The Future Of Guinn V. Legislature, Troy L. Atkinson Mar 2004

The Future Of Guinn V. Legislature, Troy L. Atkinson

Nevada Law Journal

United States Supreme Court Justice Robert Jackson best articulated the human element, giving life to the Nation's Highest Court, when he stated: "We are not final because we are infallible, but we are infallible only because we are final." With the Legislature eventually approving a balanced budget by a supermajority vote, the Nevada Supreme Court's ruling in Guinn v. Legislature, will stand, at least for now, because it is "final." However, the Guinn ruling is far from "infallible." The circumstances leading to the Court's decision, as well as the court's logic, have created a dangerous precedent that could extend far …

Abstinence-Only Adolescent Education: Ineffective, Unpopular And Unconstitutional, James J. Mcgrath Feb 2004

Abstinence-Only Adolescent Education: Ineffective, Unpopular And Unconstitutional, James J. Mcgrath

ExpressO

This article examines the recent changes in the funding of “abstinence only” educational programs that attempt to reduce the incidence of teen pregnancy and sexually transmitted diseases. Although funding for these programs was previously ruled to be facially constitutional, this is no longer the case as their lack of efficacy for their stated purpose has been exposed. Newer programs are in direct violation of unconstitutional conditions doctrine, and none of these programs address a significant segment of the student population, lesbian and gay students. My article addresses this oversight as dangerous public health policy as well as a potential constitutional …

Epistemology And Education: An Incomplete Guide To The Social-Epistemological Issues, Harvey Siegel Jan 2004

Epistemology And Education: An Incomplete Guide To The Social-Epistemological Issues, Harvey Siegel

Philosophy Articles and Papers

Recent work in epistemology has focused increasingly on the social dimensions of knowledge and inquiry. Education is one important social arena in which knowledge plays a leading role, and in which knowledge-claims are presented, analyzed, evaluated, and transmitted. Philosophers of education have long attended to the epistemological issues raised by the theory and practice of education (along with the moral, metaphysical, social-political, and mind/language issues so raised). While historically philosophical issues concerning education were treated alongside other philosophical issues, in recent times the former set of issues have been largely neglected by philosophers working in the core areas of the …

Individual interviews were conducted with 35 preservice teachers to determine their attitudes and beliefs concerning inclusion of students with severe disabilities and to examine the factors that influenced these attitudes and beliefs. Following qualitative data analysis procedures, findings indicated that the preservice teachers were relatively evenly divided on their opinions about where students with severe disabilities should receive educational services. The most significant finding of this study was that the preservice teachers attributed the underlying basis of …

Attention Deficit Disorder: Are Schools And Physicians Working Together?, Paul Koulouris

Electronic Journal for Inclusive Education

Over the past twenty years, the existence of Attention Deficit Disorder has been documented through hundreds of scientific studies. Schools play a vital role in the early in the early identification of children which ADHD and, in many cases; school personnel coordinate efforts among teachers, parents, physicians, and community resources in the assessment and treatment of children and adolescents with ADHD (Sloan, Jensen & Hoagwood, 1999). Shifting Worlds: Leading Educational *Change In A Quantum Universe, Mary O Douglas Singer Jan 2004

Shifting Worlds: Leading Educational *Change In A Quantum Universe, Mary O Douglas Singer

Doctoral Dissertations

The twentieth century theories of quantum physics and chaos theory in mathematics have had an impact across disciplines, but in many ways educational leaders have been trapped in the old Newtonian paradigm. The conceptual portion of this study bridges the paradigms to suggest new ways to view school leadership for the twenty-first century, using New Science constructs, systems thinking, and leadership concepts of business writers Senge (1990) and Wheatley (1992). It argues that such business models are appropriate for school organizations, and builds a conceptual model of a quantum principal who may participate in creating change through transformation (Burns, 1978) …

Interracial Dating Among College Students: Cultural Norms And Partner Violence, Carolyn Field Jan 2004

Interracial Dating Among College Students: Cultural Norms And Partner Violence, Carolyn Field

Doctoral Dissertations

This study examines three important issues for race relations in the United States today using a sample of college students: interracial dating patterns, attitudes towards interracial dating, and dating violence among same-race versus interracial couples. According to the U.S. Census Bureau, African American/White couples make up less than 1 percent of all married couples in the U.S. Rates of intermarriage for Hispanics and Asians in the U.S. are much higher. Using a sample of college students (N = 1174) from two Historically Black Universities and three Predominantly White Universities, results indicate that attitudes towards interracial relationships differ by race, but …

Writing American Subjects: Race, Composition, And The Daily Themes Assignment For English 12 At Harvard, 1886--1887, Amy A. Zenger Jan 2004

Writing American Subjects: Race, Composition, And The Daily Themes Assignment For English 12 At Harvard, 1886--1887, Amy A. Zenger

Doctoral Dissertations

This study works to develop a way of reading the functions of race in classroom contexts---specifically in the predominantly white contexts in which composition was formed as a university subject. The model of race chosen for this study is based on critical race theories that conceive of race as being socially constructed, but also a force that organizes identity and experience in powerful ways, even when (or perhaps especially when) its presence is apparently silent---or is, in the terminology of Charles Mills, "normalized."

Primary data for the study is drawn from materials related to the daily theme assignment designed by …

Three research questions investigated changes in tutors' cognitive-structural development, the complexity of their thinking about tutoring, and tutoring practice. The fourth question investigated the mechanisms of change. This study addresses the lack of research about undergraduate college tutors and the ways in which they change as a result of taking on the tutoring role.

The participants were nine undergraduate peer tutors at an urban commuter college …

The Interplay Between Instructional Policy And Its Constituents: How Mathematics Teachers Interact With And Understand "Principles And Standards For School Mathematics", Dawn M. Berk Jan 2004

The Interplay Between Instructional Policy And Its Constituents: How Mathematics Teachers Interact With And Understand "Principles And Standards For School Mathematics", Dawn M. Berk

Doctoral Dissertations

Educational policies aimed at reforming school mathematics education have been disseminated at an increasing rate in recent years. The impact of such policies hinges on if and how constituents decide to implement the policy recommendations, and these decisions depend largely on constituents' interpretations of the policy. Investigating how classroom teachers make sense of policy recommendations is particularly important, for teachers are the ones who ultimately decide what mathematics students learn, and how they learn it. This research followed a group of teachers as they studied a particular instructional policy, Principles and Standards for School Mathematics (NCTM, 2000). Fourteen middle school …

Congregationalist Richard Cordley And The Impact Of New England Cultural Imperialism In Kansas, 1857-1904, Nathan Wilson

Great Plains Quarterly (through 2013)

What constitutes an authentic western hero? The archetypal image of the Jeffersonian ideal, the yeoman pioneer farmer who brought all the benefits of the American republic to the West, was the quintessential western hero until the Civil War era. Following this destructive period in American history, the armed gunfighter or cowboy replaced the yeoman farmer as the popular image of what it meant to be a western hero. But what about the clergy? As a major social force throughout the nineteenth century, religion proved an important factor in the settlement of the American West. Yet the idea of a religious …
