Playing Politics With Traffic Fines: Sheriff Elections And Political Cycles In Traffic Fines Revenue, Min Su, Christian Buerger
Playing Politics With Traffic Fines: Sheriff Elections And Political Cycles In Traffic Fines Revenue, Min Su, Christian Buerger
Faculty Publications
The political budget cycle theory has extensively documented how politicians manipulate policies during election years to gain an electoral advantage. This paper focuses on county sheriffs, crucial but often neglected local officials, and investigates their opportunistic political behavior during elections. Using a panel data set covering 57 California county governments over four election cycles, we find compelling evidence of traffic enforcement policy manipulation by county sheriffs during election years. Specifically, a county's per capita traffic fines revenue is 9% lower in the election than in nonelection years. The magnitude of the political cycle intensifies when an election is competitive. Our …

It Is Our Flaws That Make Us Humane: How Technology Ruined Judicial Craft, Shai Dothan, Gregor Maučec
SMU Science and Technology Law Review
There is ample evidence that people are not completely rational. They suffer from a series of biases that limit their abilities to make the best decisions and to stick to them. Judges are a unique group of people. They go through many years of training that counter some of these biases, but not all of them. In fact, there is a whole field of research dedicated to predicting how judges, with their human flaws, are going to behave. But today, judges can use an increasing number of artificial intelligence (AI) tools to assist with their craft, particularly with research and …

Unwarranted Warrants? An Empirical Analysis Of Judicial Review In Search And Seizure, Miguel De Figueiredo, Brett Hashimoto, Dane Thorley
Faculty Articles and Papers
Every year, police perform searches governed by the Fourth Amendment on hundreds of thousands of individuals and their property throughout the United States. Many of the academy’s most decorated scholars have focused on the genesis and jurisprudential nature of the Fourth Amendment’s warrant requirement. Surprisingly, we know almost nothing about how the Fourth Amendment regulates searchers and how searches actually work in practice.
In this Article, we pull back the curtain on the search and seizure process by presenting the largest quantitative study of warrants of any kind. We analyze over 33,000 warrant applications filed through Utah’s “e-warrants” system over …
Kill ‘Em With Lies: The False Narrative Of The American Execution Laboratory, Danica Howell
Kill ‘Em With Lies: The False Narrative Of The American Execution Laboratory, Danica Howell
Saint Louis University Law Journal
The Supreme Court’s narrative regarding capital punishment, in keeping with the laboratories of democracy theory, boasts the consistent development of more humane methods of execution. Contrary to the Court’s narrative, however, states are not driven by the desire to create humane execution; they are merely striving to keep state-sanctioned killing alive. Examination reveals that execution methods are adopted on best guess and are retained without post-adoption verification of their effectiveness, humanity or painlessness. As abolitionist ideals close in on capital punishment, legislative shortcuts, willful ignorance, and secrecy allow new methods to propagate. As those tactics begin to fail, states resort …

Although the overrepresentation of men, specifically Black men and men of color, in the criminal legal system is well documented, the people who support these men, especially women, have garnered less attention. Women who are proximate to system-involved men—mothers, grandmothers, sisters, daughters, girlfriends, and wives—are invisible actors in the criminal legal system who perform critical tasks and provide essential support. They appear in court to demonstrate a person’s family and community ties, use their assets as collateral for bail, deposit money in commissary accounts, maintain social ties during imprisonment through letters and visits, and bear the burden of filling the …
Improving Hemoglobin A1c Levels In A Fqhc: A Quality Improvement Project, Laura E. Mason
Improving Hemoglobin A1c Levels In A Fqhc: A Quality Improvement Project, Laura E. Mason
DNP Projects
Significance and Background
Incarcerated individuals have a higher incidence of type 2 diabetes (T2D) than the general population and face unique challenges in managing their condition. These include limited access to nutritious food, disruptions in the healthcare continuity, and socioeconomic barriers such as unstable housing and unemployment. Upon release these challenges can compromise glycemic control.
The Transitions Clinic Model supports formerly incarcerated individuals in managing chronic conditions, including T2D during their reintegration. Continuous Glucose Monitors (CGM) have been shown to improve glycemic control and self-efficacy, leading to reductions in Hemoglobin A1c (HbA1c) levels. This project aimed to implement a CGM …

Parental Incarceration, Family Punishment, Hatim Husainy
Research Days Posters 2025
The United States of America has the second-highest incarceration rate in the world, with almost two million people behind bars. Of the incarcerated people in this country, more than half are parents. When the state imprisons a parent, what happens to their children? This project will examine the effects of parental incarceration on children and what can be done to remedy these effects. Effects of parental incarceration range from an increased likelihood of suspension and lower academic achievement to an increased likelihood of obesity and asthma. Despite this, the issue receives little attention, and significant changes have not been made …
From Asylums To Prisons: The Impact Of Deinstitutionalization On Mentally Ill Individuals In New York, Jillian Leifer
From Asylums To Prisons: The Impact Of Deinstitutionalization On Mentally Ill Individuals In New York, Jillian Leifer
Research Days Posters 2025
How has deinstitutionalization impacted mentally ill inmates in New York? How has the shift from institutional mental health care to alternatives like therapy and medicinal drugs affected incarceration rates among individuals with severe mental illness? Has deinstitutionalization led to transinstitutionalization, moving individuals from mental facilities to prisons? Though mental healthcare has undergone significant changes, access to adequate treatment remains limited, especially for low-income individuals. To explore these questions, this study examines the history of mental health policy, deinstitutionalization, and incarceration trends in New York. It also analyzes census data and scholarly literature to assess the relationship between mental health care …

Unveiling The Reid Technique: How Coercive Interrogation Tactics Fail To Protect Juveniles, Sofia Kalaitzis
Research Days Posters 2025
The United States’ failure to ratify the Conventions on the Rights of the Child (CRC) points to inadequacies in the criminal justice system. This omission reflects a broader failure: the criminal justice system is unable to adequately protect children, particularly regarding the protections against self-incrimination. The Reid Technique, a psychological interrogation method used by police, elicits confessions through a series of manipulative tactics and demonstrates unethical exploitation at the hands of the criminal justice system, undermining the justice system and revealing a failure to protect child rights in accordance with the CRC and Fifth and Eighth Amendments. The legal, psychological, …

Incarcerated Youths In Canada And The United States: A Comparative Analysis, Grace Mastrangelo
Research Days Posters 2025
Are children who commit adult crimes deserving of adult punishments? According to the United Nations, not if it harms their well-being. The U.N.’s primary treaty on children’s rights states that the Convention on the Rights of the Child (CRC), all state actions, and government institutions involving children must prioritize children’s well-being, safety, health, and protection. Only one U.N. member state, out of 196, has not ratified the CRC: the United States. This is reflected in the U.S.’s juvenile justice system, which has been criticized since the 1980s for harsh sentencing and the incarceration of children in adult facilities. In contrast, …

Stuck Behind Bars: How The Neglect For The Mental Illness Epidemic In U.S. Correctional Facilities Fuels Recidivism, Alayna Bhatti
Research Days Posters 2025
Correctional institutions are failing to fulfill their responsibility for creating an environment that minimizes the suffering that mentally ill inmates face due to their condition. Various studies show that current health services in U.S. prisons fall far below the standards of adequate care. The criminalization of mental illness since the 1990s has continued to violate the “cruel and unusual” clause of the Eighth Amendment along with various United Nations General Assembly resolutions. This research will prove that U.S. correctional facilities are not providing inmates with adequate services, preventing rehabilitation and increasing recidivism. Regardless of how severe a crime, incarcerated people …

Incarcerated individuals exist in a space where security and privacy constantly clash. This study examines how surveillance technologies—biometric monitoring, video surveillance, and electronic tracking— in correctional settings impact the privacy rights of those incarcerated. Through a review of peer-reviewed literature, and insights from informal conversations with incarcerated individuals at Broome County Jail, this research examines the ethical, legal, and social implications of surveillance in carceral facilities, focusing on how constant monitoring impacts privacy, relationships, and mental well-being. Expanding beyond jails, the study considers surveillance in state and federal prisons, evaluating its implications under the United Nations International Covenant on Civil …
Ethical Considerations Of True-Crime Entertainment On Victims’ Loved Ones, Jordan Ori
Ethical Considerations Of True-Crime Entertainment On Victims’ Loved Ones, Jordan Ori
Research Days Posters 2025
True-crime has become one of contemporary American media's most popular entertainment genres. This paper examines the reasons behind our public fascination with true-crime and its implications, specifically regarding how it impacts victims’ loved ones. Through a critical analysis of three key forms of true-crime entertainment—dark tourism, film, and podcasts—this research will explore the ethical concerns surrounding the portrayal of crime-related tragedies as entertainment. While existing scholarship often dismisses the genre as inherently problematic, this mindset is unrealistic and unproductive. Instead, this paper advocates reforming its current structure and fostering a more socially responsible and ethical approach. Moreover, to reduce harm …
Rehabilitation Over Punishment: United States Federal Prisons, John Edom
Rehabilitation Over Punishment: United States Federal Prisons, John Edom
Research Days Posters 2025
This project will analyze how United States federal prisons are places where punishment is prioritized over rehabilitation and the distinction between abuse and discipline are blurred. This issue can be traced back to the 1980s, with the passage of the Comprehensive Crime Control Act (CCCA) which prioritized punitive measures over rehabilitation and contributed to a sharp rise in incarceration rates. The discretionary power of prisons is far too entrenched. The Supreme Court’s rulings in Turner v. Safley (1987), Overton v. Bazzetta (2003), and Wilkins v. Gaddy (2010) reinforce this discretion by justifying abuse under the guise of discipline. This project …

The Uptake Puzzle In Expungement Of Criminal Records, Jessica Steinberg, Elenore Wade
The Uptake Puzzle In Expungement Of Criminal Records, Jessica Steinberg, Elenore Wade
Indiana Law Journal
Expungement has an uptake problem. A recent explosion of state-level rights allows people with felony convictions to expunge their criminal record, but only one to six percent of eligible people avail themselves of the remedy. Expungement is a powerful policy tool that promotes social and economic reintegration. It also serves a dignitary purpose, allowing people with criminal records to unshackle themselves from past mistakes. One might assume people would rush to court to clear their records. That the opposite is occurring—and new laws are idling on the books—suggests that rights-creation in this space has not been efficacious. This demands a …

The History Of Policing And The Impact On Minority Communities: The Case Against Police Abolition, F. Lee Francis
MC Law Review
This article critically examines the implications of former FBI Director James Comey’s assertions regarding the rise in violent crime and the phenomenon known as “The Ferguson Effect,” which posits that law enforcement officers are increasingly hesitant to engage in proactive policing due to fear of public backlash and viral scrutiny. Comey’s comments, made in a 2015 speech, sparked significant debate about the psychological impact of heightened scrutiny on police behavior and the potential consequences for public safety.
Through a multi-part analysis, the article first traces the historical development of policing in ancient civilizations and its evolution in the United States …

Beyond Policy: Overcoming Challenges In Prosecuting Gender Persecution At The International Criminal Court, Milena Sterio, Yvonne Dutton
Law Faculty Articles and Essays
While the ICC’s jurisdictional and resource constraints undoubtedly pose significant obstacles to its ability to tackle all cases of gender persecution worldwide, the Court’s efforts serve as a catalyst for progress in the field of international criminal law. By shining a spotlight on the crime of gender persecution and prioritizing its investigation and prosecution, the ICC sets a precedent for national jurisdictions to follow suit. Furthermore, the ICC’s engagement with gender-based crimes underscores the unique intersectionality of gender discrimination and conflict, highlighting the broader societal ramifications of such crimes, and the imperative to address them comprehensively.

The Grass Is Not Always Greener: How The Legalization Of Recreational Cannabis Across The United States Is At Odds With Incarceration And Continued Punishment, Marc Sendra
Washington and Lee Journal of Civil Rights and Social Justice
Whether you call it Mary Jane, skunky funky, green, ganja, reefer, or just plain-old cannabis, this special green plant doused in purple and orange accents has become a popular topic of discussion within the legal community and American culture. Cannabis has been held in “high” regard for its scientific advances in the medical industry, alongside its recreational usage, enjoyed by laughs and giggles, munchies, and plenty of water, leading to a wave of medical and recreational legalization.
Incentives for legalization come at the onset of promising medical research, economic growth motives, and social justice, reflecting upon a comprehensive approach that …
