A Principled Approach To Equitable Compensation Undea Principled Approach To Equitable Compensation Under Erisa § 502(A)(3)R Erisa § 502(A)(3), Gabriel Juedemann

In many cases, a beneficiary of an employee benefit plan suffers an injury due to a fiduciary’s misfeasance, but the beneficiary does not have a claim under ERISA’s benefit-recovery provision. In these circumstances, the beneficiary’s only path to relief is § 502(a)(3)’s authorization of “appropriate equitable relief.” But whether that provision permits monetary compensation when a beneficiary sues a fiduciary is a question the Supreme Court has not cleanly resolved, and circuit courts have fractured as a result.

When an administrative agency declines to defend the constitutionality of its structure, courts must grapple with the unusual scenario in which the parties before it agree—or at least do not disagree—on the merits of the constitutional question at issue. We Cut To The Chase! Building Consensus For School Librarian Collaboration: A Delphi Study, Pam Harland, Susan D. Ballard, Rachel V. Small

Learning Hub

This study examines collaboration between school librarians and educators using a three-round Delphi study with 38 experts in school librarianship. The researchers developed a consensus definition and a seven-level model of collaboration, ranging from autonomy to schoolwide assurance. The study also identifies environmental, cultural, and dispositional conditions that support successful collaboration, including administrative support, shared planning time, trust, communication, and librarian leadership. The resulting model and rubrics are intended to help educators and school librarians assess and strengthen collaborative practice to support student learning.

Michigan Business & Entrepreneurial Law Review

Rule 14a-8 under the Securities Exchange Act of 1934 allows stockholders to submit proposals for inclusion in a company’s proxy materials. The rule assumes that Delaware law provides stockholders with the right to submit non-binding proposals for stockholder approval. But as many have observed, this assumption lacks a firm basis in state law, particularly in Delaware. If such a right exists, a stockholder conducting its own proxy solicitation could submit numerous precatory proposals, including those advancing narrow or special interests. The European Union’s (“EU”) Corporate Sustainability Due Diligence Directive (“CSDDD” or the “Directive”) introduces new human rights and environmental obligations that reshape global corporate governance. This paper explores its impact on US companies, with a particular focus on compliance strategies under both direct and indirect applicability. It contrasts tactical compliance, which emphasizes risk mitigation while meeting minimum legal requirements, against strategic compliance, where companies use sustainability to gain a competitive edge in the market.

The venerable Secretary Problem asks how a decision maker (DM) should select one of n candidates, who come up randomly, when the only information available is each candidate’s strict rank within the set of previous applicants. Moreover, DM may select only the current candidate. Our illustrative case has n = 9 candidates, for which the Standard Method is to reject outright the first 3 candidates and then choose the first of the 4th through 8th candidates who is better than all of the first three, or the 9th candidate if none of them is. Although Large Language Models (LLMs) produce fluent prose, they routinely tend to generate narratively sterile content for interactive media—backstories in which every conflict has been resolved before play begins, giving rise to what we call the Closure Paradox. Moreover, current evaluation metrics—from n-gram overlap to retrieval-augmented faithfulness scores—inadvertently reward this exact type of closure in cases in which it is undesired, leaving game designers without tools to measure whether a generated character is actually useful as a foundation for play. Aconitum plants have been used as a traditional medicine in Asian countries for millennia to treat pain, rheumatism, syncope, fever, and other conditions. These therapeutic effects are mainly due to the bioactive diterpenoid alkaloids accumulated in the roots. Life Cycle Inventory (LCI) compilation is indispensable in any Life Cycle Assessment (LCA) study, yet the preparation of inventory data for import into LCA software remains one of the most time‑consuming and error‑prone steps in the LCA workflow. LCI datasets frequently originate from multiple data sources and formats, necessitating automation tools that can optimize inventory data for direct use in LCA modeling platforms. The study assesses the relationship between TPB antecedents and GIS business outcomes in SMEs, using an expanded TPB framework. Researchers gathered data from SMEs via a survey and analysed it using PLS-SEM. The framework used in the study explains 58.5% of the differences in GIS business outcomes. The results reveal that subjective norms, attitude, benefits, and obstacles are significant predictors of GIS business outcomes such as ecological IT practices, although perceived behavioural control displays an insignificant negative relationship. Flow, an optimal experience characterized by deep immersion and engagement in an activity, has been extensively studied in behavioral research. However, its neural dynamic mechanism remains poorly understood. In a within-subject video gaming experiment, we captured neural activity underlying flow, boredom, and anxiety using a 64-channel electroencephalogram (EEG) system. Compared to boredom and anxiety, flow exhibits the highest global functional connectivity, metastability, and dimensionality of dynamic functional connectivity patterns, suggesting that flow is a highly adaptable process that is supported by high-dimensional neural dynamics. A revolutionary transformation is underway in agricultural systems, with Natural Farming (NF) being promoted as an agrochemical-free, agroecological alternative to conventional Chemical Farming (CF) in several states of India. To assess the successful adoption of NF among smallholder farming systems in the Himalayan region, this study was conducted in Himachal Pradesh, India. Primary data were collected from 360 randomly selected farmers across six districts using a simple random sampling technique. Background and objective Snoring occurs due to intermittent narrowing of the airway during sleep and may indicate more severe pathology, including obstructive sleep apnea (OSA). Evidence of an independent relationship between snoring and depression is mixed. This study sought to estimate the association between self-reported snoring frequency and depression in a sample of US adults. BACKGROUND: The Lancet Oncology Commission on cancer genomics and precision oncology identified workforce capability, education, and training as major constraints to equitable implementation. As genomic and multi-omic technologies become integrated into cancer care, structured approaches are needed to define competencies across the multidisciplinary workforce.

METHODS: The Core Competency Framework for Precision Oncology was developed using a narrative review and iterative expert-informed framework development process. Women’s entrepreneurship represents an important source of economic participation, job creation, and local development in Kosovo. Despite gradual progress, women entrepreneurs continue to face structural constraints linked to family responsibilities, unequal care burdens, and uneven institutional support. This study examines how family-related responsibilities and institutional support mechanisms interact to shape the entrepreneurial experiences of women entrepreneurs in Kosovo. The analysis is guided by the 5M framework of women’s entrepreneurship developed by Brush et al. (2009) and applies a mixed-methods research design combining survey data from 145 women-owned businesses, semi-structured interviews, and secondary evidence.
