Achieving environmental justice—that is, the fair treatment and meaningful involvement of all people regardless of race, color, national origin, or income, with respect to the development, implementation, and enforcement of environmental laws, regulations, and policies—requires providing impacted communities not just the formal right, but the substantive ability, to participate as equal partners at every level of environmental decision-making. While established administrative policy purports to provide all people with so-called meaningful involvement in the regulatory process, the public participation process often excludes marginalized community members from exerting meaningful influence on decision- making. In the millennia before the creation and adoption of electric lighting, night skies drenched in stars were the inalienable inheritance of humanity. Electric lighting threatens this birthright by emitting star-blocking light (also known as light pollution) into night skies. Left unaddressed, light pollution will restrict access to dark, starry skies so that many in future generations will only know the stars secondhand. Throughout 2011 and 2012, members of the Deschutes River community who fish in the Lower Deschutes River in Oregon noticed a slew of significant changes to their natural environment. The Deschutes River Alliance attributed the changes to the operation of the Pelton Round Butte Hydraulic Project, which is co-owned and operated by Portland General Electric and The Confederated Tribes of the Warm Springs. In July 2016, DRA filed a Clean Water Act lawsuit against them. To rule on the alleged CWA violations, the DRA must first get past the tribal sovereign immunity hurdle. The ANSWERS plant and its impact on the residents of Sheridan Hollow has recently been accepted by many as a case of environmental injustice. Simply looking at the benefits and burdens of environmental processes shows clearly that the primarily black community faced most of the health burdens that came from waste in the capital region, while white residential areas who sent their trash to ANSWERS faced minimal risk. Children are most vulnerable to the effects of traffic-related air pollution because of their developing respiratory systems, amount of time spent outdoors, and faster rates of breathing. As one of the largest states in the U.S. in terms of both total population and number of children, Texas is a particularly important place for studying policies and strategies used by school districts to reduce childrenâ??s exposure to vehicular pollution. This thesis investigates the relationship between superfund sites in minority communities and their public health through the lens of social vulnerability. Various demographic parameters were used to assess the risk associated with minority communities and exposure to hazardous waste. After investigating the history of the Environmental Justice movement, three superfund sites of interest in South Carolina, and demographic and public health data; each community was analyzed to determine association between exposure to hazardous waste and minority status. Each examined community exhibited characteristics contributing to heightened social vulnerability, potentially causing increased susceptibility to negative health outcomes from exposure to hazardous waste.

Did The Clean Air Act Improve Environmental Justice Disparities?, Jared Jageler

This paper analyzes the differential impacts of the 1990 Clean Air Act Amendments (CAAA) on the racial pollution exposure gap, also known as the Environmental Justice (EJ) gap. Using recently developed, Census tract-level satellite data of PM2.5 pollution, I test whether CAAA non-attainment status and resulting State Implementation Plans decreased pollution in high-percentage Black and Hispanic areas more than in non-high percentage Black and Hispanic tracts. My results confirm that the CAAA reduced overall pollution concentrations in the U.S. and decreased the absolute level of the Environmental Justice gap. A heterogeneity analysis provides evidence that the results are primarily driven …

As global warming intensifies, ensuring that its impacts do not disproportionately burden disadvantaged populations has become a growing policy concern. Within the United States, mobile home residents increasingly face climate injustices but are often overlooked in climate policy discussions. Even after accounting for income and race, mobile home residents experience substantially higher indoor heat risks than single-family home residents. Mobile home residents also comprise a disproportionately high percentage of indoor heat deaths. The heat vulnerability of these Americans is even greater for those living in the numerous sparsely-shaded mobile home parks occupying cities and towns throughout the country’s Sun Belt …

The purpose of this study is to better understand Kentucky youth climate activism. The research questions explore how youth define their climate activism in Kentucky, their Significant Life Experiences (SLE) that motivated them to commit to climate activism, and what challenges and sustains their involvement. This qualitative study utilizes a blended framework of social/environmental positionality and political ecology to analyze 7 semi-structured interviews with participants between the ages 18 to 24 years old who are acting to address climate change in Kentucky. New contributions to the existing body of SLE literature are discussed.

Urban surface soils are contaminated by trace metals from various anthropogenic sources such as traffic and industrial facilities. Socio-economically disadvantaged communities are generally located closer to these sources and likely exposed more to toxic metals. This study aims to investigate the surface soil contamination by trace metals. Surface soils were collected from parks (n=75) and playgrounds of elementary schools (n=6) located in 33 postal codes split into four groups with different economic status (average annual household income) and industrial emissions (releases reported to the Toxic Release Inventory). This article analyzes the EPA within the broader history of federally-sponsored residential segregation, as well as the criminalization of and disinvestment from urban areas contemporaneous with the agency’s founding. It offers a detailed analysis of EPA’s first decade of recalcitrance regarding its own obligations under Title VI of the 1964 Civil Rights Act and Title VII of the 1968 Fair Housing Act. The EPA developed a pattern of responding to scrutiny by rearranging its internal office structure and launching new initiatives tangential to the substantive issues of civil rights. The D.C. Circuit Court remanded three Brownsville, TX LNG approval orders to FERC for failing to adequately explain conclusions around environmental justice and climate concerns. The Court ordered FERC to reevaluate whether the projects are in the public interest. The LNG terminals and pipeline will disproportionately impact low-income, minority communities, and substantial greenhouse gas emissions from production and export will contribute to anthropogenic climate change. Industrial agriculture is accurately criticized for eliminating biodiversity and destroying food sovereignty. Urban agroecosystems, usually individual plots in community gardens, are promoted to restore ecological services and equity to food systems. Recently, collectively tended urban community farms have developed, with explicit social justice goals. This study directly contrasts the effectiveness of the urban community farm and garden models. Spatial analysis is used to confirm that community farms enhance geographic access for healthy food priority areas compared to gardens in the San Francisco bay area. Environmental justice research has found that poor and minority households are disproportionally exposed to environmental pollution than other groups in the United States. Scholars have used several hypotheses to explain this correlation including pure discrimination among groups by polluters, the location cost considerations of firms, the migratory responses of households to pollution, Coase theorem, and collective action hypotheses. Drinking water systems in the United States confront several challenges such as aging infrastructure, polluted source water, and fragmented systems. The burdens, however, are not equally distributed across the nation. Disadvantaged communities such as communities of color are disproportionately affected by drinking water-related problems.
This study focuses on drinking water quality violations and slow enforcement actions of Safe Drinking Water Act (SDWA) during 2016 to 2018.
