation in the United States has a tumultuous history. The early European settlers viewed wetlands as obstacles to development, and they drained and filled wetlands and swamps at an astounding rate, often with government support, straight through the middle of the twentieth century. As evidence of the ecological significance of wetlands emerged over the last several decades, programs to protect and restore wetlands became prominent. Most notable among these is the permitting program under section 404 of the Clean Water Act. That provision prohibits dredging or filling of "navigable waters, " defined by law to mean "waters of the …

Although separated by more than 500 years, Christine de Pisan's "The Book of the City of Ladies" (1405) and Judy Chicago's "The Dinner Party" (1979) were created to validate and defend women and women's achievements and to move them from the periphery of the historical canon to the center, alongside accomplished men of history. Both are responses to misogynist beliefs and texts of their times. In this essay I present the historical basis of misogyny as well as events that led the two women to create their pieces. The modern public trust doctrine compels each Great Lakes state to protect the sustainable future of the Lakes and to preserve traditional public uses. At the same time, the doctrine constrains the states' powers to allow exploitation of trust resources. This Article provides a brief historical overview of the public trust doctrine in waterways and their submerged lands. It next explores how the eight Great Lakes states have applied the doctrine, discusses the surprising number of differences in the doctrine's development from state to state, and provides comparison charts. The Natural Resources Law Center's 25th Anniversary Conference and Natural Resources Law Teachers 14th Biennial Institute provided an opportunity for some of the best natural resources lawyers to discuss future trends in the field. The conference focused on the larger, cross-cutting issues affecting natural resources policy. Initial discussions concerned the declining role of scientific resource management due to the increased inclusion of economic-cost benefit analysis and public participation in the decision-making process. The effectiveness of this approach was questioned particularly in the case of non-market goods such as the polar bear. Other participants promoted the importance of public participation and …

Théorie Et Pratique De L’Écriture Chez Pius Ngandu Nkashama, Kasereka Kavwahirehi
Présence Francophone: Revue internationale de langue et de littérature
Pius Ngandu Nkashama is mostly known as a literary critic and theorist. But he is also an established novelist, poet and playwright. This essay attempts to show that both his critical work and his creative work share a common dynamic. It shows how, for Pius Ngandu, literary and aesthetic practice is not only a way of life, an existential experience from which he draws the energy to overcome despair and human mediocrity, but it is also a way of participating in the African struggle for freedom and for the conquest of a history that has been confiscated by dictators.
