Jails throughout the United States hold thousands of legally eligible voters who have not been convicted of a crime While those convicted of felonies are often statutorily disenfranchised, pretrial detainees retain their civil rights—including the right to vote. In theory, this should guarantee them a voice. In practice, pretrial detention operates like a legal disqualification. Without meaningful enforcement mechanisms, the right to vote becomes hollow.

This Comment argues that implementing a national standard based on the proactive policies of Massachusetts and Nevada will ensure accessible voting for pretrial detainees. To build that argument, this Comment first explores the low level …

This Note addresses the insufficiency of the current system in protecting criminal defendants’ privilege against self-incrimination. Part II will outline the background legal principles of the issue, including the privilege against self-incrimination, the presumption of innocence, and the no-impeachment rule. This part will also address the Supreme Court’s sole judicial exception to the no-impeachment rule as laid out in Peña-Rodriguez v. Colorado. Part III will address the statistical significance of juror bias against criminal defendants who invoke the privilege, highlight the widespread nature of the bias, and argue that the procedural safeguards currently in place are insufficient to protect.

A host of statutory schemes seek to ensure equal employment opportunities in the United States by eradicating workplace discrimination (“EEO laws”). Consider two foundational pillars necessary for these EEO laws to strike the desired balance between individual rights and workplace efficiency. First, employees require robust protection from retaliation if they engage in protected conduct—for example, by reporting perceived discrimination. Second, employers can—and ideally, should—make employment decisions based on how an employee performs the job.

In this circumstance, a conservator has a perverse incentive to profit off of and coerce their conservatee into labor which serves to benefit the conservator—a kind of involuntary servitude that would seem to implicate the plain text of the Thirteenth Amendment of the United States Constitution.

“We Talked About Straight People Sex”: The Health Education Experiences Of Queer And Trans Youth In Utah, Sonny Partola

This article explores how Utah’s health education curriculum shapes the experiences of queer and trans youth. Drawing on critical ethnography conducted at an urban public high school, the study foregrounds the voices of six queer and trans students. Findings reveal that abstinence-focused and heteronormative curricula render these youth invisible, exclude critical information on queer, trans, and intersex health, and compromise students’ well-being. Participants described feelings of discomfort, irrelevance, and pressure to act as informal educators for peers. Their accounts highlight the urgent need for queerly responsive health education that affirms diverse identities, normalizes inclusion, and provides accurate, relevant information. Such …

Research indicates that first-generation (FG) students face a number of barriers to success in higher education when compared to their continuing-generation peers. Although many institutions serving a large number of FG students have implemented programs to support this population, little attention has been paid to institutional grading policies that reinforce harmful practices by attempting to standardize assessment while perpetuating inequalities. This study uses document analysis and critical policy analysis to examine the alignment between the grading policies and institutional values of 25 community colleges serving high FG student populations. In this dissertation, I examine the Sofa Singers, an online choir formed at the start of the pandemic. Through twice-weekly meetings over Zoom and daily interactions on a private Facebook group, individuals actively work to create their community. Using sensory engagement, technological materials, and monetary fees, participants in the community come to understand their place through affective memories and social relationships. This research analyzes textual data derived from Reddit communities to examine the lived experiences of higher education students and alumni with invisible disabilities (swID). The application of concepts and models of critical disability theory (CDT) are adopted to contextualize student experiences. The introduction of this paper provides an overview of the sport and why gender plays such a significant role in it. Twelve players were brought together for a study and were put into three focus groups to discuss and hear other player’s perspectives on gender dynamics within the sport.
