¡Silencio! Undocumented Immigrant Witnesses And The Right To Silence, Violeta R. Chapin Jan 2011

¡Silencio! Undocumented Immigrant Witnesses And The Right To Silence, Violeta R. Chapin

Publications

At a time referred to as "an unprecedented era of immigration enforcement," undocumented immigrants who have the misfortune to witness a crime in this country face a terrible decision. Calling the police to report that crime will likely lead to questions that reveal a witness's immigration status, resulting in detention and deportation for the undocumented immigrant witness. Programs like Secure Communities and 287(g) partnerships evidence an increase in local immigration enforcement, and this Article argues that undocumented witnesses' only logical response to these programs is silence. Silence, in the form of a complete refusal to call the police to report …

Public Attitudes Toward Crime And Incarceration In Finland, Ikponwosa O. Ekunwe, Richard S. Jones, Kaley Mullin Apr 2010

Public Attitudes Toward Crime And Incarceration In Finland, Ikponwosa O. Ekunwe, Richard S. Jones, Kaley Mullin

Social and Cultural Sciences Faculty Research and Publications

The following paper provides insights into Finland’s criminal justice system and discusses the policies that emphasize using prison for rehabilitation, not merely for punishment. These methods of prevention and rehabilitation, in conjunction with correctional and educational staff within and outside the prison walls, have contributed to consistently low recidivism rates in Finland. This study discusses many ideological similarities between public opinions towards criminals and crime in Finland and the United States. Like Americans, Finns are intolerant of crime and violence, yet open to the idea of alternative forms of punishment, especially for non-violent and juvenile offenders. People in both countries …

A Tale Of Three Cities: Crime And Displacement After Hurricane Katrina, Sean P. Varano, Joseph A. Schafer, Jeffrey M. Cancino, Scott H. Decker, Jack R. Greene

Justice Studies Faculty Publications

When Hurricane Katrina struck New Orleans in August 2005, it greatly disrupted both the physical and social structures of that community. One consequence of the hurricane was the displacement of large numbers of New Orleans residents to other cities, including Houston, San Antonio, and Phoenix. There has been media speculation that such a grand-scale population displacement led to increased crime in communities that were recipient of large numbers of displaced New Orleans residents. This study was a case study of three cities with somewhat different experiences with Katrina's diaspora. Time series analysis was used to examine the pre- and post-Katrina …

Sorry Seems To Be The Hardest Word: The Fair Sentencing Act Of 2010, Crack, And Methamphetamine, Kyle Graham

Faculty Publications

This Essay considers the circumstances that led to the enactment of the Fair Sentencing Act of 2010, which increased the quantities of crack cocaine necessary to implicate mandatory minimum prison sentences for federal drug trafficking crimes, and considers whether the Act might facilitate re-evaluation of the penalty scheme applicable to methamphetamine.

The Order-Maintenance Agenda As Land Use Policy, Nicole Stelle Garnett Jan 2010

The Order-Maintenance Agenda As Land Use Policy, Nicole Stelle Garnett

Journal Articles

Debates about the broken windows hypothesis focus almost exclusively on whether the order-maintenance agenda represents wise criminal law policy — specifically on whether, when, and at what cost, order-maintenance policing techniques reduce serious crime. These questions are important, but incomplete. This Essay, which was solicited for a symposium on urban-development policy, considers potential benefits of order-maintenance policies other than crime-reduction, especially reducing the fear of crime. The Broken Windows essay itself urged that attention to disorder was important not just because disorder was a precursor to more serious crime, but also because disorder undermined residents’ sense of security. The later …

Street Stops And Broken Windows Revisited: The Demography And Logic Of Proactive Policing In A Safe And Changing City, Jeffrey A. Fagan, Amanda Geller, Garth Davies, Valerie West Jan 2010

Street Stops And Broken Windows Revisited: The Demography And Logic Of Proactive Policing In A Safe And Changing City, Jeffrey A. Fagan, Amanda Geller, Garth Davies, Valerie West

Faculty Scholarship

This chapter examines the development of “order maintenance policing” in New York City. It studies the stop-and-frisk activities of New York City police officers by examining temporal and spatial patterns of stops from 1999, 2003, and 2006. Findings reveal that stop rates have increased by 500 percent since 1999 despite little change in crime rates Stop activity was greatest in poor and minority communities, and stop patterns were more closely tied to demographic and social conditions than to disorder or crime. The efficiency of stops, measured as “hit rates,” dropped considerably, with the sharpest declines occurring in minority neighborhoods. Overall, …

This paper relates individuals’ characteristics to the probability of possessing firearms: a) inside the home; b) outside the home; and c) inside and outside the home. Extending the literature on the demand for firearms whose focus is on the first trait, we collected survey data on 2,045 random individuals of Brasília, Brazil, in 2002. The multinominal logit model yields several new results. First, while we do find that a person’s educational level negatively affects the likelihood that an individual will use arms only outside his or her home, education does not affect the probability of an individual possessing a gun …

Participatory Evaluation Of The Tribal Victim Assistance Programs At The Lummi Nation And Passamaquoddy Tribe, Ada Pecos Melton, Michelle Chino

School of Public Health Faculty Research

The high rate of crime in American Indian/Alaska Native (AI/AN) communities and/or against AI/AN people reflected in numerous studies in the last three decades, demonstrates the need for victim assistance programs in Indian Country to help victims cope with and heal from violent crime (Wolk 1982; Allen 1985; Sacred Shawl Women’s Society, no date; McIntire 1988; DeBruyn, Lujan & May 1995; Norton & Manson 1995; Fairchild et. al 1998; Greenfield & Smith 1999; Alba, Zieseniss, et al 2003; Perry 2004). Confronting The Evolving Safety And Security Challenge At Colleges And Universities, Oren R. Griffin Jun 2009

Confronting The Evolving Safety And Security Challenge At Colleges And Universities, Oren R. Griffin

The University of New Hampshire Law Review

[Excerpt] “Colleges and universities have long been scrutinized and confronted with lawsuits regarding safety and security measures designed and implemented to protect students and prevent dangerous incidents on campus. Under the doctrine of in loco parentis, college administrators assume responsibility for the physical safety and well-being of students as they matriculate through their academic programs. However, in recent decades, the realization that university communities are not immune to criminal activity has led to federal legislation and judicial opinions that have attempted to identify what legal duty colleges and universities have to prevent security breaches. Moreover, college and university administrators have …

This study examined 989 cases with a sexual assault or sexual abuse of a minor charge reported to Alaska State Troopers in 2003 and 2004, and excluded any sexual assault cases reported to local or municipal departments. * Forty-eight percent of reports came from C Detachment (Western Alaska - Kodiak to Kotzebue), and 58% were reported from communities off the road system. * In 69% of cases, the identity of at least one suspect was known. While most suspects (87%) were adults, most victims (73%) were juveniles. Sixty-one percent of victims were Alaska Native and 38% were White. Intra-racial victimizations …

The Cost Of Crime: Could The State Reduce Future Crime And Save Money By Expanding Education And Treatment Programs ?, Stephanie Martin, Steve Colt Jan 2009

The Cost Of Crime: Could The State Reduce Future Crime And Save Money By Expanding Education And Treatment Programs ?, Stephanie Martin, Steve Colt

ISER Reports

Alaska’s prison population is among the fastest-growing in the U.S., with five times more inmates in 2007 than in 1981. Spending for the state justice system has nearly doubled since 1981—but the crime rate has dropped only about 30%. Here’s the dilemma for the state, given the pattern shown in Figure 1: what can it do to hold down the number of inmates and stem the rising costs—while at the same time keeping the public safe and using tax dollars effectively? Senator Hollis French asked ISER to project growth in the number of Alaska inmates and the associated costs—and then …

A Miscarriage Of Juvenile Justice: A Modern Day Parable Of The Unintended Results Of Bad Lawmaking, Amy Vorenberg Jan 2009

A Miscarriage Of Juvenile Justice: A Modern Day Parable Of The Unintended Results Of Bad Lawmaking, Amy Vorenberg

Law Faculty Scholarship

Sensationalized cases increasingly create the context for public policy discussion. Stories about violent crime are a common feature of the local evening news and their emotional nature can often create the hook politicians need to showcase their “tough on crime” agendas. Often anecdotal and lurid, stories of criminal misdeeds are widely used to convince the public of a need to create or change laws. This article demonstrates the perils of making law by extrapolating from a few random, albeit attention-grabbing, events. Specifically, the article examines the impact of a 1995 change in New Hampshire state law that lowered the age …

Revisiting Alaska's Sex Offender Registration And Public Notification Statute, Deborah Periman Oct 2008

Revisiting Alaska's Sex Offender Registration And Public Notification Statute, Deborah Periman

UAAJC Occasional Papers

This paper provides a look at the parameters of the Alaska’s sex offender registration statute. At the time of its enactment in 1994, the Alaska Sex Offender Registration Act was one of the most stringent in the U.S., far exceeding the miniumum requirements imposed on the states by the federal Jacob Wetterling Act. The federal Adam Walsh Child Protection Act, signed into law in 2006, has the net effect of bringing all the states closer to Alaska’s registration and publication requirements. However, Alaska’s statute and its federal counterpart were based on assumptions about sex offender recidivism and the effectiveness of …

The Sounds Of Silence: American Criminal Justice Policy In Election Year 2008, Frank O. Bowman Iii Jul 2008

The Sounds Of Silence: American Criminal Justice Policy In Election Year 2008, Frank O. Bowman Iii

Faculty Publications

One of the striking features of the 2008 election cycle has been the absence of crime as a national political issue. Nobody has declared metaphorical war on any type of crime, run an ad about the depredations of a parolee, or even promised 100,000 cops. It may simply be that for a country embroiled in two nonmetaphorical foreign wars and deeply nervous about the state of the economy, crime is a second-order concern. It could be that the big drop in crime of all types throughout the 1990s has made the issue seem less pressing. Whatever the explanation, things are …
