Quantum-Mechanical Definition Of The Classical Scalar Potential In Schrödinger-Pauli And Schrödinger Theory, Viraht Sahni
Quantum-Mechanical Definition Of The Classical Scalar Potential In Schrödinger-Pauli And Schrödinger Theory, Viraht Sahni
Publications and Research
According to the Bohr correspondence principle, the external temporal scalar potential in the classical equation of motion is replicated in quantum theory as a multiplicative operator. An equivalent quantum-mechanical definition of the scalar potential in Schrödinger-Pauli/Schrödinger theory is provided. The potential is a known universal functional of the wave function. At each instant of time, it is the work done in a conservative “classical” field representative of internal properties of the system: Pauli and Coulomb correlations, kinetic effects, the density, the Lorentz force, an internal magnetic component, and the current density response. The Hamiltonians are thus rewritten in a …
Understanding Brady Violations, Jennifer Mason Mcaward
Understanding Brady Violations, Jennifer Mason Mcaward
Journal Articles
This largest-ever study of adjudicated violations of Brady v. Maryland provides a detailed and nuanced understanding of who suppresses material evidence in criminal cases, as well as why, how, where, and how often. Its findings complicate the conventional wisdom that Brady violations are the work of nefarious prosecutors who intentionally withhold material evidence from criminal defendants. While it is true that “bad faith” permeates this area of constitutional noncompliance, a substantial minority of Brady cases stem from “good faith” errors by prosecutors and suppression by law enforcement officers. Most Brady violations occur in a small number of states, and most …
Too Essential To Fail: Lessons From County Fiscal Crises, Michael A. Francus
Too Essential To Fail: Lessons From County Fiscal Crises, Michael A. Francus
Journal Articles
This Article draws out the lessons of counties for municipal finance. To do so, the Article begins by unpacking the municipal finance regulations that have provided counties with extraordinary fiscal safety. The Article then turns to case studies of the eleven counties that either filed for bankruptcy or had state fiscal interventions since the passage of the Bankruptcy Code in 1978. Those case studies show how counties' finances can (in rare cases) go wrong despite well-designed municipal finance regulations. The case studies also show how counties have successfully responded to those crises through bankruptcy and fiscal intervention.
Using that analysis, …
Human Rights Methodology For Clinical Instruction: Legal Theory And Interdisciplinary Practices To Realize Human Rights Outcomes, Diane Desierto
Human Rights Methodology For Clinical Instruction: Legal Theory And Interdisciplinary Practices To Realize Human Rights Outcomes, Diane Desierto
Journal Articles
The interdisciplinary fact-finding and analytical methodologies of global human rights law, when translated to experiential learning practices (e.g., in the form of human rights legal assessments that integrate international law with domestic law and inject rigorous plausibility evaluations of client claims applicable to global as well as domestic fora) can usefully enhance and expand United States law school clinical teaching practices and the transfer of practical lawyering skills. By teaching law students: (1) the wide range of available human rights factfinding and empirical tools; (2) the techniques for broad use and application of primary and secondary evidentiary sources; and (3) …
Severability And Liberty, Randy J. Kozel
Severability And Liberty, Randy J. Kozel
Journal Articles
In US federal courts and the courts of many states, the presumption of statutory severability leads judges to separate a statute’s unlawful elements from its lawful ones. This article contends that the presumption becomes problematic when the effect of severing is to restrict the constitutional rights of a group whom the legislature exempted from regulation. Presumptive severability draws on a conception of judicial review that aspires to minimize interference with enacted legislation. But there is a countervailing constitutional interest in protecting exempted groups from restrictions on their liberty unless and until the legislature directs otherwise. It is these competing strands …

From the article
The global surge in climate change litigation provokes inquiry into the nature, frequency, and scope of climate change reparations that international, regional, and national courts, as well as arbitral tribunals and other adjudicative bodies such as UN treaty body mechanisms, determine to be adequate, both on legal merits as well as intrinsic claims of justice, for the resolution of disputes brought by climate vulnerable persons, groups, and constituencies against States, multinational corporations, and other actors. Our findings from the Notre Dame Climate Change Reparations Dataset reveal a broad spectrum of pecuniary and non-pecuniary reparations being adjudicated in …
Administering Presidential Elections And Counting Electoral Votes After Trump V. Anderson, Derek T. Muller
Administering Presidential Elections And Counting Electoral Votes After Trump V. Anderson, Derek T. Muller
Journal Articles
In the landmark case Trump v. Anderson, the Supreme Court unanimously held that states lack the unilateral power to exclude presidential candidates from the ballot on the basis of Section 3 of the Fourteenth Amendment. But while the Court was united in its essential holding, the Justices fractured in their reasoning, leaving significant questions about Congress's role in enforcing Section 3 against presidential candidates.
This Article examines the fault lines in Trump v. Anderson and analyzes how Congress's power to count electoral votes under the Twelfth Amendment intersects with its authority to enforce Section 3 of the Fourteenth Amendment. …
Meta-Interpretive Questions And The Aims Of Theories Of Interpretation: Beyond The Remedial Answer, Francisco J. Urbina
Meta-Interpretive Questions And The Aims Of Theories Of Interpretation: Beyond The Remedial Answer, Francisco J. Urbina
Journal Articles
This invited Response to Bill Watson’s “What Are We Debating When We Debate Legal Interpretation?” examines the point and purpose of interpretive theories. Watson argues that theories of interpretation are about how legal actors should exercise discretion when the law runs out. The Response builds on Watson’s sophisticated conceptual framework to explain that interpretive theories can be about at least two other topics. They can be about the most normatively appealing way of operating with sources—whether this tracks legal content or not—and they can be about which criteria for identifying something as law the legal community should adopt.
Are Nonprofit Tax Exemptions And Deductions “Federal Financial Assistance”? Should They Be?, Lloyd Hitoshi Mayer
Are Nonprofit Tax Exemptions And Deductions “Federal Financial Assistance”? Should They Be?, Lloyd Hitoshi Mayer
Journal Articles
Two recent federal court decisions have reignited the debate over whether “Federal financial assistance” as used in four federal anti-discrimination statutes includes the tax benefits enjoyed by most nonprofit organizations. Both courts concluded that it does. While an appellate court reversed one decision, and the other case settled without appellate review, these holdings create significant uncertainty. And this uncertainty affects the more than 1.8 million tax-exempt nonprofits, many if not most of which do not receive federal financial assistance through other channels and so could safely conclude these statutes do not reach them, absent these decisions.

Introduction:
With growing recognition of the influence that social risks, such as food insecurity and housing instability, have on individual and population health, social risk screening and social care interventions have proliferated across the health system. Social needs intervention research on screening and referral in specialty care is limited, despite evidence that social needs influence access to and outcomes of surgical and specialty care.
Methods:
This study is a qualitative, formative evaluation of a quality improvement-oriented social needs screening and referral pilot program implemented in a bariatric surgery practice and aims to share lessons related to the structure and process …

Secure Federated Learning Via Neural Cryptography With Homomorphic Operations, Espen Sele, Ferhat Ozgur Catak, Jungwon Seo, Murat Kuzlu
Engineering Technology Faculty Publications
This study examines neural cryptography with homomorphic operations as an alternative secure aggregation method for federated learning (FL). It proposes a novel neural cryptographic system supporting homomorphic addition on fixed-point encrypted data, and consisting of three networks, namely (1) an encryption network (Alice), (2) a homomorphic network (HO), and (3) a decryption network (Bob), along with an adversarial Eve network. Using the MNIST dataset, the proposed Neural Homomorphic Operation System (NHOS) is evaluated against a plaintext baseline and the CKKS scheme, a widely used public-key homomorphic encryption method. The results show that the proposed NHOS approach offers a satisfying performance, …

Advancing Sustainability In Civil Engineering Technology Through The Engineering For One Planet Framework, Dalya Ismael, Vukica M. Jovanovic, Murat Kuzlu, Charles Lowe, Lisa Bosman
Engineering Technology Faculty Publications
As global environmental challenges intensify, integrating sustainability into engineering technology education is increasingly critical. Yet, many programs lack comprehensive methods to embed sustainability principles, leaving graduates underprepared to address real-world environmental issues. Courses on sustainability often approach it in isolated or superficial contexts, unable to capture its complexity. The purpose of this study is to showcase one approach for embedding the Engineering for One Planet (EOP) framework into the Sustainable Building Practices course within the Civil Engineering Technology Department. The newly developed curriculum integrated learning outcomes from three EOP topics: Environmental Impact Assessment, Materials Selection, and Systems Thinking. Students were …

Flipped Classroom Techniques In A Thermodynamics Course In Engineering Technology, Nathan Luetke, Orlando Ayala, Vukica Jovanovic
Engineering Technology Faculty Publications
Teaching undergraduate thermodynamics presents numerous challenges to educators due to its inherently complex and abstract nature. The vast array of applications in engineering requires educators to strike a balance between theoretical principles and practical examples, thereby creating a meaningful and applicable learning experience. This paper presents an approach to teaching an undergraduate thermodynamics course in engineering technology developed over four consecutive semesters blending traditional lecture-based teaching with flipped classroom techniques. The teaching methods used, and modifications made each semester are presented along with student performance.

The Financialization Of The American Dream: Private Equity’S Rise In The Single-Family Rental Market, Colby Sherwin
The Financialization Of The American Dream: Private Equity’S Rise In The Single-Family Rental Market, Colby Sherwin
Honors Theses and Capstones
This thesis examines how private equity firms and other institutional investors are reshaping the single-family rental market in the United States, and what that shift means for homeownership, affordability, and community stability. What began as a short-term strategy to acquire foreclosed homes after the 2008 financial crisis has evolved into a long-term business model, with firms now owning hundreds of thousands of properties across the country. Leveraging their financial scale, these investors often outbid individual buyers, particularly in fast-growing cities. While proponents argue that institutional ownership brings professionalism and much-needed supply to tight housing markets, data shows that it has …

From Civil War To Cold War: China, The Us, And The Korean Conflict, Ethan Paul Foss
Honors Theses and Capstones
This history honors thesis investigates US foreign policy in East Asia during the early Cold War, specifically from 1945 to 1953, focusing on the Chinese Civil War and the Korean War. This thesis argues that American policymakers misjudged Chinese communism, Korean nationalism, and regional dynamics due to ideological assumptions and Cold War anxieties. The research examines missed diplomatic opportunities with Mao’s China, the flawed occupation of South Korea, and the escalation of the Korean Conflict, revealing how rigid anti-communist policies contributed to the Korean War's outbreak and strengthened communist alliances. Ultimately, it argues that the Korean War was less an …

A Comparison Of Pacing Strategies Between Males And Females Running In Carbon-Fiber Plated Shoes, Amanda P. Ares, Allison A. Petry, Morgan M. Koskela, Owen R. Daigle, Summer B. Cook
Honors Theses and Capstones
Carbon-fiber plated (CFP) shoes have been shown to enhance performance in elite runners, with less research on recreational runners. It is also unknown how CFP shoes affect pacing strategy during races. Additionally, it is known that male and female recreational runners pace differently throughout running races. Purpose: This study aimed to compare pacing strategies between male and female recreational runners running in non-CFP and CFP shoes during a 5km time trial. Methods: Twenty-one male and female recreational runners (22±4 years, 1.7±0.07m, 65.2±7.0kgs) completed two 5km time trials in non-CFP and CFP shoes in a randomized order. Participants were blinded to …
