Judicial and legislative involvement in agency rulemaking is a relevant and particularly salient topic. The authority of an agency to make sound policy with flexibility and discretion often comes into conflict with the judiciary’s duty to prevent arbitrary regulations, which lack solid evidence or convincing rationale. Considering that more than three million passengers fly every day, it is no surprise that establishing a robust certification process for pilots is among the Federal Aviation Administration’s top priorities. As commercial space activities move from state-led exploration to market operations, outer space is changing from a mission space into a workspace. As a result, the traditional connecting point for employment taxes, centered on the workplace, begins to lose force. This Article develops the concept of outer space employment taxation and argues that its key issue is not taxation in orbit, but enforceability. International space law does not directly provide the tax base, tax rates, or specific withholding rules. Are drug users second-class citizens under the Second Amendment? The Federal Government enacted the Gun Control Act in 1968 which imposed heaps of new regulations relating to private gun ownership, including enacting criminal statutes, namely 18 U. S. C. §922(g), which allows an individual to face charges if that individual is categorized under any of § 922(g)’s enumerated subsections. How To Stop Mass Shootings Without Violating The Second Amendment: Designing Regulations To Prevent Acts Of Mass Violence That Pass The 6:3 History And Tradition Test, Robert D'Alessandro

The article proposes that states can constitutionally implement ammunition possession limits to reduce mass violence by aligning such laws with the "history and tradition" test established by the current Supreme Court. It argues that modern caps on ammunition are analogous to early American gunpowder restrictions, which were enacted for public safety to prevent catastrophic explosions in populated areas.

This Article posits that the concept of "erotic justice" could be used by courts to push back against the current cascade of anti-LGBTQ+ laws and meaningfully improve the lives ofgay and trans people. The beginning of the twenty-first century was widely seen as a time of great progress for LGBTQ+ people, with the legalization of gay marriage in countries across the world seen as the ultimate triumph. Why are sanctuary states and cities in the present moment largely failing to protect immigrants and other vulnerable people from federal enforcement of an agenda based on mass deportation and fear? While federalism was painted during the Civil Rights Era as a weapon of states to protect policies of discrimination and segregation, federalism was also a powerful tool used by Northern States before the Civil War to resist Southern and federal laws enabling the dehumanizing capture and transport offugitive slaves (or suspected fugitive slaves). Recent political events have laid bare the ways that the United States functions like a plutocracy, in which the ultra-wealthy exert influence over core governance functions. The criminal system is not immune from this influence. Big Capital shapes the operation of the criminal system in highly visible ways through its investments in policing technology, electronic monitoring systems, and correctional and detention systems. This Article shows how the economic elite shape the operation of the criminal system in a less obvious way: through philanthropic giving. Sea level rise poses significant risks to coastal infrastructure and recreational activities, limiting public coastal access. In this study, we evaluate the current use and measure the recreational value of coastal access areas in Bristol County, Rhode Island, while assessing the vulnerability of those areas to rising sea levels. By combining measurements of non-market economic value derived from cellular device location data with modeled future sea level projections, we quantify the economic value at risk under different inundation scenarios. We produce site-level results, which provide context and quantifiable measurements of social value that can guide prioritization of mitigation strategies to …

Tree failures (e.g., stem breakage, uprooting, or branch drop) can pose significant risks to public safety, particularly along powerline corridors for the risk of power outages and wildfire ignitions. In California, tree-related powerline failures have led to severe ecological and human costs in recent years. Despite extensive research on tree failure in urban environments and post-disturbance contexts, comparatively little empirical work has examined where powerlines intersect largely unmanaged stands. In urban forestry, trees provide numerous economic, ecological, and aesthetic benefits to the surrounding community. One of their key roles is intercepting stormwater runoff, reducing flooding risk, and improving water quality. Chapter 1 of this thesis characterized the ecological and economic contributions of urban trees on the Marshall University campus and provides guidance on their management and conservation in the future. Chapter 2 examined how urban tree species modify the urban hydrology cycle by altering the volume and timing of precipitation delivery. “It is curious that the Legislature has chosen to give a presumption of probation for more serious felony offenses, but not for lesser misdemeanor offenses.” With those words, Judge Bishop concluded a heart-wrenching opinion in State v. Anderson, which upheld Courtney Anderson’s sentence of 240 days in jail. Despite being sentenced for a first offense Class I misdemeanor and nearly every sentencing factor counseling in favor of probation, the district court decided to separate Ms. Anderson from her two children, one of whom was a newborn. Over the last thirty years, the use of restorative justice within and adjacent to state juvenile and criminal proceedings, including community contexts, has expanded significantly in the United States. This dissertation presents a comprehensive program evaluation of vocational schools in Duval County, with the goal of laying the groundwork for assessing effectiveness of vocational education. This study utilized exploratory mixed-methods approach, gathering quantitative and qualitative data about high school graduation rates, career readiness, college enrollment, experiences, and satisfaction levels from students and faculty at fully accredited vocational high schools. A Real-Time Autonomous Mobile Robotic System For Crack Detection And 3d Laser Profiling In Construction Using Two-Stage Deep Learning, Emmanuella Ogun

This thesis presents an autonomous mobile robotic system that integrates real-time visual crack detection with laser-based three-dimensional profiling for building inspection. The system coordinates SLAM-based navigation, deep learning perception, and manipulator-guided measurement within a unified ROS 2 framework, enabling scan-on-demand workflows where laser profiling occurs selectively at visually detected defect locations. The detection pipeline employs a two-stage architecture combining U-Net semantic segmentation with Pix2Pix residual refinement, achieving 73.9% mean intersection-over-union and 76.4% F1-score on the CrackSeg9k benchmark while maintaining 16 frames-per-second real-time throughput. This study is a qualitative thematic analysis of counselor wellness practices as well as how selfidentified personal traits are part of how a counselor practices and prioritizes wellness. Theoretical underpinnings of the study integrate trait activation theory (Tett & Burnett, 2003), Martin Seligman’s wellbeing theory (Seligman, 2011), and Urie Bronfenbrenner’s ecological systems theory (Bronfenbrenner, 1977). Participants included nineteen licensed counselors (N=19). Analyzed responses lead to four main themes, each with two to four subthemes. The United States incarcerates more people than any other country. Each month, tens of thousands of people across the country are released from prison or jail. Most return to communities that are economically, socially, and environmentally disenfranchised. This Comment examines the existence and impact of alleged loopholes within American gun control laws and explores how these gaps may affect Constitutional rights, legal enforcement, and public safety. In addition to identifying trends in American gun ownership, including patterns of purchasing, possession, and regulatory compliance, this Comment analyzes the current legal standards that determine who is disqualified from owning or possessing a firearm under federal law. These categories include individuals with certain criminal convictions, domestic violence restrictions, or mental health adjudications, and how those legal standards are applied in practice.

Advanced Practice Paramedics (APPs) are highly skilled paramedics who operate in diverse clinical settings both within and outside traditional ambulance services. International evidence demonstrates that APPs enhance patient outcomes in areas such as critical and primary care. The clustering of tourist accidents is a critical yet underexplored area of research. This study employs cluster theory and safety system theory to develop a comprehensive measurement tool for analysing tourist accident clusters, examining their spatiotemporal evolution patterns, and identifying the driving mechanisms from a holistic destination perspective. By analysing accident records of Chinese outbound tourists across 48 countries from 2011 to 2019, the findings reveal a reduction in disparities among tourist accident clusters (α-convergence effect) and a fluctuating trend over time. Spatial autocorrelation analysis identifies four distinct spatial distribution patterns: low-low (L-L), high-low (H-L), high-high (H-H), and low-high (L-H). …

Railroad tank cars, being one of the most used means of transportation of hazardous material across the country, have not been structurally upgraded for a long time. Thus, the Pipeline and Hazardous Materials Safety Administration (PHMSA), a United States Department of Transportation (USDOT) agency, released a rule for safer transportation of highly hazardous and flammable liquids by railroad to enhance the design specifications of both the new and existing tank cars in May 2015. The rapid advancement of intelligent surveillance systems and the increasing demand for reliable biometric identification in border security, public safety, and digital forensics require robust face understanding under unconstrained conditions, including low resolution, pose variation, and occlusion. While Vision Transformer (ViT)-based foundation models have greatly improved visual representation learning, their patch-based tokenization and lack of spatial inductive bias limit their ability to capture fine-grained details in low-resolution inputs. This dissertation investigates multimodal representation learning for face understanding through natural language supervision, large-scale face-caption pre-training, and parameter-efficient foundation model adaptation. During major ocean storms (hurricanes, tropical storms, nor’easters), coastal communities often experience negative outcomes that local emergency managers (EMs) did not anticipate or sufficiently prepare for. Local EMs often have difficulty obtaining specific, local forecast data and consequence predictions they can act on to prevent losses and minimize avoidable consequences. Despite tremendous advances in forecasting science, uncertainty remains a constant in storm decision making, requiring local EMs to make critical response choices under pressure of limited time and incomplete information.
