An Analysis Of New York’S Drug Policies: Comparing The Effectiveness Of Punitive Punishment Versus Rehabilitation In Preventing Recidivism, Zed Agarwal

Student Publications & Research

The persistent failure of punitive drug policies, exemplified by the Rockefeller Drug Laws, necessitates a critical re-examination of how society addresses drug offenses. For decades, New York State has been at the forefront of both the implementation of harsh drug sentencing laws and the subsequent development of innovative rehabilitation alternatives. The trajectory of this policy evolution reveals a profound shift in understanding the nature of addiction and the most effective approaches to reducing drug-related crime. When New York enacted the Rockefeller Drug Laws in 1973, they represented the epitome of punitive drug policy by imposing mandatory minimum sentences of fifteen …

Innocence And Habeas Corpus: A Call For Equitable Reforms, Paige Skousen Nelson Apr 2025

Innocence And Habeas Corpus: A Call For Equitable Reforms, Paige Skousen Nelson

BYU Law Review

Congress intended the Anti-Terrorism and Effective Death Penalty Act of 1996 (AEDPA) to codify the Burger and Rehnquist Courts’ habeas corpus jurisprudence, which aimed to establish finality and innocence as gatekeepers to the “Great Writ.” But in practice, AEDPA hinders innocence claims, particularly claims of legal innocence.

This Note agrees that innocence should be one of the most important considerations in granting writs but argues that it is not as valued as Congress intended. This Note proposes two congressional reforms to reinstate innocence to its paramount role without compromising finality: first, amending the federal habeas petition rule to allow petitioners …

Deputized To Discriminate: The Dangerous Revival Of Ice “Task Force” Agreements, Yuwen Huyan Apr 2025

Deputized To Discriminate: The Dangerous Revival Of Ice “Task Force” Agreements, Yuwen Huyan

Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog

Section 287(g) of the Immigration and Nationality Act, first implemented in 1996, authorizes local and state law enforcement agencies to enter into formal agreements with U.S. Immigration and Customs Enforcement (“ICE”).  These agreements, known as Memoranda of Agreements (“MOAs”), deputize selected officers to perform certain federal immigration enforcement functions.  There are two enforcement models: the jail enforcement model, in which officers identify individuals for ICE after an arrest, and the more controversial task force model, which allows officers to initiate immigration enforcement in the field—during traffic stops, patrols, or other community interactions. Once trained and certified by ICE, local officers …

The Success Of The Clinton, Bush, And Trump Administrations In Securitizing Mexican And Central American Immigration Through Border Policies, Madeline Lynch

The Compass

U.S. political discourse has framed immigration from Mexico and Central America as a security threat, driven by political, economic, and racial motivations. American presidential administrations are able to further racialize and criminalize immigrants coming from the Global South through rhetoric in legislation and executive orders that frame migration as a national security issue. Administrations focus on this narrative to indicate that the security threat is harmful to the interests of Americans. Although few migrants do present security threats to the US, the rhetoric used by various presidential administrations generalize these populations as a political tactic to further control and militarize …

The Effects Of Artificial Intelligence On Trial Courts, Alexys Zellner

Honors Projects

Artificial Intelligence has quickly entered the realm of everyday life. Without extensive testing, there have been issues surrounding transparency, accountability, and biased decisions made by Artificial Intelligence decision-making algorithms. When a political institution—such as the courts—uses these types of tools, there is a chance that the negative attributes will impact the institutions and actors using them. The court system relies on legitimacy and public approval to enforce its laws and decisions. This study aimed to determine whether the use of Artificial Intelligence would lead to a decrease in public approval and legitimacy of the courts, as well as diminish perceptions …

The Impact Of Corruption On Lebanon's Governmental Institutions And The Connection To Terrorism, Joseph Mansour Apr 2025

The Impact Of Corruption On Lebanon's Governmental Institutions And The Connection To Terrorism, Joseph Mansour

Harriet L Wilkes Honors College Theses 2020 - Present

This thesis explores how systemic corruption in Lebanon, deeply rooted in sectarian power structures and elite dominance, has eroded governance, exacerbated socioeconomic inequalities, and created vulnerabilities conducive to terrorism. Applying Dennis F. Thompson’s institutional theory of corruption alongside Seamus Miller’s normative and causal frameworks, I analyze how resource mismanagement, elite capture, and governance failures have degraded public trust and diminished state capacity. Drawing on empirical case studies—including the Beirut Port explosion, the failure of Electricité du Liban, and the manipulation of foreign aid—I demonstrate how corruption has weakened institutional legitimacy and contributed to national insecurity. The study concludes by advocating …

This thesis advances interference management by developing advanced techniques for interference prediction, monitoring, and control in dynamic spectrum …

To Follow The Rule Or Not To Follow The Rue, That Is The Question, Beatrice Lovato Apr 2025

To Follow The Rule Or Not To Follow The Rue, That Is The Question, Beatrice Lovato

Academic Festival

This paper explores the ethical dilemma of whether it is more ethical to obey the law or to resist laws that are morally questionable. To examine this issue, I draw a parallel between two historical and contemporary examples: Nazi officers during World War II who implemented genocidal policies, and modern-day ICE officers involved in the detention and deportation of undocumented immigrants. By analyzing the motivations, mindsets, and personal responsibility of individuals who enforce state policies, this essay questions the moral agency of those who "just follow orders." It considers the psychological and ethical consequences of such actions, and challenges readers …
