Judicial Oversight Over The Interstate Placement Of Foster Children: The Missing Element In Current Efforts To Reform The Interstate Compact On The Placement Of Children, Vivek Sankaran

This article argues that current efforts to reform the Compact are flawed because they lack an essential element: judicial oversight of agency decision-making. The first section explores the important role that juvenile court judges play in making placement decisions for foster children. Next, an examination of the current problems in the interstate placement process demonstrates the vital need for judicial oversight of the system. Finally, a specific proposal is put forth on how best to incorporate judicial oversight without interfering with the sovereignty of states.

Development Of The Video Suggestibility Scale For Children: Spanish-Language Version, Claudia Ornelas

This study examined the psychometric properties of a Spanish version of the Video Suggestibility Scale (VSSC). A cross-cultural validation with a sample of 3-5 year old Spanish speaking children was performed to evaluate its psychometric properties (N = 79). The development of the VSSC Spanish language version (VSSC-S) is described. The new version was created using the translation-back-translation process to increase the instrument‟s equivalence. Internal consistencies were satisfactory. Construct validity was assessed by using factor analysis and the Varimax procedure. As expected, the VSSC-S items loaded on two separate factors. This paper traces the history of attempts to restrict contraception, the legal events securing widespread access to contraception and their importance to a generation of college-aged women, the short-lived nature of the consensus that produced them, and the potential of the issue to serve as a rallying point for a revitalized feminism. It explores the hypocrisy of a system that, whatever its values, makes reproductive autonomy readily available for the affluent and the sophisticated and increasingly beyond the reach of the most vulnerable. Due to continued fragmentation and gaps in mental health services and the increase in the prevalence of mental health problems for children, youth, and their families, these populations remain underserved. In 2003, the federal New Freedom Commission (Commission) responded by publishing policies to address these concerns. As directed in 2005, the Substance Abuse and Mental Health Services Administration (SAMHSA) funded planning incentive grants to states to transform their delivery of care.

The study reviewed the federal policy, specifically the recommendations of the Commission’s Subcommittee on Children and Families, and Washington State’s policy and implementation actions of its five-year SAMHSA incentive …

Youth have been a focus of recreation and leisure programmers for over a century. During that time, assumptions have been made about the value of recreation for young people. More recently, a resurgence of interest has occurred related to positive youth development. The purpose of this paper is to describe the results of an integrative review done to examine research conducted with youth as a focal point in four prominent U.S. based recreation journals over the past 21 years (1985-2005). This Essay considers the emerging research in the area of dual-jurisdiction children, often referred to as "crossover kids "-those currently or previously involved in maltreatment proceedings who have also committed delinquent acts. Part I describes the development of the juvenile courts in the early twentieth century. Part II of this Essay questions the need to "track" children along one legal path or another and points to the pitfalls of providing services to some children through a criminal justice paradigm instead of treating all children through a social work paradigm. Because child welfare cases in the world of professional practice require interdisciplinary collaboration, it would seem to follow that graduate students, who will become child welfare professionals, should be trained together, both in the classroom and in clinical settings. However, the implementation of interdisciplinary training is far from straightforward. In this Article, we focus on law and social work students. First, we describe the roles of lawyers and social worker in child welfare work. The Interstate Compact on the Placement of Children deals with the interstate placement of abused, neglected and abandoned children. This article addresses the critical need for reform of the Interstate Compact and attempts to tackle its most serious flaw-the lack of a provisional placement for children awaiting approval of out-of-state kinship placements. This essay focuses on the human rights of immigrant children, regardless of the legality of their presence within U.S. borders, especially with respect to health, education, and welfare. In that context, the work explores, as the title suggests, the international, local, and social/cultural normative standards that structure the responsibilities—independently and collectively, that proverbial village—with respect to children's well-being. We develop these ideas in three parts. First, we address the foundations of the human rights idea and specifically enumerate the particular normative notions, including international treaties that govern children's lives. Our chapter addresses how the family promotes or hinders transcendence of the self in children, that is, how the family is a context in which spiritual development occurs. Due to space limitations, our emphasis is on socialization and interaction processes within the family and not on other issues such as psychodynamic processes (e.g., Rizzuto, 1979) or faith development (e.g., Fowler, 1981). There are many motivations to explore family socialization of religious and spiritual development. After decades of legislative reform, stories of foster care abuse still appear on the fron pages of our newspapers, and foster children who are injured while in protective care are turning to the courts to change the system. It is still relatively difficult for a child to prevail in an action against child protective workers and agencies. Opinions addressing children’s issues are few, and courts seem hesitant to expand causes of action. Delinquency Jurisdiction In A Unified Family Court: Balancing Intervention, Prevention, And Adjudication, Gloria Danziger

This article will examine the demographics of the current juvenile delinquency caseloads and will argue that, despite trends toward greater punitive measures-including placement of juveniles in adult courts for certain offenses, the concept of a therapeutic "family-centered court," which inspired Jane Addams and her colleagues, remains the most promising approach to delinquency, articulated most notably by the proponents of the unified family court concept. The article will consider and address objections and concerns raised with respect to this approach, looking at ways in which several states have incorporated juvenile delinquency into a family-centered unified family court.

This applied dissertation was designed to support the development of a comprehensive system of care for grandparents and other relatives raising children, noncustodial parents, and children in out of home placement. The family constellation was changing in the community were the applied dissertation was implemented. Many children were in out of home placement with relative caregivers; there were few resources and no formal system of care designed to respond to the needs of these at risk families. This left many grandparents and other relative caregivers, children, and noncustodial parents without support or access to services.

Kinship Care, Public Policy, And The Best Interests Of Children, Lisa H. Olewine

This article characterizes kinship care arrangements, surveys the problems with which kinship caregivers contend, and considers the advantages and disadvantages of kinship care. In addition, it examines federal statutes that have implications for kinship relationships, analyzes them in light of the best interests of children, and weighs the relative rights of states, parents, children, and kinship caregivers. Various state measures to implement these policies and to develop kinship care programs are canvassed throughout the article. It concludes with an exploration of legislative and legal alternatives available to assist kinship families, followed by the author's recommendations.

The need for comprehensive reform of child welfare policies and systems has long been evident. This Article reports observations from the WK Kellogg Foundation-sponsored Families for Kids Initiative that seeks to expand services and support to families and reduce the time children spend in temporary care. The authors first provide an overview of the need for reforms such as those proposed by this initiative, suggesting that many child welfare studies, critiques, and proposed reforms have had similar objectives. The Proposed Model Surrogate Parenthood Act: A Legislative Response To The Challenges Of Reproductive Technology, Murray L. Manus

In this Article, Manus proposes a Model Surrogate Parenthood Act. He examines the medical and scientific history of surrogacy and reviews the jurisprudence in the area, specifically the constitutional relationship between procreation rights and surrogacy. The author asserts that surrogate motherhood cannot be, and indeed, should not be, eradicated through legislation criminalizing it. The proposed Model Act, presented here in its entirety, attempts to reduce the problems inherent in the concept of surrogate parenthood by putting the process under strict court supervision and by zealously protecting the rights of the surrogate mother and the child to be conceived.
