Widening The Avenues For Rehabilitation And Release In The Criminal Legal System Through A Revision Of The First Step Act's Safety Valve Provision In Response To Pulsifer, Drew Svensson

Cardozo Journal of Equal Rights & Social Justice

The note argues that the Supreme Court's decision in Pulsifer v. United States severely undermines the First Step Act by restrictively interpreting the safety valve provision, thereby limiting judicial discretion and increasing incarceration. To remedy this, the note proposes legislative revisions to the safety valve to expand eligibility for relief from mandatory minimums while maintaining public safety.

Technological innovation has made virtual appearances by criminal defendants increasingly common. These appearances have advanced efficiency but also raised questions about the scope of both the right and the duty of defendants to be physically present in court. Should judges, for example, be allowed to hold virtual arraignments, even if a defendant wishes to appear in person? Can defendants opt for virtual appearances at will? While courts are beginning to address these questions, they have yet to develop a coherent framework to evaluate when virtual appearances are constitutional and appropriate. The United States recorded its largest ever unhoused population in 2024. Acute affordable housing shortages and climate-fueled natural disasters have exacerbated a decades-long unaddressed humanitarian crisis, straining resources in cities and rural areas alike. In response, state and local governments have pivoted to a more punitive approach to houselessness. Draconian "anti-camping" ordinances subject houseless people to fines or arrests while police destroy their property in encampment "sweeps," disconnecting the unhoused from critical social structures. Quality-of-life laws criminalize basic biological functions in public. New York, California, and other states have expanded the reach of involuntary civil commitment procedures, forcibly hospitalizing and …

This paper describes the application of wargaming-based approach (scenario-based planning via a tabletop training exercise) to address the complex issue of local climate impacts germane to Naval base operations within the context of its neighboring communities. Using a novel interdisciplinary approach, our team conducted a Military Installation Resilience Review to inform Naval Station Newport (Rhode Island, U.S.A.) and the three surrounding municipalities on fostering, protecting, and enhancing a resilient future against natural hazards. Associations Between Traumatic Life Events And Substance Use Among Black Men Who Are Incarcerated, Jasmine K. Jester, Brittany Miller-Roenigk, Paris B. Wheeler, Danelle Stevens-Watkins

Educational, School, and Counseling Psychology Faculty Publications

The current study examined associations between traumatic life events, current and lifetime importance of mental health and substance use treatment, and crack cocaine use among 201 Black men who were incarcerated and nearing community reentry. Results indicated age, sexual trauma and lifetime importance of drug treatment were significantly associated with an increased likelihood of crack cocaine use. Substance abuse treatment in correctional settings should consider culturally tailored assessment and treatment for history of unaddressed sexual trauma among Black men who are incarcerated and use crack cocaine.

Kentucky’s public universities provide significant educational, economic, and workforce development benefits to the Commonwealth. However, because these institutions are exempt from local property taxes, questions arise about the fiscal effects on the communities that host them. While the benefits generated by universities extend beyond municipal boundaries, the fiscal effects of tax-exempt property are often concentrated within host communities. As universities expand their campuses and acquire additional property, local governments may face increased demands for public services without a corresponding increase in property tax revenue.

This Article considers how eliminating meaningful choices inside prisons harms individuals and obstructs reintegration efforts. While any individual restrictions on incarcerated people may seem minor—such as limitations on the food available in the commissary— they accumulate to a point where people adopt passive, compliant behaviors and attitudes that are adaptive inside yet maladaptive outside the prison walls. Thus, we argue that even modest improvements in prisoner autonomy could reduce recidivism and achieve the public safety goals of incarceration.

The article examines the strategy of institutional self-preservation employed by the Ukrainian Orthodox Church of the Moscow Patriarchate (UOC-MP) under conditions of Russian armed aggression. The relevance of the topic is determined by the adoption of Law of Ukraine No. 3894-IX “On the Protection of the Constitutional Order in the Sphere of Activities of Religious Organizations,” aimed at limiting the influence of religious structures affiliated with the aggressor state. Flooding is one of the most frequent and damaging natural hazards in the United States, with impacts expected to intensify under changing climate conditions. In regions such as West Virginia, complex terrain, development patterns along river corridors, and socioeconomic disparities contribute to elevated flood risk. Traditional approaches to flood risk assessment often focus on single dimensions of vulnerability or rely on binary floodplain maps, which do not fully capture the spatial variability and multidimensional nature of flood resilience.

Battery electric vehicles (BEVs) rely on accurate thermal management to ensure component performance, efficiency, safety, and long-term durability. Critical propulsion system components, including electric motors and high-voltage battery packs, are commonly monitored using physical temperature sensors. However, these sensors increase system cost, introduce additional hardware complexity, and may be impractical for directly measuring temperatures at critical internal locations. Virtual temperature sensors (VTSs) provide a software-based alternative by estimating component temperatures using readily available vehicle operating data.

Puget Sound is a densely populated, tectonically active area that can be affected by earthquakes from local crustal faults and the Cascadia subduction zone capable of producing abrupt coseismic subsidence. Tidal wetlands are particularly sensitive to abrupt changes because they are depositional environments that reside at sea-level and their lithology and ecological communities are strongly controlled by elevation within the tidal frame. As a result, coseismic subsidence can disrupt established environmental gradients and leave distinguishable signatures preserved within the stratigraphy, like tidal mud directly over peat deposits. The use of social media platforms to share, view, and communicate information is now ubiquitous (Crockett, 2017). Given the prevalence of problematic content found on social media (e.g., prejudice, misinformation), this research examines how accurately people predict their responses to such content. Kawakami et al. (2009) found that individuals overestimate their emotional distress and behavior in response to discriminatory actions (i.e., racism) in-person predicting they would be more upset, and more likely to reject a racist confederate than individuals who experienced the incident actually were. California faces an escalating wildfire crisis, driven by climate change, drought, and development in fire-prone areas. Despite decades of scientific research on wildfire behavior and risk reduction, catastrophic fires since 2017 raise a critical question: to what extent have California state laws and policies kept up with the intensifying wildfire crisis? Ethnic and racial diversity in police services has been a focus for criminologists and policing scholars for some considerable time. But despite intense efforts, most multicultural societies still struggle to get Black minority communities recruited into their police services. Two widely held interconnected assumptions appear to be at issue. The first is that police occupational culture, which has been shown in some studies to be prejudicial, is, in many cases, blatantly racist. On-campus active shooter incidents challenge U.S.-based Institutions of Higher Learning (IHLs) as they are usually only identifiable after the first shot. My mixed-methods, exploratory study was conducted to fill gaps in the limited research regarding on-campus active shooter incidents. Using purposive sampling, I identified two IHL security directors for the initial qualitative phase of my research.
