Lower court judges across the country are struggling to manage the Supreme Court’s new “history and tradition” test that applies to Second Amendment challenges. This Article articulates one fundamental reason for the struggle: nobody is quite sure what a judge is actually doing when she evaluates claims about what happened in the past. Is it traditional legal reasoning— weighing evidence and looking for patterns? Is it fact-finding of the sort we think expert historians should testify about—conveying to a trial judge the best evidence we have about the purpose of colonial gun laws? The patent system provides a surprisingly rich archive of the interplay between social norms and technological change. Patent law requires applicants to publicly disclose the novelty and usefulness of their inventions, thereby bringing to light areas of innovation that may have previously lived in the shadows. In other words, patent law encourages public disclosure of technologies that are taboo—developed and practiced in secret, for reasons such as social approbation, illegality, or religious sanctity. To obtain a patent for a taboo technology, patentees must establish their legitimacy as innovators while navigating cultural norms that are hostile to their fields of innovation. …

For this symposium, I was not assigned to talk about Megan [Fairlie]’s work per se, and so I initially planned to discuss something completely different. In the end, however, I came back to Megan’s work because I believe her scholarship provides a new way of thinking about the entrenched challenges currently facing our collective field of study: international criminal law and procedure.
As we all know, Megan was an accomplished comparativist, and her area of expertise was criminal procedure. Even more particularly, Megan specialized in the criminal procedure of the still relatively new international criminal courts and tribunals. She focused …

In this moment, Diversity, Equity, and Inclusion (DEI) programs are hotly debated and very misunderstood. Contrary to popular belief, DEI programs do not drastically change an employer’s hiring practices. They are, to some extent, performative. In this essay, I explain what DEI really is and why a rebranding (or at least a new name) might be in order.

Background
Fatigue is a common problem in individuals with multiple sclerosis (MS).
Objective
The objective was to evaluate the effects on fatigue of having 4 weeks of
access to audio recordings of therapeutic hypnosis (HYP) and mindfulness meditation
(MM) practices.
Methods
A total of 333 individuals with MS and fatigue were randomly assigned to
one of the three treatment conditions for 28 weeks: (1) access to therapeutic HYP audio
recordings, (2) access to MM audio recordings, or (3) no access to recordings
(treatment as usual or TAU). Fatigue impact (primary outcome) and other outcomes

Flaviviruses such as Dengue, West Nile, and Zika viruses are mosquito-borne RNA viruses that can cause serious diseases in humans. To develop effective drugs for treating these viruses’ infections, we create a new approach for developing common or shared drugs that may work for several different viral species of flaviviruses. It is based on the conserved RNA-dependent RNA polymerase (RdRp), which is the key enzyme for viral replication. We built up a common structure of RdRps (POLcon) from their consensus sequence. Bacterial vesicles hold immense potential in various biomedical fields. Among these, outer membrane vesicles (OMVs) produced by Gram-negative bacteria are the most extensively studied. While the exact mechanism of OMV production remains unclear, numerous environmental factors have been shown to influence both their yield and composition. In this study, we investigated the effect of three different antimicrobial families on OMV production by E. coli. Interestingly, antimicrobials within the same family did not provide the same effects on OMV yield, suggesting that OMV production may not directly correlate with the antimicrobial mechanism of action. Biorefineries play a vital role in reducing dependence on fossil fuels and addressing global warming concerns. Unfortunately, investment in biorefineries remains limited due to economic sustainability concerns. One approach to enhance the economic viability of biorefineries is by fully utilizing the potential of feedstocks, particularly lignocellulosic biomass, which is commonly used in these processes. Traditional processing methods often alter the lignin portion of biomass, making it unsuitable for further utilization. However, when retained in its native form, lignin can serve as a valuable source of chemicals that contribute to the economic sustainability of biorefineries.

Several technologies have been developed to produce hydrocarbon biofuels – renewable diesel (RD) and sustainable aviation fuel (SAF) – from fats, oils, and greases (FOG), with the hydroprocessing of esters and fatty acids (HEFA) representing one of the most mature pathways. In its current form, HEFA is mainly reliant on the hydrodeoxygenation (HDO) reaction, which has several drawbacks since HDO requires large amounts and pressures of hydrogen, feedstocks of high purity and cost, as well as problematic sulfided catalysts that risk contaminating the biofuel product with sulfur. Lignin is a complex aromatic biopolymer and an important constituent in plant cell walls. The process of lignin biosynthesis, known as lignification, is poorly understood and challenging to study but has important implications in a variety of fields including sustainable energy, bioengineering, and materials science and is therefore of interest to pursue. In the final stage of lignification, H-, G-, and S-monolignols are oxidized by laccase and peroxidase enzymes to generate radical species that couple to form dimers and further oligomeric species to ultimately produce the lignin polymer. BACKGROUND One third of organ donors suffer catastrophic brain injury (CBI). There are no standard guidelines for the management of traumatic CBI prior to brain death, and not all trauma centers have institutional CBI guidelines. In addition, there is high variability in management between institutions with guidelines. Catastrophic brain injury guidelines vary and may include various combinations of hormone therapy, vasopressors, fluid resuscitation, and other practices. We hypothesized that centers with CBI guidelines have higher organ donation rates than those without. Background: Primary graft dysfunction (PGD) contributes substantially to both short- and long-term mortality after lung transplantation, but the mechanisms that lead to PGD are not well understood. Exposure to ambient air pollutants is associated with adverse events during waitlisting for lung transplantation and chronic lung allograft dysfunction, but its association with PGD has not been studied. We hypothesized that long-term exposure of the lung donor and recipient to high levels of ambient air pollutants would increase the risk of PGD in lung transplant recipients. The power to revoke one’s will by physical act was enshrined in Anglo-American law in 1677 by the Statute of Frauds. It remains the law in Great Britain, in such developed Commonwealth countries as Canada, Australia, and New Zealand, and in each of the United States of America. Yet revocation by physical act creates numerous perplexities in the law, is badly out of phase with the law governing non-probate transfers, has become increasingly anomalous within the law of wills itself, and is in need of reform.

When the Vietnam War ended in 1975, Southeast Asia arrived at its most stable condition since the close of World War II. In Indochina, international communism triumphed over Western democracy. However, regional peace was fleeting and tenuous. Disparate communist ideologies and combustible, extra-regional power designs soon clashed. American retrenchment emboldened the Soviet Union and China, two competing communist forces, to fill the power vacuum and inflame the enmity unfolding between their respective client states: Vietnam and Cambodia. Legged robots are well-suited for navigating uneven and unmapped terrain, making them valuable in various robotics applications. Maintaining balance and stability in such environments relies on a combination of sensors, control strategies, and mechanical design. However, selecting the most effective sensing and control method for a given use case remains challenging. Dynamical sampling is an area of mathematics which studies the theory and applications of signals evolving through time, as well as the stable recovery of said signals from spatiotemporal measurements. This manuscript is devoted to problems which arise as theoretical considerations in signal recovery and as applications of using space-time measurements as opposed to static measurements.
For the former, we consider the problem of recovering an evolving signal via space-time measurements at irregular time intervals. To do so, we generalize the classic Kadec $1/4$ theorem using techniques of Banach $L^1(\R)$-modules. For the latter, we show how dynamical samples can be …

This thesis explores how Generation Z college students at Northern Illinois University (NIU) understand, negotiate, and express academic expectations and experiences, particularly concerning their sense of academic entitlement. Drawing from semi-structured interviews with 20 full-time undergraduate students across diverse academic disciplines, this qualitative study employed Braun and Clarke’s (2006) six-phase thematic analysis approach to identify patterns in students’ perspectives on grades, effort, and faculty relationships. The findings reveal detailed tensions between students’ desire for recognition of effort and their awareness of institutional standards of academic merit. Neural networks have become central to modern natural science. One of the key components of these networks is the choice of a suitable activation function. In this manuscript, we explore the selection of an optimal activation function in the context of complex-valued neural networks. We aim to characterize the activation functions $\sigma\colon \mathbb{C} \rightarrow \mathbb{C}$, where each neuron performs the operation $\mathbb{C}^N \rightarrow \mathbb{C}$, defined as: $z \mapsto \sigma(b + w^Tz)$. Childhood emotional abuse is a relatively common form of childhood maltreatment that has been associated with adverse impacts spanning numerous diagnostic categories. Maladaptive interpersonal processes appear to be implicated in the pathway from childhood emotional abuse to later psychopathology. Rejection sensitivity, in particular, has demonstrated a strong association with emotional abuse and appears to mediate the relationship between emotional abuse and depression. Incorporating themes from general mindfulness practices, the concept of mindful parenting teaches parents to bring present centered attention and awareness to their interaction with their child. For parents of all children, but especially children who may exhibit more challenging behaviors or attention deficit/hyperactive symptoms, the practice of mindful parenting may be especially useful. Using data collected from parents of children ages 5-8 (n = 179), results of the current study suggest significant positive associations between mindful parenting and supporting good behavior and limit setting, and a negative association with parental over-reactivity. This thesis examines and documents the tradition of Indigenous Custom Marriage (ICM) practiced in a semi-rural community in central Mexico. The arrival of Spaniards to Mesoamerica during the sixteenth century brought new forms of marriage to the region, those of the Christian religion and of the Spanish crown’s laws. While these new forms slowly gained acceptance, the traditional pre-Hispanic Mesoamerican form of getting married has endured over the intervening centuries up through the present. Workplace learning was profoundly impacted by the COVID-19 pandemic. One of the effects of the pandemic was the shift to work-from-home arrangements for eligible workers. It is anticipated that work-from-home arrangements will permanently remain above pre-COVID levels. Previous studies have identified the potential of using virtual reality (VR) for certain types of training, including workplace safety, soft skills, and virtual tours. Rise Or Retreat: The Role Of Appraisal And Goal Orientations In Leader Engagement, Haleigh Broucher

This dissertation examines how leaders psychologically interpret developmental challenges as threats or challenges, and how these interpretations shape engagement. Furthermore, I propose that these processes are shaped by mastery-approach and mastery avoidance orientations. Study 1 manipulated the presence of developmental challenges to test causal pathways. Results indicated that developmental challenges increased threat appraisal but not challenge appraisal, and threat was negatively associated with absorption. Study 2 found the opposite pattern: challenge appraisal, not threat appraisal, explained engagement. Relative importance analysis showed that challenge appraisal accounted for nearly all explained variance in engagement (97.6%). There was no significant moderation of mastery …
