Cybersecurity Mission Creep, Mailyn Fidler Jan 2026

Cybersecurity Mission Creep, Mailyn Fidler

Law Faculty Scholarship

Cybersecurity is experiencing mission creep. Policymakers are casting more and more problems as issues of cybersecurity. So refrained, wildly different policy issues, from misinformation, to child social media safety laws, to antitrust regulations, to alleged journalist misconduct, to anti-sex trafficking statutes become what this Article calls "cybersecuritized." Before this refraining, these issues present as important but not existential. But once cybersecuritization positions the issues as threats intensified by their technological nature, they gain access to the politics and law of urgency and exceptionalism and invite troubling governance responses. Positioned as security threats, cybersecuritized issues become endowed with the apparent normative …

Elementary Teachers' Perceptions On Mtss, Inclusion And Instructional Pedagogy, Sarah Mccusker Jan 2026

Elementary Teachers' Perceptions On Mtss, Inclusion And Instructional Pedagogy, Sarah Mccusker

All Capstone Projects

The purpose of the study was to examine elementary teachers’ perceptions of the multi-tiered system of support (MTSS) implementation process, their understandings of inclusion, and the ways these beliefs informed their pedagogy. To gain deeper insight into these dynamics, a phenomenological approach was employed, in which elementary educators were invited to participate in interviews that focused on the MTSS process in their school contexts. Findings revealed teachers’ interpretations of inclusive classrooms, their perceptions of MTSS frameworks, and the strategies they used to address students’ academic and behavioral needs while recognizing individual strengths. Teachers shared their beliefs about students who do …

MA Theses

This research aims to reconstruct foundational history of the Case, based on the publicly available sources. Using the established factual background to test the significance of each of the three major assumptions, referred traditionally as motivation behind the studied Case undertaking. Through critical analysis this Thesis targets to uncover the keystone of this Case and use it as the background to introduce the governance Duty of Stewardship concept in the corporate collection context. Assuming the introduced concept sustains initial analysis, assess its potential value for further strategic development of the corporate collections of the contemporary art.

On Dark Skinned Jesus Of Nazareth: Why Color Matters, Nicholas Berkel Jan 2026

On Dark Skinned Jesus Of Nazareth: Why Color Matters, Nicholas Berkel

MA Theses

This thesis examines the historical, religious, and cultural consequences of portraying Jesus as white within Christian art. Although Western art has overwhelmingly depicted Christ with white skin, archaeological, and contextual evidence supports a dark-skinned Jesus rooted in the ethnogeography of first century Palestine. The persistence of a White Jesus has shaped religious imagination and perception for centuries, reinforcing racial hierarchy and legitimizing systems of white supremacy. Through an interdisciplinary analysis combining biblical studies, Christian iconography, ethnography of ancient Semitic, Greco-Roman, and Egyptian peoples, medieval symbolism, modern mass-produced imagery, and Black thought, this study demonstrates how Jesus’ original complexion was gradually …

From Monasteries To The Market: The Legal And Spiritual Economies Of Himalayan Art In China, Hengshi An

MA Theses

In recent years, the Himalayan art market in China has shown a remarkable transformation, emerging as one of the most dynamic segments within the broader Asian art economy. While much of the global and domestic art market has stagnated, Tibetan and Himalayan artworks have achieved sustainable growth and high auction price with major collections been published, showing structural strength rather than speculative enthusiasm. This paper examines the drivers behind this phenomenon through a qualitative analysis of auction data, dealer networks, and collector behavior across key hubs in China such as Beijing, Chengdu, Shanghai, and Hong Kong. The findings suggest that …

From It-Girls To Obscurity: What Happened To The Stettheimer Sisters?, Catherine Pierce Higgins Jan 2026

From It-Girls To Obscurity: What Happened To The Stettheimer Sisters?, Catherine Pierce Higgins

MA Theses

This dissertation explores the lives and impact of the three Stettheimer sisters, Florine, Carrie and Ettie, cultural innovators, and major influencers of a distinctive, feministic strand of American modernism in New York between 1914 and 1950. The Stettheimer sisters did not use their privilege to assimilate into society but to create an alternate artistic universe, resisting the male hierarchies of the dominant avant-garde. By controlling a salon, an intellectual and creative social center where artists, writers, and intellectuals such as Marcel Duchamp, Georgia O’Keeffe and Carl Van Vechten held court, they were able to create an environment in which femininity, …

Does Textualism Constrain Supreme Court Justices?, James J. Brudney, Lawrence Baum Jan 2026

Does Textualism Constrain Supreme Court Justices?, James J. Brudney, Lawrence Baum

Faculty Scholarship

A principal justification for textualism is the constraint hypothesis. Conservative Justices and leading textualist scholars contend that—in stark contrast to reliance on legislative history—focus on the ordinary meaning of enacted text leaves little room for the Justices to be policy-oriented or ideological in their interpretations. This Article represents the first systematic study probing the validity of the constraint hypothesis, one that employs both quantitative and qualitative analysis.

The Article examines the Justices’ reliance on interpretive resources in over 660 statutory decisions in the field of labor and employment, decided by the Burger Court, the Rehnquist Court, and the Roberts Court—during …

Brokering Safety, Chinmayi Sharma, Thomas E. Kadri, Sam Adler Jan 2026

Brokering Safety, Chinmayi Sharma, Thomas E. Kadri, Sam Adler

Faculty Scholarship

For victims of abuse, safety means hiding. Not just hiding themselves, but also their contact details, their address, their workplace, their roommates, and any other information that could enable their abuser to target them. Yet today, no number of name changes and relocations can prevent data brokers from sharing a victim’s personal information online. Thanks to brokers, abusers can find what they need with a single search, a few clicks, and a few dollars. For many victims, then, the best hope for safety lies in obscurity—that is, making themselves and their information harder to find.

This Article exposes privacy law’s …

An Empirical Study Of Malingering In Insanity Cases Across Twelve Decades, Deborah W. Denno Jan 2026

An Empirical Study Of Malingering In Insanity Cases Across Twelve Decades, Deborah W. Denno

Faculty Scholarship

The last 120 years have seen a surge in the use of neuroscientific evidence in American criminal law cases, fueled by discoveries in brain science that have challenged the legal system’s assumptions about human thinking and culpability. One key assumption is that many defendants “malinger,” that is, feign or fake insanity or mental illness, to garner an acquittal or mitigated punishment. Likewise, when potential evidence that a defendant is malingering is introduced in court, it can have a pronounced and powerful negative effect on the defendant’s insanity claim, especially when juries and criminal justice actors are already skeptical of insanity …

The Black Hole Of Capital Gains: Etf Swap Funds, Jeffrey M. Colon Jan 2026

The Black Hole Of Capital Gains: Etf Swap Funds, Jeffrey M. Colon

Faculty Scholarship

ETFs have begun to challenge mutual funds as the dominant U.S. public pooled asset vehicle.  Their constant liquidity, exposure to an ever widening range of investment strategies, and highly touted tax efficiency have driven the explosive growth in the assets under management of ETFs over the last 15 years.  The tax efficiency is due to section 852(b)(6), which permits ETFs to distribute appreciated property tax free and eliminate all fund-level taxable gains even while making portfolio adjustments, which mutual funds cannot do.

Fund sponsors have developed various strategies to exploit the benefits of section 852(b)(6), with the newest being the …

Postpartum Psychosis On Trial: A Preview Of Commonwealth V. Clancy, Jolie Zangari Jan 2026

Postpartum Psychosis On Trial: A Preview Of Commonwealth V. Clancy, Jolie Zangari

Scholarly Works

In the case of Commonwealth v. Clancy, the deaths of three young children are the focus of the upcoming criminal trial.  However, the identity of their killer will not be at issue.  The children, Cora, Dawson, and Callan Clancy, were killed by their mother, Lindsay Clancy, who then attempted suicide, but survived with severe permanent injuries. The critical issue to be litigated is—why?  Why did she kill them?  Most fundamentally at issue is whether Lindsay Clancy was suffering from symptoms of a mental disease so severe that she should be found not guilty by reason of insanity.

The Commonwealth of …

Who Decides Who Gets Deported?, Mauricio Noroña, Peter L. Markowitz Jan 2026

Who Decides Who Gets Deported?, Mauricio Noroña, Peter L. Markowitz

Scholarly Works

As President Trump began his second term, he promised the largest mass deportation program in U.S. history, backed by unprecedented increases in immigration enforcement funding. Yet even at historically unprecedented resource levels, the government can reach only a fraction of the tens of millions of noncitizens now subject to deportation. So this Administration, like every administration before it, must make choices about whom to target—and every decision to deport someone necessarily entails an implicit or explicit decision to deprioritize someone else. But who makes those decisions?

Every modern presidential administration has tried to vest such choices in high-level, politically accountable …

Health Insurance As A Mediator Of Neighborhood Deprivation And Pediatric Cancer Survival: An Analysis Of State Cancer Registry Data, Emma Hymel, Cheng Zheng, Jenna Allison, Kendra L. Ratnapradipa, Edward S. Peters, Sarah H. Nash, Mei-Chin Hsieh, Shinobu Watanabe-Galloway Jan 2026

Health Insurance As A Mediator Of Neighborhood Deprivation And Pediatric Cancer Survival: An Analysis Of State Cancer Registry Data, Emma Hymel, Cheng Zheng, Jenna Allison, Kendra L. Ratnapradipa, Edward S. Peters, Sarah H. Nash, Mei-Chin Hsieh, Shinobu Watanabe-Galloway

Journal Articles: Epidemiology

INTRODUCTION: To develop interventions to reduce neighborhood-level disparities in pediatric cancer outcomes, it is necessary to understand their underlying mechanisms. It has been suggested that individual-level health insurance is a mediator of neighborhood deprivation and pediatric cancer survival.

METHODS: This study was a population-based longitudinal study of children with cancer from 2000 to 2020 in the Iowa Cancer Registry and Louisiana Tumor Registry. Neighborhood deprivation was measured using the Area Deprivation Index. Log-binomial regression models were used to identify predictors of health insurance status at diagnosis. Cox regression models were used to assess the association between health insurance status at …

Nicolini, Jesse J. Waggoner, Sami Alcedo, Davidson H. Hamer, Ralph Huits, Michael Libman, Geosentinel Network, Tropnet Network, Kevin O'Laughlin

Journal Articles: Epidemiology

BACKGROUND: Recent global epidemics and pandemics have highlighted the need for adequate diagnostic capacities to respond to emerging threats. Strengthening operational capacities can lead to improved preparation; investing in emergency response infrastructure may diminish progression of outbreaks and prevent escalation.

METHODS: An email-linked survey was sent January-March-2025 to two global infectious disease surveillance networks' (GeoSentinel and TropNet) participating clinics assessing capacity for Oropouche virus (OROV) diagnostic testing. Data on testing capacity for other arboviruses was also requested.

RESULTS: Responses were obtained for 58 GeoSentinel/TropNet sites (58/104, 55.8%): 50% responding sites (29/58) had OROV diagnostic testing available at a public reference …

Climate And Other Environmental Factors Predict Tick Abundance And Lyme Cases In Minnesota One And Two Years In Advance, Kathleen E. Angell, Janet Jarnefeld, Elizabeth K. Schiffman, M. Jana Broadhurst, Jianghu James Dong, Abraham Degarege, Roberto Cortinas, David Brett-Major Jan 2026

Climate And Other Environmental Factors Predict Tick Abundance And Lyme Cases In Minnesota One And Two Years In Advance, Kathleen E. Angell, Janet Jarnefeld, Elizabeth K. Schiffman, M. Jana Broadhurst, Jianghu James Dong, Abraham Degarege, Roberto Cortinas, David Brett-Major

Journal Articles: Epidemiology

BACKGROUND: Environmental factors, like weather and host abundance influence tick populations which in turn affect tickborne disease in endemic regions. It is important to understand how these factors are associated with tick abundance, and whether they can predict disease. We assessed associations between environmental factors, tick abundance, and human Lyme disease cases in the same year and with one- and two-year lags in Minnesota. In parallel, we compare conventional analytical methods with a novel machine learning approach to evaluate their relative strengths and potential for integration.

METHODS: Environmental and tick abundance relationships were examined using generalized linear mixed-effects models (GLMM), …

Smith, Jeff Hamik, Roberto Cortiñas, Joseph R. Fauver

Journal Articles: Epidemiology

Ixodes scapularis ticks transmit a number of pathogens important to human health, including Borrelia burgdorferi sensu stricto, the causative agent of Lyme disease. While I. scapularis is found across the Eastern United States, Lyme disease transmission is largely limited to the Northeast and Upper Midwest and is nearly absent in the South. This indicates that differences in northern versus southern clades of I. scapularis are associated with differences in Lyme disease transmission risk. Ixodes scapularis is undergoing range expansion, including into the Great Plains region of the United States. Determining where I. scapularis populations in the Great Plains originated can …
