What Lawyers Could Learn From The Corporate Practice Of Medicine, Melissa D. Mortazavi Jan 2025

What Lawyers Could Learn From The Corporate Practice Of Medicine, Melissa D. Mortazavi

Faculty Articles

Proponents of the United States’ domestic experiments in non-lawyer ownership (NLO) of legal practice justify them in terms of increasing “access to justice.” But what if opening ownership of legal practice to investment capital only exacerbates market failures (leading to further consolidation and increased costs to clients), while also compromising professional autonomy and fiduciary duty? The legal profession must be clear-eyed about who are the real winners and losers of such a shift and avoid being blinded by wishful thinking. Prominent legal scholars have repeatedly touted NLO as a solution to the access to justice crisis. However, there is scant …

As part of the legal profession’s tradition of self-regulation, attorneys have an ethical obligation to ensure that those within it are fit to practice. Given the gravity associated with accusing another lawyer of misconduct, it is not surprising that many are reticent to speak up. But what would happen if attorneys were pressured to vigorously pursue sanctions against their opponents, even if those sanctions may be unwarranted? President Trump’s recently-issued memorandum arguably does just that, mandating the Attorney General to seek court and disciplinary sanctions for lawyers and law firms that appear to violate ethics rules. This Essay explains how …

The First Amendment, Global Corporate Responsibility Standards, & The Quest For Online "Speech Nirvana", Evelyn Aswad

Faculty Articles

With large and powerful social media companies operating as worldwide speech regulators, it is unsurprising that governments have attempted to not only regulate how these companies address platform speech but also pressure them to deliver preferred speech outcomes. In 2024, the Supreme Court decided two cases addressing both themes in the U.S. context. In Moody v. NetChoice, the Court explained how legislation regulating private platform curation of usergenerated content runs afoul of First Amendment protections. And, in Murthy v. Missouri, the Court appeared to erect significant hurdles to challenging alleged governmental coercion of such platforms. These cases have left many …

Increasing Congressional Oversight Of Fisa Section 702 After Risaa, Noah C. Chauvin Jan 2025

Increasing Congressional Oversight Of Fisa Section 702 After Risaa, Noah C. Chauvin

Faculty Articles

In April of 2024, Congress passed the Reforming Intelligence and Securing America Act ("RISAA"). This bill reauthorized Section 702 of the Foreign Intelligence Surveillance Act ("FISA'), an important counterterrorism authority that was intended to make it easier for the government to spy on foreign terrorists but which has been repeatedly abused to spy on Americans. While RISAA enacted modest surveillance reforms, it also included substantial expansions of the government's spying powers. Moreover, it largely left intact the existing oversight regime for Section 702, which is deficient as a matter of law, policy, and fact.

This article assesses the extent to …

Zorro: Everyperson's Moral Vigilante, Stephen E. Henderson Jan 2025

Zorro: Everyperson's Moral Vigilante, Stephen E. Henderson

Faculty Articles

Zorro (Amazon 2024) is hundreds of years in the making—from medieval ballads of Robin Hood; to the fiction of Alexandre Dumas, Baroness Orczy, and the legend of Mexican bandits; to the Johnston McCulley 1919 original; to comics like Daredevil and Batman; to scores of Zorro derivatives from the minds of McCulley, Walt Disney, and many others. At this point, it would be impossible to identify and duly credit the countless inspirations that together form this early-California vigilante. But such rich heritage might provide something more than literature and entertainment: if there is an everyperson’s conception of a moral vigilante, Zorro …

The Economic Cost Of Exclusion: How Trump's Second-Term Immigration Policies Threaten California's Economy, Kit Johnson Jan 2025

The Economic Cost Of Exclusion: How Trump's Second-Term Immigration Policies Threaten California's Economy, Kit Johnson

Faculty Articles

The second Trump administration has pursued an array of immigration enforcement initiatives—from denaturalization and visa scrutiny to termination of humanitarian programs and aggressive workplace raids. Legal scholars have sharply debated these measures, but almost entirely through constitutional, statutory, and rights-based frames. This Article exposes a critical omission in immigration law scholarship: the economics of large-scale noncitizen removal. Drawing on major empirical studies of historic enforcement episodes—including Mexican repatriation between 1929-1934, Japanese internment during World War II, Arizona’s immigration restrictionism from 2007-2012, and federal immigration enforcement efforts of 2008-2015—this Article demonstrates that broad noncitizen removals may reduce the employment and wages …

Space Resource Development And Property - Clarifying Usufruct, Jeremy A. Kent Jan 2025

Space Resource Development And Property - Clarifying Usufruct, Jeremy A. Kent

Journal of Air Law and Commerce

This article examines competing legal frameworks for governing property rights in outer-space resources through a comparative analysis of two distinct approaches: the rule of capture and the concept of usufruct. The increasing interest in commercial space activities, such as mining the Moon and asteroids, has raised questions about the legal frameworks governing property rights in space resources. The growing challenge is that while the Outer Space Treaty (OST) serves as the foundation for space law, it does not explicitly address property rights in the resources humankind increasingly can extract from the space domain.

The rule of capture is a legal …

Dangers From Regulatory Vacuums In Outer, Inner, And Near Space, Rob Frieden Jan 2025

Dangers From Regulatory Vacuums In Outer, Inner, And Near Space, Rob Frieden

Journal of Air Law and Commerce

Space, “the final frontier,” has become an attractive but increasingly risky market for both public and private investments. Gold rush enthusiasm anticipates solutions to the digital divide via small low earth orbiting satellites, extraction of valuable minerals from asteroids, a vibrant space launch and tourism industry, and expanding earth observation opportunities. Such entrepreneurial boldness juxtaposes with a severe lag in government oversight, consumer safeguards, and essential operational guardrails. The ambitious plans of Elon Musk and other space entrepreneurs could fail—despite recent market success—as SpaceX’s plans for 148 rocket launches in 2024.

Without substantial refinement of global space treaties and effective …

WHO reports that burns account for more than 180,000 deaths annually with the majority of cases coming from low and middle-income countries due to limited resources in the management of burns. Currently, burns are being treated using silver sulphadiazine and gauze dressings, but this method has demonstrated to have some shortfalls. Alternative methods are being researched to find a better treatment modality with a faster healing duration. This case report describes the novel application of Chambo tilapia (Oreochromis lidole) fish skin xenograft in the treatment of partial thickness burns in a patient. The research was conducted on a 5-year-old female …

Faculty, Staff and Student Publications

Induced pluripotent stem cell (iPSC)-derived natural killer (NK) cells offer an opportunity for a standardized, off-the-shelf treatment with the potential to treat a wider population of acute myeloid leukaemia (AML) patients than the current standard of care. FT538 iPSC-NKs express a high-affinity, noncleavable CD16 to maximize antibody dependent cellular cytotoxicity, a CD38 knockout to improve metabolic fitness, and an IL-15/IL-15 receptor fusion preventing the need for cytokine administration, the main source of adverse effects in NK cell-based therapies. Here, we sought to evaluate the potential of FT538 iPSC-NKs as a therapy for AML through their effect on AML cell lines …

The Lived Experiences Of Millennial Black Women Employed By Predominantly White Organizations: An Interpretative Phenomenological Exploration Of Identity Shifting, Natasha Ross Jan 2025

The Lived Experiences Of Millennial Black Women Employed By Predominantly White Organizations: An Interpretative Phenomenological Exploration Of Identity Shifting, Natasha Ross

Human Resource Development Theses and Dissertations

Identity shifting is “the intentional process of altering one’s behavior and language based on feelings of exclusion, expectations, and perceptions from others” (Dickens et al., 2018, p. 5). Previous identity shifting research shows that many have used it as a coping mechanism to escape racial and/or gender discrimination or a tool for success. However, there are negative consequences, such as poor mental health, that questions the necessity of using this. Millennial Black women were used as participants because they would offer unique experiences since they experience being at the intersection of being Black, female, and being born within the same …

Policy Paper On Incorporating Migrant Children In A Strengthened Public Education System, Amira Abdelaziz, Dina Ibrahim, Dunia Zaatar

Papers, Posters, and Presentations

A transit, destination, and sending country, Egypt generously hosts more than one million refugees and asylum seekers (UNHCR, 2025), in addition to several migrants estimated at nine million in 2022 (IOM, 2022). Against this backdrop, the country is currently facing growing challenges in ensuring access to quality, inclusive, and equitable primary education for migrant and refugee children, particularly following the arrival of Sudanese nationals since April 2023, when the conflict in Sudan erupted. Egypt’s new Asylum Law No. 164 of 2024 grants de jure access to basic education for all refugee children until the age of 14, yet the law …

Computational Bridges: Enhancing Natural Language Processing Of Swahili., Joyce Murungi Jan 2025

Computational Bridges: Enhancing Natural Language Processing Of Swahili., Joyce Murungi

Harrisburg University Other Works

Swahili remains significantly underrepresented in natural language processing (NLP) despite being one of the most widely spoken languages in Africa. Computational Bridges: Enhancing Natural Language Processing of Swahili addresses this gap through computational linguistics, corpus creation, and large-scale analysis of Swahili syntax and lexical structure. Central to this study is GUMZO, a novel corpus developed from spontaneous conversational data collected from YouTube videos, television panel discussions, political speeches, religious discourse, and unscripted broadcasts. Unlike many existing datasets that rely on formal or translated text, GUMZO captures authentic language use and provides a stronger foundation for NLP research involving low-resource languages. …

A Power Dependence Model Of The Impact Of Leader Impostorism On Supervisor Support And Undermining: The Moderating Role Of Power Distance, Xueqi Wen, Zihan Liu, Feng Qiu, Keith Leavitt, Xingyu Wang, Ziyang Tang Jan 2025

A Power Dependence Model Of The Impact Of Leader Impostorism On Supervisor Support And Undermining: The Moderating Role Of Power Distance, Xueqi Wen, Zihan Liu, Feng Qiu, Keith Leavitt, Xingyu Wang, Ziyang Tang

Research Collection Lee Kong Chian School Of Business

Leaders, often perceived as possessing exceptional confidence and competence, are not immune to feelings of self-doubt. Leader impostorism describes the experience that one’s attributes, experiences, skills, and abilities fall short of the standards expected in the leadership role, resulting in a sense of deception in fulfilling leadership responsibilities. While existing research has examined the antecedents and individual outcomes of leader impostorism, its implications for leaders’ treatment of subordinates remain largely unexplored. In this research, we investigate the downstream consequences of leader impostorism on behaviors directed toward subordinates. Integrating research on leader impostorism with power dependence theory, we propose that for …

Preserving The Future: Recognizing Intergenerational Equity In United States Constitutional Jurisprudence In Light Of Evolving Climate Rights Litigation, Molly Morgan Jan 2025

Preserving The Future: Recognizing Intergenerational Equity In United States Constitutional Jurisprudence In Light Of Evolving Climate Rights Litigation, Molly Morgan

Cardozo Journal of Equal Rights & Social Justice

Climate rights litigation is an essential part of holding states accountable for their climate change obligations. This type of litigation has increased across the globe, and domestic and international courts have issued landmark rulings that serve as precedent for reinforcing state obligations and protecting constitutional and human rights in the process. One focus of these cases is intergenerational equity, which implicates the theory that inadequate state action on climate change violates the rights of future generations. This Article explores the evolution of this theory in domestic and international law, illustrating its increasing importance in climate rights litigation and the necessity …

Shining Light On Policy: The Case For Solar Panel Mandates On New Construction Projects, Emily Glazier Jan 2025

Shining Light On Policy: The Case For Solar Panel Mandates On New Construction Projects, Emily Glazier

Cardozo Journal of Equal Rights & Social Justice

The note argues that solar panel mandates on new construction projects are a necessary and sensible approach to reducing greenhouse gas emissions and achieving climate goals, but their implementation must include provisions to protect vulnerable communities and address environmental justice concerns. While such mandates face legal and political challenges, the benefits of decreased emissions and energy independence outweigh the costs, particularly when paired with measures like community solar systems, incentives, and exemptions.

The Effect Of Need For Cognition & Need For Affect On Human Reliance And Artificial Intelligence Interactions, Aliyah Mcgowan

Doctoral Dissertations and Master's Theses

Abstract

With the increased use of Artificial Intelligence (AI) automations in fields like medical diagnoses and mental health queries, there are concerns regarding an individual’s trust and reliance on the technology. Reliance on AI output may lead an individual to accept inaccurate or incorrect information without further analysis. Trust may influence reliance and trust formation may be a product of affective processing. This study investigated the relationship between Need for Affect (NFA), Need for Cognition (NFC), and trust and reliance on AI interactions. Participants were assessed on the NFA scale for willingness to approach or avoid emotional stimuli, the NFC …

Protection Of Male And Female Sexed Children From Genital Cutting: Making Sense Of Recent Legal Developments, J. Steven Svoboda

Cardozo Journal of Equal Rights & Social Justice

The article critically examines the disparate legal treatment of female genital cutting (FGC) and male genital cutting (MGC), arguing for a more consistent approach that recognizes both practices as violations of bodily integrity. It highlights the ethical and legal inconsistencies in how these practices are viewed and regulated, advocating for a unified legal framework that prioritizes consent and the rights of the individual.
