Courts Of Appeal And Colonialism In The British Caribbean: A Case For The Caribbean Court Of Justice, Ezekiel Rediker
Courts Of Appeal And Colonialism In The British Caribbean: A Case For The Caribbean Court Of Justice, Ezekiel Rediker
Michigan Journal of International Law
In recent years, a public debate on law and the colonial legacy has engaged people of all walks of life in the English Speaking Caribbean (ESC), from judges and politicians to young people in the streets. Throughout the ESC, the Judicial Committee of the Privy Council (JCPC)—based in London and composed of British jurists—has been the highest court of appeal since the colonial era. In the past decade, however, Caribbean governments have sought greater control over their legal systems. In 2005, they created the Caribbean Court of Justice (CCJ) to supplant the British Privy Council as the Supreme Court for …
Historical And Modern Conceptualization Of Adhd: A Neurobiological Perspective, Nikolas Santamaria
Historical And Modern Conceptualization Of Adhd: A Neurobiological Perspective, Nikolas Santamaria
Theses & ETDs
This paper seeks not only to analyze the current neurobiological concepts of attention deficit disorder, but to examine the disorder from a historical perspective and to study its development. The historical review begins with Hippocrates and studies its evolution of the disorder throughout the 20th century, including early neurobiological theories such as minimal brain damage/dysfunction and the catecholamine hypothesis. Through studying the history, it seems that some but not all of the behavioral disorders observed could have been fact attention deficit disorder. Due to the complexity and diversity of the symptoms of attention deficit disorder, symptoms closer to the genetic …
Dignité/Dignidade: Organizing Against Threats To Dignity In Societies After Slavery, Rebecca J. Scott
Dignité/Dignidade: Organizing Against Threats To Dignity In Societies After Slavery, Rebecca J. Scott
Book Chapters
This chapter is not an attempt to join the fractious debate over philosophical first principles or juridical first usages of the term 'dignity'. Instead, it explores the tight connection between the institution of slavery and the giving of specific meanings to the concept of dignity, in particular times and particular places. To explore the dynamics of the intertwined process of creating and drawing upon meaning for the terms 'dignity' and 'slavery', I examine two historical movements that emerged after formal abolition.

The Death Of Punishment: Searching For Justice Among The Worst Of The Worst, Robert I. Blecker
The Death Of Punishment: Searching For Justice Among The Worst Of The Worst, Robert I. Blecker
Books
For twelve years Robert Blecker, a criminal law professor at New York Law School, wandered freely inside Lorton Central Prison, armed only with cigarettes and a tape recorder. The Death of Punishment tests legal philosophy against the reality and wisdom of street criminals and their guards. Some killers' poignant circumstances should lead us to mercy; others show clearly why they should die. After thousands of hours over twenty-five years inside maximum security prisons and on death rows in seven states, Professor Blecker exposes the perversity of justice: Inside prison, ironically, it's nobody's job to punish. Thus the worst criminals often …

Klotzen, Nicht Kleckern (Strike Together, Not Divided!): The Panzer Divisions As New Dominating Strategy Of Modern Warfare, Stefano Alianelli
Senior Independent Study Theses
The beginning of the Second World War was dominated by a new type of strategy developed by German General Heinz Guderian that overwhelmed the Allied armies in Poland and France. Guderian argued that the best way to win on the battlefield and avoid the stalemate of World War I should be done through the use of tanks grouped together in formation: the product of this strategy was embodied in the Panzer divisions that, through mobility and coordination of multiple weapons, were able to breach the enemy's defensive lines with devastating effects.
Preaching Unbelief: Freethought In Boston, 1825--1850, James Rogers
Preaching Unbelief: Freethought In Boston, 1825--1850, James Rogers
Master's Theses and Capstones
Freethinkers in the early nineteenth century embarked upon unprecedented organizational efforts in a period characterized by evangelical religious awakenings. In the face of almost pervasive discrimination, unbelievers conspicuously appropriated the recruitment and publicity methods of Christian organizations. Radical developments in print technology resulted in the publication of atheistic books and periodicals, none of which survived longer than the Boston Investigator. Its editor, Abner Kneeland, further disseminated antitheistic thought through oratorical performances and by engaging with contemporary social issues. More than this, unbelievers unashamedly copied specific religious practices: they sang rational hymns celebrating "truth" and science, and individual freethinking intellectuals gave …

Landscape Fairness: Removing Discrimination From The Built Environment, Stephen Clowney
Landscape Fairness: Removing Discrimination From The Built Environment, Stephen Clowney
Utah Law Review
At its core, this Article argues that the everyday landscape is one of the most overlooked instruments of modern race-making. Drawing on evidence from geography and sociology, the paper begins by demonstrating that the built environment inscribes selective and misleading versions of the past in solid, material forms. These narratives — told through street renamings, parks, monuments, and buildings — ultimately marginalize African-American communities and transmit ideas about racial power across generations.
After demonstrating that the landscape remains the agar upon which racial hierarchies replicate themselves, the Article then pivots and examines current efforts to rid the built environment of …

Burn, Boil & Eat : An Intersection Analysis Of Stereotypes In The Most Influential Films Of All Time, Roslyn M. Satchel
LSU Doctoral Dissertations
This research builds upon the work of Entman & Rojecki (2001) in examining the ways the most influential movies use racial stereotypes in media frames. The results of this study contribute to the rather limited mass media research and body of knowledge regarding the media content that attracts the largest and most enduring audiences in the new media landscape. As ten of the films that have generated the most revenue, the movies in this sample constitute a genre of movies that are also a prime feature of on-going publishing, cable, internet, digital gaming, DVD, and movie sequel franchises. If, as …
New Orleans And Fazendeville (De) Segregated : Challenging A Narrative Of School Integration, April Antonellis
New Orleans And Fazendeville (De) Segregated : Challenging A Narrative Of School Integration, April Antonellis
LSU Master's Theses
Too often, “integration” is a word only associated with the 1960s. The dominant narrative of education and integration in the South is simple and linear: African Americans were oppressed, then there was integration, then there was equality. However, in the case of New Orleans, the narrative is not so linear and not nearly so succinct. The conversation on integration began in New Orleans immediately following the Civil War, a century earlier than this conventional starting date, and yet despite generations of successes and drawbacks, the public schools of New Orleans continue to exist segregated today. Examining the narrative of school …

Les Enfants De L’Ombre: Dalila Kerchouche. Leila: Avoir Dix-Ans Dans Un Camp De Harkis, Jimia Boutouba
Modern Languages & Literature
Is Now The Time For Simplified Rules Of Civil Procedure, Paul V. Niemeyer
Is Now The Time For Simplified Rules Of Civil Procedure, Paul V. Niemeyer
University of Michigan Journal of Law Reform
Unfortunately, any objective evaluation of current federal civil process will inevitably lead to the conclusion that the process is functioning inadequately in its purpose of discharging justice speedily and inexpensively. One need only ask any trial lawyer whether he can try a medium-sized commercial dispute to judgment in a federal court in less than three years and at a cost of less than six figures. Is the iconic appellation of "making a federal case out of a dispute" not the ultimate condemnation of current judicial process in federal courts? Can we understand the private bar's flight from federal courts to …

Between Pulpit And Pew: The Supernatural World In Mormon History And Folklore, Curtis Ashton, Michael S. Van Wagenen, W. Paul Reeve
BYU Studies
In an address to a joint meeting of the Utah Historical Society and the Folklore Society of Utah in 1991, folklorist William A. Wilson applauded the two organizations for their cooperation over the previous twenty years and then urged even greater cooperation between history and folklore in Utah over the next twenty years. Between Pulpit and Pew serves as one benchmark for measuring just how seriously a rising generation of historians have taken Wilson's challenge. The editors, Paul Reeve and Michael Van Wagenen, are firmly planted in their chosen discipline, each with an impressive start to developing careers that explore …

Videopoetry: Collaboration As Imaginative Method, Peter Lutze, James Armstrong, Laura Woodworth-Ney
Literacy, Language and Culture Faculty Publications and Presentations
Three Idaho professors (a poet, videographer, and historian) have been collaborating for eight years on a cross-disciplinary project called VideoPoetry, which integrates historical narration, narrative poetry, historical photographs, and videography into the video medium. To this point we've worked primarily on a specific program, Culture of Reclamation, which explores the culture of the early irrigated landscape communities in southern Idaho. In reflecting on our work-process, we’ve discovered that we’ve fundamentally changed as scholars as a result of our collaboration. This paper identifies the nature of our changes and documents instances of the ways in which we have been challenged to …
