Black English For Lawyers: A Primer, L. Alexander Walker Iii
Black English For Lawyers: A Primer, L. Alexander Walker Iii
Faculty Scholarship
Lawyers do not know as much about Black English as they should, and people’s freedom hangs in the balance. Differences between language varieties in sounds and grammar can change and have changed the outcome of cases: “He at work” and “He be at work” mean two completely different things. To reduce misinterpretation and therefore wrongful outcomes, this Article provides a primer on the sounds, words, grammar, and social context of Black English targeted directly at legal practitioners. It begins by explaining key concepts in linguistics and making the case for why lawyers must foreground accurate description over normative prescription when …

Watershed Land Use Decreases The Nitrogen Limitation Of Benthic Algal Growth In Coastal Wetlands Of A Large Oligotrophic Lake, Matthew J. Cooper, Michele C. Wheeler
Open Access Publishing Support Funded Articles
Introduction:
Identifying patterns in the primary limiting nutrients of basal trophic levels such as benthic algae can inform the prediction of potential ecological responses to anthropogenic nutrient loading. In coastal wetlands of the Laurentian Great Lakes, reduced concentrations of reactive nitrogen species such as ammonium and nitrate may limit algal growth, especially when nutrient loading is minimal. However, the response of benthic algae to macronutrient inputs remains understudied, especially in Lake Superior coastal wetlands.
Methods:
We conducted nutrient amendment assays using nutrient diffusing substrate devices in 25 coastal wetlands along the southwestern shore of Lake Superior in the spring, summer, …

Racial Powers, Talhah Mustafa
Racial Powers, Talhah Mustafa
Dissertations and Doctoral Documents, University of Nebraska-Lincoln, 2023–
This dissertation will be divided into three papers that in some way considers the concept of racial powers. The concept of racial power is under-researched and presupposed in the Philosophy of Race literature. Many arguments in this field seem premature without a general understanding of racial powers. The first paper fills that gap by introducing and defending the view that racial powers are possessed in virtue of one’s race or perceived race.
In the second paper, I consider Chike Jeffers’ cultural constructionist account of race. The nature of race is complex, requiring nuanced consideration. Chike Jeffers’ cultural constructionist may seem …
The Enlightenment In Early America, Annette Gordon-Reed
The Enlightenment In Early America, Annette Gordon-Reed
William & Mary Law Review
The founding of the United States of America is often said to have been the product of Enlightenment ideals that emphasized reason, individual liberty, and notions of progress. During this same era, however, racially based slavery, which confounded reason, denied individual liberty to millions, and challenged ideas about progress, existed in all of the colonies of North America.
The third president of the United States, Thomas Jefferson, embodied this seeming contradiction at the heart of the American founding. The principal author of the American Declaration of Independence enslaved hundreds of people over the course of his long life.

The Rise Of China And The Concept Of Civilization: Constructing A Conceptual Apparatus For Cross-Civilizational Comparisons, Liah Greenfeld
Comparative Civilizations Review
The Rise of China and the Concept of Civilization: Constructing a Conceptual Apparatus for Cross-Civilizational Comparisons
The paper examines the deficiencies of the current understanding of “civilization” in the social science literature, among others exemplified by “civilizational analysis,” and proposes a new concept that adds to the conceptual apparatus of sociological theory — a new, fully independent of others, variant of the cultural process. This independence makes distinctions between civilizations as the root cause of socio-cultural diversity.
Combined with the idea of humanity as a culturally constituted reality sui generis, this concept allows the construction of the theoretical scaffolding …

Examining The Role Of Executive Functioning In Self-Care Of Type 1 Diabetes Among Youth, Erin Vogel
Doctor of Psychology (PsyD)
This study explores the relationships between youth executive functioning, symptoms of depression, the self-management (self-care) of Type 1 diabetes (T1D), and glycemic control, a proxy for diabetes-related health outcomes. Utilizing archival clinical data from a universityaffiliated pediatric diabetes clinic, the study tested a priori hypothesized associations between depressive symptoms, executive functioning, diabetes self-care, and health outcomes. Parent and youth measures included the Patient Health Questionnaire-9 to assess youth depression, the Diabetes Related Executive Functioning Scale-Short Form to assess youth executive functioning, and the Diabetes Self-Management Profile-Short Form to assess youth diabetes-related self-care behaviors. Hemoglobin A1c (HbA1c) assays were a secondary …

Personalized antisense oligonucleotides (ASOs) have achieved positive results in the treatment of rare genetic disease. As clinical sequencing technologies continue to advance, the ability to identify patients with rare disease harbouring pathogenic genetic variants amenable to this therapeutic strategy will probably improve. Here we describe a scalable platform for generating patient-derived cellular models and demonstrate that these personalized models can be used for preclinical evaluation of patient-specific ASOs. We describe protocols for delivery of ASOs to patient-derived organoid models and confirm reversal of disease-associated phenotypes in cardiac organoids derived from a patient with Duchenne muscular dystrophy (DMD) with a structural …

Purpose
Single passive limb movement (sPLM) of the lower extremity is a simple and clinically relevant measure of the microvascular vasodilatory response to movement. A promising stimulus to improve microvascular health is ischemic conditioning (IC). We examined whether a single session of IC could improve microvascular reactivity to sPLM in young adults.
Methods
This was a blinded, crossover, randomized clinical trial. Participants were seated in an isokinetic dynamometer that passively moved the knee 90° at a frequency of 1 Hz while superficial femoral artery leg blood flow (LBF) was measured. The absolute and the relative peak changes in LBF were …

To generate evidence to address food system challenges, we developed an adaptable framework for multimodel assessment of the convergence effect of health and environmental drivers in food systems. We achieved this goal by developing a modeling framework that facilitates testing and applying four deep-learning algorithms using a case study of the United States's food system. Among the models tested, the bidirectional and single-layer long short-term memory models outperformed the others with αE(2.75) and αH(3.51) when predicting environmental drivers and health drivers, respectively. All the models tested performed better at predicting environmental than health drivers. The best-performing …

Current phototherapeutic approaches in cancer treatment include photothermal (PTT) and photodynamic (PDT) therapy, which harness light energy for the activation of a photoactive molecule resulting in the destruction of cancer cells. In PTT, generated local heat kills abnormal cells; whereas, in PDT, a series of biochemical reactions generating reactive oxygen species is responsible for cellular damage. However, a major concern arises in the cellular delivery of an optimal amount of a photoactive molecule required for the desired effect. In this work, we employed IR-820, a new Indocyanine green dye, in a liposomal formulation to maximize its delivery to cancer cells …
Litigating Predator Management, John A. Erwin
Litigating Predator Management, John A. Erwin
Utah Law Review
Despite significant gains over the last half-century, predators such as mountain lions, wolves, and bears are in the crosshairs once again. Scientific management, democratic principles, and the holding of wildlife resources in trust for the public are all foundational pillars of the North American Model for Wildlife Conservation, yet state wildlife agencies and legislatures routinely fail to uphold these values where predators are concerned. Many of these tensions were thrust into the public consciousness in 2020 when gray wolves were temporarily delisted under the Endangered Species Act (ESA), resulting in a disastrous wolf hunting season in Wisconsin. States that have …

Economic Impact Of Energy Accounting Schemes For Commercial Systems On A Broiler Farm With Power Demand And Generation, Yi Liang, Michael Popp
Biological and Agricultural Engineering Faculty Publications and Presentations
The aim of this study was to assess the impact of the on-farm solar photovoltaic (PV) generation to offset grid electricity consumption on a commercial poultry farm in the US. Hourly electricity production by PV systems was estimated using the System Advisor Model (SAM) of the National Renewable Energy Lab (NREL) and compared with the estimated electric load demand of a broiler house. We analyzed the economic benefits of installing solar systems of three capacities under net energy metering and net energy billing pricing scenarios. Results suggested that a smaller PV installation of 35 kWp, while substantially short of meeting …
Assessing Vegetation Changes And Ecosystem Impacts Of Invasive Species In Florida's Water Conservation Area 3a (2004–2024) Using Landsat Data, Gideon Tandoh
Research, Papers & Creative Work
The spread of invasive species is a concrete problem, threatening biodiversity, ecosystem integrity, and the functional status of wetlands. As these species continue to advance, it is crucial to assess their spread as well as management success through the more sophisticated invasive monitoring methodologies. This research examines the change in vegetation communities and the spread of invasive plants in the Water Conservation Area 3A (WCA-3A) using Object-Based Image Analysis (OBIA) and Support Vector Machine (SVM) classifiers on time series Landsat images. Unlike traditional pixel-based methods, OBIA enhances classification accuracy by incorporating spatial, spectral, and contextual information, enabling precise differentiation between …

Objective: Perfluoropropane droplets (PD) are nanometer-sized particles that can be formulated from commercially available contrast agents. The preferential retention of PDs in diseased microvascular beds can be detected by ultrasound imaging techniques after acoustic activation and offers an opportunity for the detection of such processes as scar formation or inflammation. We hypothesized that in the presence of ischemia/reperfusion (I/R) injury, retention of intravenously injected PDs would be enhanced. Methods: Using an established intravital microscopy model of rat cremaster microcirculation, we determined the retention and subsequent acoustic activation behavior of PDs in exteriorized rat cremaster tissue. DiI-labeled droplets (200 µL) were …

Off-target neuronal injury is a serious side-effect observed in cancer survivors. It has previously been shown that pediatric acute lymphoblastic leukemia (ALL) survivors have a decline in neurocognition compared to healthy age-matched counterparts. Elevated oxidative stress has been documented to be a mediator in off-target tissue damage in cancer survivors. Early detection of oxidative stress markers may provide an opportunity to prevent off-target tissue damage. Extracellular vesicles (EVs) have surfaced as a potential diagnostic tool due to molecular cargo they contain. We investigated the potential for EVs to be a sensitive indicator of oxidative stress and off-target tissue damage by …

Analysis Of 26 Studies Of The Impact Of Coconut Oil On Lipid Parameters: Beyond Total And Ldl Cholesterol, Mary T. Newport, Fabian M. Dayrit

Coconut oil (CNO) is often characterized as an “artery-clogging fat” because it is a predominantly saturated fat that ostensibly raises total cholesterol (TChol) and LDL cholesterol (LDL-C). Whereas previous analyses assessed CNO based on the relative effects on lipid parameters against other fats and oils, this analysis focuses on the effects of CNO itself. Here, we review the literature on CNO and analyze 984 lipid profile data sets from 26 CNO studies conducted over the past 40 years. This analysis shows considerable heterogeneity among CNO studies regarding participant selection, the amount consumed, and the study duration. The analysis reveals that, …

BACKGROUND: The opioid epidemic is a serious crisis in the United States. It has been proposed that opioid prescriptions after dental procedures are a major contributor to opioid use and abuse. The American Dental Association has been working to educate dental care providers about safe opioid prescribing practices. The authors hypothesized that oral and maxillofacial surgeons, following the efforts and publications from the American Dental Association, have been prescribing fewer postoperative opioids.
METHODS: This was a multi-institutional retrospective study with a total of 3,710 patients from Loma Linda University and University of Texas Health Science Center at Houston undergoing ambulatory …

Silver Tsunami Or Silver Rush? Extracting Value From Elders, Andrew Milne
Silver Tsunami Or Silver Rush? Extracting Value From Elders, Andrew Milne
Suffolk University Law School Faculty Works
I examine how the United States finances elder care, arguing that the legal processes structuring elder care tend to widen economic inequality and divide the interests of lower-income people against each other along generational, gendered, and racialized lines. I begin with two case narratives drawn from my practice experience as a poverty lawyer for older adults. One narrative involves an elder homeowner, while the other involves an elder renter. Both face crises of unmet care needs, the threat of homelessness, and ultimately the outcome that many older people dread most: institutionalization in a nursing home. I use these narratives as …

Obesity increases the risk of respiratory diseases that reduce respiratory chemosensitivity, such as Obesity Hypoventilation Syndrome and sleep apnea. Recent evidence suggests that obesity-related changes in the brain, including alterations in melanocortin signaling via the melanocortin-4 receptor (MC4R), may underly altered chemosensitivity. Setmelanotide, an MC4R agonist, causes weight loss in both humans and animal models. However, it is unknown the extent to which setmelanotide affects respiratory chemosensitivity independent of body weight loss. The present study uses diet-induced obese, male C57bl/6 J mice to determine the extent to which acute setmelanotide treatment affects the hypercapnic ventilatory response (HCVR). We find that …

Testing the extent to which ecological communities are structured by deterministic (niche-based) assembly processes, resulting in predictable species abundance and composition, is a fundamental goal of ecology. Here we use a 10-year dataset of 55,156 lianas comprising 86 species in an old-growth tropical forest in Panama to test whether community assembly is consistent with niche-based assembly processes. We find that species diversity and community composition was maintained because species conformed to four general requirements of coexistence theory: (1) species have negative conspecific frequency-dependent feedback that control their local population size; (2) species have a stronger negative effect on their own …
