An Investigation Into The Effects Of Preservatives On Ss-Hydroxybutyrate Concentrations Measured By Commercial Ketone Meter And Gas Chromatography-Mass Spectrometry, Kerry F. Murr
All ETDs from UAB
Ketoacidosis occurs when fatty acids are metabolized into ketone bodies in the liver and released into the bloodstream. This condition, which can be fatal, is commonly observed in diabetics, alcoholics, and individuals who experienced starvation or hypothermia. Although the ketone ß-hydroxybutyrate (BHB) is an accepted biomarker of ketoacidosis, the effects of preservatives on BHB concentrations in postmortem blood are unaddressed. The first aim of this research was to determine whether preservatives affect ketone levels as measured by a point-of-care device. Paired preserved and unpreserved blood samples were obtained from the Jefferson County morgue: preserved samples in grey top tubes and …

From Unprepared To On Track: Closing The Kindergarten Readiness Gap By Using A Team-Based Approach To Implement A Multi-Tiered System Of Supports (Mtss) Framework With Fidelity, Erica Filipiak
Theses and Dissertations
We live in a world where preschool and even kindergarten are optional years in schooling, only perpetuating the problem of incoming kindergartener students systemically lacking foundational skills necessary to successfully begin their academic careers. Access to quality preschool is an equity problem that needs to be discussed and researched. Preparing a student to enter kindergarten with the appropriate foundational academic skills does not just set them up for kindergarten success, but also for success in future grade levels. Therefore, a co-design team focused a problem of practice at an elementary school to provide the kindergarten teacher with additional support by …

Impact Of An Educational Workshop On Occupational Therapy Student Perceptions Of People With Justice System Involvement, Emily K. Simpson, Sara Engimann, Jamie N. Deal, Sydney M. Sabbagha, Lexi Frazier
Journal of Occupational Therapy Education
The United States has the highest number of people per capita in detention centers when compared to all other nations in the world. Stigma exists against people with justice system involvement, resulting in discrimination by healthcare providers and students and ultimately health inequities. This convergent mixed-methods study aimed to impact occupational therapy students’ (N=25) knowledge, attitudes, and beliefs about the criminal justice system and people with justice system involvement. The workshop included education, a panel of people with lived experience, and an occupational therapist with experiences in the criminal justice system. Significant changes were seen in the number of correct …
Trauma-Informed Care In Occupational Therapy Education, Cristina H. Scionti, Mary Shotwell, Donnamarie Krause
Trauma-Informed Care In Occupational Therapy Education, Cristina H. Scionti, Mary Shotwell, Donnamarie Krause
Journal of Occupational Therapy Education
Students bring their life histories, including traumatic experiences, to their learning and education. Potentially up to 75% of the student body of occupational therapy programs may have experienced a traumatic event, which often leads to occupational disruption and challenges in academic performance. Thus, it is critical for occupational therapy educators to mitigate the impact of trauma by identifying the barriers and facilitators to occupational participation in education for occupational therapy students affected by trauma. Despite the high prevalence of adverse childhood experiences (ACEs), research shows that few health professions education programs, such as occupational therapy, attend to ACEs or utilize …
Measuring The Rapidly Increasing Use Of Artificial Intelligence In Legal Scholarship, Michael Conklin, Christopher Houston
Measuring The Rapidly Increasing Use Of Artificial Intelligence In Legal Scholarship, Michael Conklin, Christopher Houston
St. Mary's Journal on Legal Malpractice & Ethics
The rapid advancement of artificial intelligence (AI) has had a profound impact on nearly every industry, including legal academia. As AI-driven tools like ChatGPT become more prevalent, they raise critical questions about authorship, academic integrity, and the evolving nature of legal writing. While AI offers promising benefits—such as improved efficiency in research, drafting, and analysis—it also presents ethical dilemmas related to originality, bias, and the potential homogenization of legal discourse.
One of the challenges in assessing AI’s influence on legal scholarship is the difficulty of identifying AI-generated content. Traditional plagiarism-detection methods are often inadequate, as AI does not merely copy …

On January 6, 2021, a mob of supporters of then-president Donald Trump stormed the U.S. Capitol Building to disrupt the certification by Congress of the presidential election. Joseph Fischer was a member of that mob, and he was one of the individuals who forced his way into the Capitol Building. He was charged with multiple criminal counts, including obstruction of an official proceeding, in violation of 18 U.S.C. § 1512(c) for allegedly attempting to delay Congress’ election certification. In Fischer v. United States, the United States Supreme Court reversed the obstruction charge, holding that section 1512(c) did not apply to …

Educational Sessions On Opioid Use Disorder In A Rural Community: A Faith-Based Approach, Tarrelle Reade
Doctor of Nursing Practice Projects
This scholarly project aimed to evaluate the effectiveness of a faith-based community education program regarding opioid use disorder (OUD) in a rural area of Person County, North Carolina. Through 4 weekly sessions hosted at Lattisville Grove Missionary Baptist Church, the program provided education on the signs and symptoms of opioid misuse, associated risks, available treatment options, support resources, and the use of Narcan. A pre- and post-survey design using a Likert scale measured changes in knowledge and confidence across five key domains. Data from participants (n = 54 total) showed statistically significant improvements in awareness and self-efficacy in most areas, …
Educator Equity And Pedagogy: Multilingual Learners In Rural Schools, Marsha R. Martin Kerr
Educator Equity And Pedagogy: Multilingual Learners In Rural Schools, Marsha R. Martin Kerr
Doctor of Education
This sequential explanatory mixed-method design study aims to understand and identify educator experiences and beliefs and how they affect equitable pedagogy with multilingual learners(MLLs) in rural K-12 public schools today. The research questions the significance of equitable pedagogy, systems, and resistances instructing MLLs to create dialogue supporting educator self-awareness, critical thinking, and collaboration while supporting diversity, equity, inclusion, and cultivating a positive school climate through multicultural education. The theoretical framework threads social learning theory through psychological mechanisms of observance and behavior from others, and social theory examines educational institutions through sociological perspectives and methodologies. These theories support teaching and learning …
Creating A General Psychology Curriculum That Embeds Humane Education, Kristina Marie Pham
Creating A General Psychology Curriculum That Embeds Humane Education, Kristina Marie Pham
Antioch University Dissertations & Theses
Academic freedom is under attack in the United States, hindering the ability of educators to develop critical thinking skills in students to prepare them for their roles as participating members of a democracy. The inquiry that informed the curriculum development is as follows: How to embed Humane Education and Participatory Action Research into a General Psychology class? The theoretical framework of Humane Education was the basis for utilizing the principles of Participatory Action Research in the General Psychology curriculum co-created with rural community college students. The Backward Design Model was chosen because the curriculum was created using an existing General …

Informed by relational-cultural theory and polyvagal theory, the research employs a grounded theory methodology to investigate the potential development of a somatic supervision framework. Eleven participants completed semi-structured interviews and data were analyzed using both thematic analysis and grounded theory techniques. Eleven core themes emerged: (a) conceptualizations of somatic supervision, (b) integration of somatic techniques in supervisory practice, (c) theoretical foundations for somatic supervision, (d) attunement to countertransference, (e) the supervisory relationship, (f) trauma-informed approaches, (g) somatic techniques and practices, (h) initiating and structuring somatic …
Ai Artists On The Stand: Bias Against Artificial Intelligence-Generated Works In Copyright Law, W. Michael Schuster, Joseph J. Avery
Ai Artists On The Stand: Bias Against Artificial Intelligence-Generated Works In Copyright Law, W. Michael Schuster, Joseph J. Avery
Scholarly Works
Generative artificial intelligence (AI) is revolutionizing the creation of art, literature, and music, challenging the boundaries of intellectual property law. To date, scholars have primarily focused on AI's authorship/entity status and the regulation of its use, overshadowing a critical issue: how AI's involvement in creative processes influences legal judgments in copyright disputes. Our empirical research reveals systemic bias against AI-generated works in such legal matters. In our studies, participants read about a company that had hired either a human designer (condition one) or a generative AI art system (condition two) to produce works of art, and those works of art …
Law School Veterans Clinics: Helping Veterans, Training Students, Improving The System, Alexander W. Scherr
Law School Veterans Clinics: Helping Veterans, Training Students, Improving The System, Alexander W. Scherr
Scholarly Works
This essay makes the case for law schools to create clinics and externship courses that address the needs of veterans. Veterans legal work offers excellent opportunities to represent individual veterans to obtain the benefits they earned through service to our country. At the same time, veterans clinic work can enlist students in systemic advocacy that changes how institutions address veterans' needs through appellate, administrative, and class action advocacy. Law students who work in veterans clinics develop skills they can readily transfer to other practice areas while working closely with clients and developing their professional identities. Finally, veterans clinics help law …
Values-Ambiguous Clinics, Willow Tracy
Values-Ambiguous Clinics, Willow Tracy
Scholarly Works
As law school clinical programs have grown in recent decades, many of the newer offerings focus on business law, entrepreneurship, intellectualproperty, and technology. It is commonly presumed that social justice values, such as the amelioration ofpoverty or theprotection offundamental rights, are notfoundational goals of these non-traditional clinics. This Article calls these clinics "values-ambiguous" to highlight the frequent uncertainty and skepticism about their relationship to traditional clinical social justice values. Importantly, "values-ambiguous"does not describe a quality of the clinic itself it describes a quality ofperception of the clinic. In other words, "values-ambiguous clinics" are clinics that are typically not perceived as …
Disrupting Public Defense: A Transitions Theory Approach, Matt Bender
Disrupting Public Defense: A Transitions Theory Approach, Matt Bender
Lewis & Clark Law Review
Public defense problems are well known, but a solution has been elusive. This Article analyzes public defense’s adaptive features using the Multi-Level Perspective (MLP) for the first time. The MLP is a theoretical framework that is often employed to study institutional and societal barriers to innovative ideas, like climate change responses and clean energy transitions. This Article describes the MLP’s theoretical model and uses it to examine why public defense reform consistently fails.
This Article then goes beyond the MLP framework to explore how transition management tools can be used to design and nurture new approaches to public defense. I …
Carceral Bonds, Tyler E. Dougherty
Carceral Bonds, Tyler E. Dougherty
Lewis & Clark Law Review
Over the past 50 years, the U.S. financed a massive physical and fiscal expansion of prisons via the municipal bond market—with devastating results. This project is the first to shine a light on the role of municipal debt in state-level carceral decision making, spotlighting the ways that the municipal bond market affects states’ capacities to incarcerate.
This Article argues that the two primary controls of states’ use of the carceral bond market—(1) market discipline and (2) states’ fiscal constitutions—are particularly ineffective at limiting states’ spending on prisons. This failure to restrain states’ spending through the carceral bond market enables private …
Legal Framework For Counterintelligence Activities In Ukraine, Viktor Tyshchuk
Legal Framework For Counterintelligence Activities In Ukraine, Viktor Tyshchuk
Journal of Strategic Security
The legal framework governing counterintelligence activities in Ukraine is one of the key elements in ensuring national security and protecting state interests, particularly in the context of modern challenges, as this article analyzes the current legislation and normative acts regulating the activities of counterintelligence agencies while evaluating their impact on the effectiveness of combating potential threats; a notable aspect is the change in the criminogenic situation, specifically the increase in crimes against the foundations of national security in 2022, which coincided with the onset of a full-scale invasion and significantly affected the investigative process due to difficulties associated with martial …
Evaluating The Reporting And Safety Culture Of An Airline According To Patankar And Sabin's Safety Culture Pyramid, Seda Mumlu Karanfil
Evaluating The Reporting And Safety Culture Of An Airline According To Patankar And Sabin's Safety Culture Pyramid, Seda Mumlu Karanfil
International Journal of Aviation, Aeronautics, and Aerospace
As a result of the literature review, it is seen that the safety management system in airline businesses is mostly evaluated with Reason's just culture model. The fact that there is no research examining Patankar and Sabin's (2010) safety culture pyramid on airline operations, except for a study conducted in the field of ground handling services (Poçar, Işık, & Durmaz, 2022), constitutes the importance and unique value of the research. As stated by Poçar et al. (2022), Patankar and Sabin's (2010) safety culture pyramid is not sufficiently included in practice, and this model is important in terms of drawing attention …

Setting The Stage For Success: Readiness And Connectedness As Antecedents Of Learning Continuance Intention In Online Learning, Yingqi Tang, Hungwei Tseng, Yu-Chun Kuo, Hsin-Te Yeh, Jianfang Liu
Research, Publications & Creative Work
Through a hierarchical multiple regression analysis, this study investigated how dimensions of online learning readiness and online connectedness influence students’ intentions to continue to take online courses. Data from 369 students who took at least one online course at a four-year public university showed that online learning readiness had a stronger relationship with continuance intention than online student connectedness, while online learning readiness had a significant correlation with online student connectedness. Online learning readiness and connectedness were indicators of online learning persistence. Factors such as age, computer/internet self-efficacy, self-directed learning, learner control, and facilitation influence students' intention to continue with …
An Empirical Exploration Of A Jury Veto, Stephen E. Henderson, Vanessa A. Edkins, Matthew L. Jensen
An Empirical Exploration Of A Jury Veto, Stephen E. Henderson, Vanessa A. Edkins, Matthew L. Jensen
Faculty Articles
Among the many contemporary dissatisfactions with American criminal justice are longstanding concerns relating to the scarcity of jury trials and the resulting lack of democratic oversight and control in the adjudicative process. A novel solution has recently been proposed in the form of a ‘jury veto’: perhaps a jury could be empaneled, prototypically if not exclusively by defense request, that would be empowered to select between the judicially-imposed sentence and a prosecutorial and defense alternative. We conduct the first empirical exploration of such a structure and find reason to believe it could lessen the disconnect between the American framing vision …
Zorro: Everyperson's Moral Vigilante, Stephen E. Henderson
Zorro: Everyperson's Moral Vigilante, Stephen E. Henderson
Faculty Articles
Zorro (Amazon 2024) is hundreds of years in the making—from medieval ballads of Robin Hood; to the fiction of Alexandre Dumas, Baroness Orczy, and the legend of Mexican bandits; to the Johnston McCulley 1919 original; to comics like Daredevil and Batman; to scores of Zorro derivatives from the minds of McCulley, Walt Disney, and many others. At this point, it would be impossible to identify and duly credit the countless inspirations that together form this early-California vigilante. But such rich heritage might provide something more than literature and entertainment: if there is an everyperson’s conception of a moral vigilante, Zorro …

In Defense Of Pardons, Stephen E. Henderson
In Defense Of Pardons, Stephen E. Henderson
Faculty Articles
Pardons by the past two U.S. presidents—one Democratic and one Republican—have caused some to question the wisdom of executive clemency. American criminal justice is imperfect, such critics of course recognize, but here the cure might be worse than the disease. If pardons have become the playthings of would-be monarchs and tyrants, perhaps it is time to let them go. As a strong proponent of role-reversible criminal justice, I am sympathetic to this view—even in mercy, why is the decision of the single elite supplanting the will of the people? Still, I write in pardons’ defense. Not only are pardons an …
High Crimes In Low Airspace: The Rise Of Drones In Cross-Border Drug Trafficking, Hannah Haight
High Crimes In Low Airspace: The Rise Of Drones In Cross-Border Drug Trafficking, Hannah Haight
Journal of Air Law and Commerce
Can the United States effectively regulate its airspace when criminal actors exploit it without entering traditional territorial channels? Mexican drug trafficking organizations increasingly deploy drones to deliver narcotics across the U.S.–Mexico border. These flights often occur at low altitudes, at night, and in remote areas, which renders them nearly undetectable by conventional enforcement methods. Yet, no statute squarely addresses the use of drones in cross-border drug trafficking. The Federal Aviation Administration (FAA) regulates drones under the FAA Modernization and Reform Act of 2012, but its mandate is safety, not interdiction. The result? A growing technological asymmetry: criminal cartels innovate, while …
The Lived Experiences Of Millennial Black Women Employed By Predominantly White Organizations: An Interpretative Phenomenological Exploration Of Identity Shifting, Natasha Ross
Human Resource Development Theses and Dissertations
Identity shifting is “the intentional process of altering one’s behavior and language based on feelings of exclusion, expectations, and perceptions from others” (Dickens et al., 2018, p. 5). Previous identity shifting research shows that many have used it as a coping mechanism to escape racial and/or gender discrimination or a tool for success. However, there are negative consequences, such as poor mental health, that questions the necessity of using this. Millennial Black women were used as participants because they would offer unique experiences since they experience being at the intersection of being Black, female, and being born within the same …
