Standing, Randall S. Abate
Standing, Randall S. Abate
GW Law Faculty Publications & Other Works
Chapter 4 explores the intricacies of the legal principle of standing, its role in climate litigation, and how it impacts the ability of parties to bring climate change-related lawsuits to trial. The author discusses interpretations of standing across different jurisdictions, such as the United States, New Zealand, and countries in Europe, and explains how these interpretations can either impede or facilitate climate litigation. He distils emerging best practice from this analysis, providing an insightful guide for future climate lawsuits. The author then identifies emerging best practice in interpreting standing rules in a flexible manner, thus allowing a broader range of …
The Uptake Puzzle In Expungement Of Criminal Records, Jessica K. Steinberg, Elenore Wade
The Uptake Puzzle In Expungement Of Criminal Records, Jessica K. Steinberg, Elenore Wade
GW Law Faculty Publications & Other Works
Expungement has an uptake problem. A recent explosion of state-level rights allows people with felony convictions to expunge their criminal record, but only 1 to 6 percent of eligible people avail themselves of the remedy. Expungement is a powerful policy tool that promotes social and economic reintegration. It also serves a dignitary purpose, allowing people with criminal records to unshackle themselves from past mistakes. One might assume people would rush to court to clear their records. That the opposite is occurring—and new laws are idling on the books—suggests that rights-creation in this space has not been efficacious. This demands a …
Whose Burden Is It Anyway? A Comprehensive Proposal To Reshape Food Safety Review By Treating Food As Medicine, Katya S. Cronin
Whose Burden Is It Anyway? A Comprehensive Proposal To Reshape Food Safety Review By Treating Food As Medicine, Katya S. Cronin
GW Law Faculty Publications & Other Works
With more than sixty percent of U.S. adults struggling with at least one diet-related health condition, the relationship between nutrition and public health has never been clearer. Indeed, for the first time in over a century, food has a prominent place on the national political stage and is one of the exceedingly few issues that has garnered bipartisan support. The recent rise in popularity of "Food Is Medicine" initiatives, which seek to provide medically tailored or healthy meals to vulnerable populations, underscores the critical importance of food to public health. Yet, while "Food Is Medicine" is shifting the insurance, business, …

A Call For Integration Of Trauma-Informed Care Into Occupational Therapy: Improving Provider Competency Through A Case Study Of A Cooking Skills Program For Survivors Of Human Trafficking, Natalie Pravinkumar
OT Doctoral Capstones
Trauma, such as abuse, neglect, and violence, has evident lasting physical and mental health effects, such as chronic illness, behavioral changes, and depression. While trauma-informed care (TIC) helps providers recognize and respond to trauma, this training is often limited to mental health and social work fields. Many survivor populations never receive interventions designed with TIC in mind, restricting outcomes leading to reduced rehabilitation and reintegration.
Occupational therapy (OT) is fundamentally client-centered and functional, making it well suited for TIC. However, while they cover many similar topics, most OT programs do not include specific curriculum on TIC.
TIC education in OT …

Using A Water Quality Index To Assess The Impacts Of Heavy Metals Contamination For Sustainable Water Management: A Case Study Of The Bang Pakong River, Thailand, Khin Yadana Soe, Pokchat Chutivisut, Wilailuk Niyommaneerat
Applied Environmental Research
Anthropogenic activities such as improper waste disposal, excessive fertilizer use, and industrial effluents cause heavy metal contamination in water, soil, and the atmosphere. Herein, the water quality index (WQI) was used to characterize heavy metal (i.e., cadmium (Cd), arsenic (As), and mercury (Hg)) contamination in the Bang Pakong River, Thailand. Specifically, water samples were collected during the dry season from four stations along the river from 2012–2022. The heavy metal concentrations in the samples were analyzed via atomic absorption spectrophotometry, and WQI values were calculated on the basis of standard water quality parameters. At the four sampling stations, high As …

Applied Environmental Research
The complex aromatic structures of synthetic dyes in contaminated water bodies make them difficult to degrade, posing a serious environmental challenge and representing a significant emerging pollutant that warrants urgent intervention. This study evaluated the biodegradation and detoxification potential of a halotolerant, marine-derived fungal strain, Penicillium oxalicum M6A, isolated from the Nigerian coastline, against Indigo carmine (IC) and Remazol Brilliant Blue R (RBBR). The effects of pH, temperature, salinity, and dye concentration on degradation efficiency, alongside enzymatic activity, were assessed. FTIR and GC‒MS analyses were employed to identify degradation products and predict metabolic pathways, whereas toxicity was evaluated in three …

Spatial Estimation Of Trophic State For Reservoir Using Ground Monitoring And Remote Sensing Data, Thong Nguyen Hoang, Van Tran Thi
Applied Environmental Research
Nutrient pollution, also known as eutrophication, is a severe environmental problem that leads to harmful algal blooms in water bodies and affects water supplies for human use. This study aims to determine the trophic state of the reservoir based on the trophic state index (TSI) calculated from ground monitoring data of Secchi depth (SD), total phosphorus (TP), and chlorophyll-a (Chl-a) obtained from 35 points in 2 survey periods during the late rainy season to early dry season 2012–2013 and May 2023. In addition, we combined remote sensing data to spatially estimate the eutrophication situation across the reservoir through correlation analysis …

U.S. Bison Industry: An Analysis Of Production, Health, And Market Dynamics, Morgan A. Young
Research Papers
The bison market has been becoming increasingly popular within recent years. However, this market is challenging for producers due to disease concerns, aggressive bison behaviors, nutritional and facility requirements and market risks for bison operations. Since most bison data began in 2020, forecasting bison meat prices remains difficult. This raises an important question: can bison meat cut prices be effectively hedged by using live cattle futures prices? This paper examines USDA bison meat cut price data and live cattle futures prices to determine potential correlations. A regression analysis, along with a dummy variable approach is utilized to evaluate the relationship. …
A Study Of Regulatory Compliance In U.S. Nursing Homes, Patrick Schumacher
A Study Of Regulatory Compliance In U.S. Nursing Homes, Patrick Schumacher
Electronic Theses & Dissertations (2024 - present)
The federal government is responsible for ensuring that nursing homes comply with regulations designed to protect residents from abuse, neglect, and substandard care. To this end, the Centers for Medicare and Medicaid Services (CMS) partners with states to conduct onsite inspections of nursing homes, during which regulators may identify violations. The agency can take one or more actions in response to violations, including imposing civil money penalties (fines), appointing a state monitor, or mandating remedial education for staff. Despite this regulatory framework, the quality of care in nursing homes remains poor, with many facilities failing to protect the well-being of …

Multimorbidity In Adolescents: The Longitudinal Impact Of Childhood Socioeconomic Trajectories And Health Risk In Adulthood, Savitha Sambandamoorthy
Electronic Theses & Dissertations (2024 - present)
Abstract
Background:
Multimorbidity, defined as the co-occurrence of two or more health conditions (physical, mental, or both), has been thought of as a disease of the elderly, with most studies of multimorbidity focusing on adults and the elderly population. However, co-occurring (multimorbid) health conditions are common in adolescence, and it is important to understand the profiles and patterns of multimorbidity during adolescence, a critical developmental period with long-term implications. Social determinants of health, especially lower socioeconomic status (SES), are linked to higher risk of multimorbidity and poor outcomes in adulthood. However, most of the past studies that have looked at …
Can Financial Inclusion-Based Interventions For Poverty Alleviation Build Sustainable Livelihoods? Voices From Mutual Solidarity Groups (Muso) In Haiti., Meera R. Bhat
Electronic Theses & Dissertations (2024 - present)
Scholars, policymakers, changemakers, and social workers have attempted to define, understand, and eradicate poverty. Its endurance raises the prospect that these efforts may be incomplete or faulty. This thesis will probe this concern by examining poverty and poverty alleviation programs through the lens of a holistic intervention-based framework known as the Sustainable Livelihoods Framework (SLF). The first paper introduces the SLF and uses it to undertake a conceptual analysis comparing demand and supply driven poverty alleviation interventions that are based on financial inclusion. Next it uses the SLF as a methodological tool to compare financial inclusion programs, as operationalized by …

Retrospective Recall Of Food Parenting Practices During Childhood, Current Adult Health Outcomes, And Intuitive Eating, Katelyn Bretzel
UNF Graduate Theses and Dissertations
Emerging adulthood is a time of exploration, change, and emerging independence, which can make individuals vulnerable to health changes. Previous research demonstrates that food parenting practices (coercive control, structure, and autonomy support) during childhood may relate to health outcomes into adulthood. In the current study, it was hypothesized that intuitive eating during emerging adulthood would be associated with food parenting practices; with coercive control and structure practices hindering intuitive eating, while autonomy support encourages it. The current study tested these relationships further, utilizing retrospective reports of food parenting practices during childhood and examining their relation to intuitive eating, dietary quality, …
Toxic Sweetness And Abstinence: The Citationality Of Robert Lustig's Anti-Sugar Rhetoric, Tyler J. Snelling
Toxic Sweetness And Abstinence: The Citationality Of Robert Lustig's Anti-Sugar Rhetoric, Tyler J. Snelling
Iowa Journal of Communication
Robert Lustig’s (2009) lecture on YouTube “Sugar: The Bitter Truth” animated a widespread conversation about whether sugar poisons bodies. Discourse following the lecture warrants analysis to gage how the meaning of the lecture transformed from a critique of food systems into individual actions. I argue that citationality of “Sugar: The Bitter Truth” fosters healthism by grounding sugar’s toxicity in scientific and affective reasoning that compels individual actions like abstinence from sugar. The pediatrician's lecture enabled the construction of a supposedly "moral eater" who removes sugar from consumption to avoid the poison's consequences. This paper offers tools for examining the spread …
Moldy Whoppers And Vitamin Donuts: Health Halos In Food Advertisements, Debbie Danowski
Moldy Whoppers And Vitamin Donuts: Health Halos In Food Advertisements, Debbie Danowski
Iowa Journal of Communication
Health Halos have been used in food advertisements since the late nineteenth and early twentieth centuries when the advent of mass-produced consumer goods took hold and manufactures began advertising their products. It wasn’t until nearly eight decades later, however, that theoretical framework specifically involving health halos was recognized in advertising research. Though subsequent research suggests the effectiveness of health halos in making unhealthy food appear healthier, there has been little, if any, attention given to identification of the health halos used in food advertising. This study aims to fill the gap by identifying two of the health halo techniques used …

Background: There is a linear correlation between piglet weaning weight and average daily gain during the post-nursery period. A key factor that influences piglet weight gain during lactation is milk intake. Thus, the variation in piglet weaning weight is hypothesized to be, to some extent, a result of differences in milk production among individual mammary glands. Objective: The objective of this study was to evaluate the impact of piglet nursing location throughout lactation on piglet weaning weight, with a secondary objective of determining the impact of piglet birth weight on nursing location selection. Methods: Teat pairs were labeled from anterior …

Transportation at weaning is an integral component of the American swine industry. However, the long-term effects on growth performance have not been well characterized. Previous research suggests transportation causes weight loss immediately following weaning, but few studies have followed this effect further than 7 d post-weaning, with transport causing decreased body weight in those that have. In experiment 1, average weight pigs at 20 ± 1.3 d of age were weaned and either 1) transported for 9 hour without feed and water (TR), 2) had their feed and water restricted for 9 hour (FR), or 3) were weaned and provided …
