This Article examines the regulatory decisions and policy debates surrounding Diablo Canyon in the wake of recent legislation aimed at extending the plant’s operational timeline. Presenting a balanced analysis of the arguments both for and against the closure, this Article explores how the new bill reshapes the conversation around the plant’s future. While proponents of the shutdown emphasize safety concerns and the goal of an all-renewable grid, this Article argues that closing Diablo Canyon would hinder California’s decarbonization efforts and jeopardize energy reliability amid increasing power shortages and extreme weather events. Undocumented individuals face significant barriers to accessing mental health and substance use treatment, contributing to increased recidivism rates in Monterey County, California. The purpose of this capstone project was to identify the specific barriers undocumented immigrants encounter when seeking these services and to inform strategies that improve access and reduce recidivism. Recent legislation, exemplified in statutes from California and Washington, creates new methods for resentencing defendants in old cases. These laws place controlling authority for resentencing in the hands of local officials, especially local prosecutors, and invite variation at the county level.

While some new procedural channels for reducing the sentences of people convicted of past crimes are mandatory, in that they entitle certain defendants to resentencing if they were convicted of certain crimes or were subject to certain penalty enhancements that are no longer valid, other statutes create discretionary resentencing channels. This Article analyzes: (1) the contours of a natural gas installation ban, how municipalities have incorporated these bans, and how the state government may pass a statewide ban; (2) the likelihood that these bans would place a substantial burden on interstate commerce; (3) who, if anyone, would have standing to sue to end these bans; and (4) whether anyone could prevail in an action against a ban on new gas development.

In the United States today, the incarceration experience has become entirely barbaric and inhumane. Basic needs are neglected, drug smuggling runs rampant, and the mental health crisis within the system is worse than ever before. In California (CA), the wildland-urban interface (WUI) faces escalating challenges due to surging population and real estate development. This study evaluates communities along CA's WUI that have witnessed substantial population growth from 2010 to 2021, utilizing demographic data and the 2020 WUI boundaries by the University of Wisconsin-Madison SILVIS Lab. Employing the Mann-Kendall test, we analyze yearly population trends for each census tract along the CA WUI and assess their significance. House ownership, affordability, and wildfire risk are examined as potential drivers of this demographic shift. Planned and unplanned power outages have been increasing in frequency and duration, negatively impacting all public sectors, and threatening public safety. These outages are deadly to those who rely on medical devices. As climate change-fueled extreme weather events (wildfires, earthquakes, storms, etc.) also increase in frequency, our electrical grid must be prepared to bounce back. Microgrids provide necessary redundancy and reliability. This Note discusses the legal implications of California’s Advanced Clean Cars II vehicle-emissions standards. These standards, which would affect vehicle model years 2026 through 2035, seek to eliminate the sale of new gasoline-powered vehicles in favor of only selling electric, zero-emission vehicles. In light of the Supreme Court’s recent decision in West Virginia v. EPA, this type of “generation-shifting” plan stands on broken ground due to the applicability of the Major Questions Doctrine. The agency action here—EPA approval of a Clean Air Act §7543 waiver—is exactly the type of “extraordinary case” that the Court must strike down in order …

Experiences of fires are mediated by energy infrastructures and refracted through social inequality and difference. In California, a state marked by increasingly intense and frequent wildfires, the grid is a source of fire risk, with historically marginalized groups bearing the brunt of exposures to wildfire smoke. Drawing on research conducted by one of the co-authors in collaboration with California’s Karuk Tribe and Blue Lake Rancheria Tribes, this empirically grounded review article expands our understanding of grids. James W. Loewen’s book Sundown Towns: A Hidden Dimension of American Racism, released in 2005, calls out cities across the United States for their historically discriminatory practices of excluding Black and other non-white individuals from living within city borders, either through formal exclusionary policies or informal methods. Cities often enforced this exclusionary practice through violence and intimidation, leading to “all-white” communities throughout the United States. The belief was that these communities should be “sundown” or “sunset” towns, where people of color were not allowed after dark. The Deferred Action for Childhood Arrivals (DACA) program, implemented in 2012, has been a subject of intense debate. While much research has examined the early effects of DACA, this study contributes to the literature by analyzing more recent data on the labor and educational outcomes of DACA recipients in California. Using a difference-in-differences approach, I aim to uncover significant changes in the labor market and educational outcomes of DACA recipients over time. I find those eligible for DACA experienced noteworthy effects compared to those who were ineligible. Specifically, they exhibit a significant 3.1 percentage point increase in the likelihood of …

This Comment begins by examining and comparing the legal framework for deportation and other immigration consequences for convictions of drug offenses in the United States, the European Union, and the United Kingdom. This Comment then looks at the harsh effects of current immigration policy on individuals and marginalized communities. Finally, this Comment argues that immigration law should be reformed to adopt a more humanitarian approach toward non-citizens convicted of drug offenses. In 2019, the Governor of California vowed to fundamentally transform the state’s youth justice system. The legislature endorsed this commitment by enacting SB 823, which began a phased closure of state-run youth prisons in 2021. California is not the first state—nor will it be the last—to close facilities in light of decreased youth crime and greater awareness of the harms associated with incarceration. Although a welcomed development, the closure of youth prisons should not be viewed as the culmination of reform; rather, it is only the beginning. Often forgotten in light of later pieces of anti-Chinese legislation, the Page Act of 1875 and the anti-Chinese prostitution movement were critical in creating a legal precedent for racially exclusionary immigration laws. Religious leaders in California aggressively campaigned against Chinese prostitution by creating rehabilitation centers for former Chinese prostitutes, investigating Chinese women arriving at the port, and focusing media attention on the issue. Concentrated specifically on Chinese prostitution, religious leaders created an implicit association between Chinese women and prostitution while ignoring the larger white prostitution trade. The mounting demand for inmate firefighters in response to increased disaster relief has made such individuals an indispensable resource to the State of California. As a result, state agencies in charge of administering inmate firefighters’ services must give renewed attention to expanding efforts to protect the inmates’ livelihood both before and after a participating inmate’s release. This Comment provides an overview of California inmates undertaking prison labor as volunteer firefighters under the Conservation Camp Program. Prisoners sentenced to a life term in California’s state prisons are being found suitable for parole at record-high rates. Although macro-level policy guides California’s prisoner rehabilitation process, a specific policy does not exist to guide the rehabilitation of the lifer population. Research shows a compelling relationship between public safety resulting from reduced recidivism and an inmate’s participation in rehabilitative programming during incarceration. There is a gap in the literature about ex-lifers and their ability to achieve sustainable social reintegration upon release from incarceration. The Facebook Disaster Maps (FBDM) work presented here is the first time this platform has been used to provide analysis-ready population change products derived from crowdsourced data targeting disaster relief practices. We evaluate the representativeness of FBDM data using the Mann-Kendall test and emerging hot and cold spots in an anomaly analysis to reveal the trend, magnitude, and agglommeration of population displacement during the Mendocino Complex and Woolsey fires in California, USA. Our results show that the distribution of FBDM pre-crisis users fits well with the total population from different sources. Due to usage habits, the elder population is underrepresented …
