Embankments are essential components of transportation infrastructure, providing crucial support for long stretches of highways, railways, and other routes in California and around the world. Clay embankments are susceptible to weather-related deterioration processes that can gradually compromise their stability and, in some cases, lead to unexpected failures. Ideology And Iconography In Gustav Machatý’S Ecstasy (1933), Karl E. Toepfer

This essay discusses the cinematic construction of sexual ecstatic experience in Gustav Machaty's 1933 film Ecstasy. Sergei Eisenstein's theory of cinematic montage governs the shapes the way the filmmakers organize the representation of erotic desire and rapture. But the film also shows affinity with the Czech "Poetist" movement of the 1920s in constructing a guiding view of ecstatic experience. The essay analyzes many images in the film, and concludes with an application of montage theory of ecstatic cinema to the consumption of erotic videos and internet imagery.

Sixty years after it was decided, Miranda v. Arizona remains one of the most significant and renowned cases—as well as, arguably, one of the most controversial cases—in the history of the United States. Chief Justice Earl Warren’s majority opinion, establishing the eponymous Miranda warnings for custodial interrogation of criminal suspects, has prompted voluminous and continuing commentary, among both critics and supporters. This Article is part of an ongoing project exploring a particular aspect of Chief Justice Warren’s majority opinion: a footnote referencing Jewish legal sources, documenting an important passage at the start of a pivotal section of the opinion.

The Ideological Work Of Penal Reform: How Reformers Justify Penal-Welfare Hybridization, John Halushka, Brandon Miller

This article uses the Santa Clara County Reentry Resource Center (RRC) as a case study to explore the cultural content of penal reform. Specifically, we explore the discourses that officials use to publicly justify projects of penal-welfare hybridization, or the linking of state systems of punishment and welfare to manage criminalized populations. Our qualitative analysis draws on a dataset consisting of county planning documents, budgets, videos, press releases, and newsletters published online between 2011 and 2023. By examining these materials over time, we are able to chart patterns of consistency and variation in how officials justify hybridization. We find that …

Native American tribes are the original sovereign peoples of the lands that now comprise the United States, with histories, governments, and cultures that predate the founding of the nation by thousands of years. Long before European colonization, hundreds of distinct tribal nations exercised independent political authority over their territories. Although the United States entered hundreds of treaties recognizing tribes as distinct political entities, federal Indian policy evolved over time through periods of treaty-making, forced removal, allotment, assimilation, termination, and, since the 1970s, tribal self-determination. Section 504 of the Rehabilitation Act of 1973 was designed to eliminate disability-based discrimination in federally funded educational institutions. However, its practical application remains inconsistent, often resulting in systemic inequities for students in low-socioeconomic situations. This dissertation study critically examines how social justice issues manifest in the implementation of Section 504 plans for high school students in low-socioeconomic situations and was conducted in one school district located within Washington State. While the presence of international Catholic Sisters serving in the United States has grown (Johnson et al., 2019), the lived experiences of Vietnamese Catholic Missionary Sisters remain largely absent from the scholarly literature. Addressing this gap, this qualitative study examined adaptation, resilience, and thriving among the Sisters serving in the United States by centering their voices through in-depth narratives. Their experiences were interpreted through Social Identity Theory, Servant Leadership, and Transformational Leadership Theory within the context of Vietnamese Catholicism and the charism of the Lovers of the Holy Cross. The Supreme Court of Canada has repeatedly held that police sniffer dog searches are Charter-compliant based on a low standard of reasonable suspicion because they are minimally intrusive, narrowly targeted, and can be highly accurate. Since the Court last considered their constitutionality, however, extensive empirical research has fundamentally challenged assumptions about the reliability and accuracy of police sniffer dogs, as well as the harm to individuals subjected to these searches. Moreover, the phenomenon of handler cueing can operate to transmit a police officer’s unconscious biases—even those they would consciously reject—to their dogs, further reducing accuracy and leading to false alerts …

Race and Racism in Canada's Immigration Detention System is the first comprehensive, independent study to examine race and racism in Canada's immigration detention system. Grounded in rigorous legal analysis and qualitative research, the study draws on interviews with 50 participants, including people with lived experience of immigration detention, as well as lawyers, paralegals, and service providers who work in immigration detention. The research was guided by an advisory board of people with lived-experience in immigration detention and co-led by a collaborative research team.

Coastal urban areas are increasingly exposed to flooding driven by more frequent and intense rainfall events, rising sea levels, and expanding impervious surfaces. Norfolk, Virginia, a low-lying coastal city with aging stormwater infrastructure, faces heightened vulnerability to these hydrologic pressures. This study evaluates the hydraulic performance of an existing urban detention basin within the Edgewater–Larchmont catchment under 10-, 50-, and 100-year, 2-h design storms using the U.S. Environmental Protection Agency’s Storm Water Management Model (SWMM). The electrochemical conversion of biomass-derived 5-hydroxymethylfurfural (HMF) represents a promising, economically viable, and environmentally sustainable approach for producing value-added chemicals using renewable energy and in situ hydrogen generated through water electrolysis. However, the electrochemical hydrogenation (ECH) of HMF remains challenging due to the inherently low catalytic activity and selectivity of the electrodes, compounded by competition with the kinetically favored hydrogen evolution reaction (HER) in aqueous electrolytes. The hydrothermal liquefaction (HTL) process offers an energetic advantage over pyrolysis because it does not require prior drying of the biomass feedstock. However, there are significant challenges in simultaneously estimating both the yields and characteristics of products from the HTL of biomass with theoretical support. This study developed a unique element-based kinetic model to predict the yields, higher heating values, and fuel characteristics of solid residue and heavy bio-oil, based on the temperature, residence time, solid loading, and elemental composition (C, H, N, and O) of corn stover. Although hydrothermal liquefaction (HTL) is the leading technology in converting wet biomass into bioenergy, the treatment of its toxic-laden aqueous phase wastewater presents a major challenge on its path toward commercial viability. This study presents the first-ever assessment of sewage sludge-fed HTL wastewater (SS-HTLWW) treatment and toxic compound removal using municipal activated sludge (AS) by optimizing its cultivation condition. It was found that AS with optimized pretreatment can remove up to 91.2% of the soluble chemical oxygen demand (sCOD) in SS-HTLWW, of which up to 82% can be attributed to biological mineralization and adsorption of sCOD by AS. Assessing seismic risk to spatially distributed infrastructure systems requires realistic representations of spatially correlated ground motions. Existing models for the spatial correlations of ground motions rely on strong second-order stationarity assumptions, under which the correlation structure is assumed to be invariant across space, potentially masking regional variations. Because repeatable site and path effects can vary spatially, the resulting correlation structure is likely to be nonstationary. We propose a nonstationary spatial correlation method that captures geographically varying correlation decay behavior. Emerging transportation technologies are rapidly reshaping transportation systems and industry practice. However, most transportation undergraduate curricula still emphasize foundational topics such as geometric design, travel demand forecasting, pavements, and soil properties, typically delivered through lecture-centric instruction. While these subjects remain essential to the discipline, they do not fully reflect the pace of technological change or provide sufficient opportunities for experiential learning with modern tools and data. Surface water-groundwater interactions are complex in the Great Bend region of the Yellow River. Clarifying water exchange and source differences among geomorphic units is important for understanding regional hydrological processes and improving water resources management. In this study, the Wulanmulun River Basin, a typical tributary of the Yellow River, was selected as the study area. A total of 90 water samples were collected, including 25 river water samples, 43 groundwater samples, and 22 precipitation samples. This research presents a cost-effective microscale modeling analysis of high-efficiency particulate air (HEPA) filter media. We analyzed leak-free and leaking media with known leak sizes. A three-dimensional fibrous model with non-homogeneous fiber diameters (0.2–2 µm) and a packing density of 7.5% was developed to replicate a HEPA filter sheet (H14) microstructure. The objective was to simulate and analyze the pressure drop and collection efficiency of nanofibrous media for aerosol particles with a diameter of dp ≤ 0.5 µm. In semi-arid surface water-groundwater systems, nitrate (NO₃–) and sulfate (SO₄²–) are jointly influenced by natural processes and anthropogenic activities, yet how their sources, transformations, and export vary across contrasting activity zones remains insufficiently understood. Integrating hydrochemistry, multiple stable isotopes, a Bayesian isotope mixing model, and representative-section flux analysis, this study investigated the source compositions, transformation processes, and export differences of NO₃– and SO₄²– in the Dahei River Basin. New hydrological insights for the region: Results showed greater SO₄²– enrichment in high-activity zones, whereas NO₃– exceedance was more prominent in low-activity zones. In …

In this Article, I argue that courts regularly deviate from Federal Rule of Evidence 404(b), which prohibits character evidence—evidence of a defendant’s past misdeeds offered to prove that the defendant acted in conformity with a certain character trait on the occasion in question. These deviations undermine the fairness of a trial and the presumption of innocence. The Article addresses this problem in three ways. First, it explains how courts have misinterpreted Rule 404(b)—an error that I call the permitted-purpose fallacy—and how they have fortified this misinterpretation with a body of flawed principles and precedent. American universities are frequently portrayed as stewards of democracy—sites where dissent is protected, truth is pursued, and diversity is championed. Yet these institutions often betray these ideals, especially under the pressures of donor influence, reputational risk, and political retrenchment. This Essay interrogates the internal contradictions of the university by centering one of its most guarded rituals: faculty hiring. Building on my 2021 article The Soft Shoe and Shuffle of Law School Hiring Committee Practices, I argue that hiring serves as both a performance of inclusion and a mechanism for preserving institutional whiteness, elite networks, and gatekeeping norms.
