Deciding To Kill: Revealing The Gender In The Task Handed To Capital Jurors, Joan W. Howarth Jan 1994

Deciding To Kill: Revealing The Gender In The Task Handed To Capital Jurors, Joan W. Howarth

Scholarly Works

Day after day, across this country, ordinary people are summoned to court for a selection process that ultimately leaves them in a room deciding, with other jurors, whether a criminal defendant should be killed. The task handed to these jurors is an awesome, personal, moral decision, encased within the complex legal standards and procedures that constitute modern capital jurisprudence. The doctrine that created and sustains this moment of conscience reflects an ongoing struggle of rule against uncertainty, reason against emotion, justice against mercy, and thus, at one level, male against female. Capital jurisprudence -- the law for deciding whether to …

Gender, Crime, And The Criminal Law Defenses, Deborah W. Denno Jan 1994

Gender, Crime, And The Criminal Law Defenses, Deborah W. Denno

Faculty Scholarship

This Article attempts to explain some of the disparity in criminality between males and females by analyzing the results of the “Biosocial Study,” one of this country's largest longitudinal studies of biological, psychological, and sociological predictors of crime. Section II analyzes the literature and research on gender differences in crime. Section III describes the Biosocial Study and its results, noting the gender differences in the prevalence and prediction of crime and the inability of any one factor to be a strong predictor of crime. Section IV considers whether gender differences warrant disparate types of punishment or treatment within the criminal …

Recognizing Violence Against Women: Gender And The Hate Crimes Statistics Act, Elizabeth Pendo Jan 1994

Recognizing Violence Against Women: Gender And The Hate Crimes Statistics Act, Elizabeth Pendo

All Faculty Scholarship

This article argues that acts of gender-based violence should be recognized under the Hate Crimes Statistics Act of 1990, and that certain types of violence against women, such as rape, are fundamentally gender-based. Part I examines the existing definition of hate crimes under the HCSA, and the exclusion of the majority of violence against women. Part II suggests gender should be included as a category under the HCSA because of the similar effects of violence directed at women due to gender, and violence directed at members of other groups because of their group identity. Using acquaintance rape as an example, …

A Comment On The Canadian Bar Association's Gender Equality Task Force Report, Dianne Pothier Oct 1993

A Comment On The Canadian Bar Association's Gender Equality Task Force Report, Dianne Pothier

Dalhousie Law Journal

The Canadian Bar Association's Gender Equality Task Force Report sets out to challenge the traditions of a male model of the legal profession. The title of the Report, Touchstones for Change: Equality, Diversity, and Accountability, announces the challenge. Although in a formal sense the legal profession has been open to women since well before the Judicial Committee of the Privy Council acknowledged women's eligibility to be Senators, the sad truth is that, in many respects, the legal profession is still not a welcoming environment to women. While women are entering the profession in greater numbers than ever before, they are …

The Effects Of Gender Of Observers And Victims On Perceptions Of Fairness In Unjust Situations., Laura Leah Josoff Apr 1993

The Effects Of Gender Of Observers And Victims On Perceptions Of Fairness In Unjust Situations., Laura Leah Josoff

Student Work

The effects of gender of observers and victims on perceptions of fairness in unjust situations were investigated. Subjects participated in group sessions and were blocked by gender and then assigned to either the disadvantaged female (read a composition concerning a femal who received poor outcomes) or disadvantaged male (read a composition concerning a male who received poor outcomes) group. After reading the composition, subjects completed a questionnaire which was related to the composition. It was expected that the perception of fairness would depend upon the gender of the perceiver as well as the gender of the victim. Specifically, females would …

Sexuality Research: Untested Gender Assumptions Amid Paradigm Shifts, Donna J Walker Jan 1993

Sexuality Research: Untested Gender Assumptions Amid Paradigm Shifts, Donna J Walker

UNLV Retrospective Theses & Dissertations

Content analysis of 803 sexuality research abstracts selected from Sociological Abstracts published from January 1974 to August 1992 answers three questions: (1) Are there trends in sexuality research? (2) Is there a paradigm shift? and (3) Is gender differentiation present? Research between 1973 and 1991 displayed a consistent division between the positivist "nature" paradigm and the interactionist "nurture" paradigm. The proportion of studies which attempt to be non-gender specific has declined annually while researchers have consistently neglected to study male sexuality. Although there has been little change in basic principles, there have been trends in interpretations of research data. Conclusions …

(1993) Simon: A Story About Being The Same And Being Different, Laurance J. Splitter Jan 1993

(1993) Simon: A Story About Being The Same And Being Different, Laurance J. Splitter

Collected Papers of Laurance J. Splitter

Simon is a high school student who is simultaneously learning about political equality and HIV/AIDS. He is confused about the differences between sex, sexuality, and sexual preference, and whether sexuality is really a preference. In discussions with schoolteachers, classmates, friends, and his mum, Simon also thinks about discrimination, hate, and the risks and benefits of hiding one’s identity and “going along with the guys.”

Gender Neutral, K.K. Duvivier

Sturm College of Law: Faculty Scholarship

Regardless of your preference, you should be aware that the use of "he" as a universal gender pronoun now is controversial, and your reader probably will follow only one of two very divergent ideologies. Therefore, fall back on a primary rule of persuasive writing: avoid any words or structures that alienate your rader or distract from your message.

Subjects completed the Bem Sex-Role Inventory (BSRI) and the Beck Depression Inventory (BDI).

A difference was found in the rate of depression between females and males that exceeds the generally accepted 2:1 ratio. There was a female to male ratio of approximately 4:1 in the group of subjects who indicated a high level of depression on the Beck Depression Inventory.

The Hidden Gender Of Law, Christine Boyle May 1992

The Hidden Gender Of Law, Christine Boyle

Dalhousie Law Journal

Two legal academics who set out to produce a book of materials with such a title could weave many components into it. They could explore feminist methodology, and show how much feminist legal scholarship has in common with feminist scholarship generally. They could illustrate the influence of feminist academic work on actual legal decisions and legislation. They could discuss feminist scholarship and legal education, including the dramatic developments over the last twenty years. Questions about fundamental values - equality, liberty, security, fairness - could be addressed. Materials could be included from the field of law often called Women and the …

Women's Images Effaced: The Literary Portrait In Seventeenth-Century France, Nina Ekstein Mar 1992

Women's Images Effaced: The Literary Portrait In Seventeenth-Century France, Nina Ekstein

Modern Languages and Literatures Faculty Research

The literary portrait was extremely popular in France for a number of years during the mid-seventeenth century. With roots in salon society, the portrait became a genre in its own right during this period and was eventually incorporated in numerous other genres such as novels, memoirs, theater, and sermons. In this study, I will consider the close association between the initial vogue of portraiture and women, and examine the advantages and problems posed by the genre for women authors. I will trace the evolution of the literary portrait during the seventeenth century, in particular, the manner in which women were …

Canadian Tort Law: A Review For The Nineties, B T. Hill Oct 1991

Canadian Tort Law: A Review For The Nineties, B T. Hill

Dalhousie Law Journal

My purpose in writing this review follows from a tradition initiated by feminist scholars. My analysis of Canadian Tort Law. Cases, Notes and Materials begins with a survey of the casebook with commentary concerning its historical development as a casebook, focussing on instances where gender issues are raised. I then offer a critique concerning the lack of consideration and misappropriation of gender issues in the recently released 1990 edition of the casebook, using illustrative examples from the casebook and a selection of two feminists' critique of tort law. Some modest suggestions for improvement are made throughout the review, and the …

Feminist Theory, Professional Ethics, And Gender-Related Distinctions In Attorney Negotiating Styles, Lloyd Burton, Larry Farmer, Elizabeth D. Gee, Lorie Johnson

Journal of Dispute Resolution

Historically, law has been a male-dominated profession; only recently has it become possible to consider the woman's experience and perspective with respect to law practice generally and negotiation practice in particular. This paper addresses two gender-related issues: first, are there identifiable gender-related distinctions in the negotiating behavior of attorneys? Second, if there are discoverable differences, are they attributable to ethical perspectives linked to gender? In addressing these questions, this article begins by reviewing the literature on feminist theory, moral development, and negotiation theory. These themes are tied together in a review of the small but growing literature on negotiation ethics. …

“Make The Ring In Your Mind” (Book Review), Emily A. Hartigan Jan 1991

“Make The Ring In Your Mind” (Book Review), Emily A. Hartigan

Faculty Articles

aking All the Difference, by Martha Minow, promised to render the multiple differences of race, gender, disability, and orientation, part of a whole discourse on difference. In this, the book is a success. Yet, the contradiction which Minow’s ideas play with her genre is bothersome. It is not that her way of writing is not valuable. Minow is remarkably lucid. But what she names at the outset—a relational approach, with a sensitivity to boundaries—she does not deliver. That conundrum, and why it seems to be—but is not—the unavoidable dilemma of the gifted female scholar in law today, is worth investigating.
