The Systematic Devaluation Of Legal Scholarship In Criminology And Criminal Justice, Henry F. Fradella Jan 2025

The Systematic Devaluation Of Legal Scholarship In Criminology And Criminal Justice, Henry F. Fradella

Touro Law Review

Certain bibliometrics have become important indicators of scholarly impact despite their many weaknesses. This Article presents data demonstrating the shortcomings of using citation counts and journal impact factors for law-based scholarship. Moreover, the Article argues that reliance on these flawed metrics is just one example of how scholars in criminology and criminal justice (“CCJ”) systematically devalue legal scholarship.

The Article begins by offering quotations from social scientists that provide insights into the negative ways they view legal scholars and their work. It also quotes from interviews conducted with CCJ scholars who hold a law degree and either earned or are …

Loopholes Of Liberty: The Supreme Court’S Evisceration Of The Fourth Amendment, David J. Looney Jan 2025

Loopholes Of Liberty: The Supreme Court’S Evisceration Of The Fourth Amendment, David J. Looney

Touro Law Review

The Fourth Amendment’s protections against unwarranted government intrusion are currently undermined by the Supreme Court’s third party and open fields doctrines, which permit warrantless access to shared data and private land beyond a home’s curtilage, clashing with the Amendment’s aim to safeguard privacy and property in an era of advanced surveillance. These doctrines enable arbitrary governmental overreach, necessitating urgent review to restore constitutional protections. Rooted in Enlightenment principles, the Fourth Amendment historically protected “papers” and “effects” from physical trespass, as seen in Boyd v. United States. Katz v. United States introduced a “reasonable expectation of privacy” test, but its subjective …

Evaluating Competitive Equality: The Department Of Education’S Regulations And Impact On Title Ix In Women’S Sports, Lola-Marie Pyros Jan 2025

Evaluating Competitive Equality: The Department Of Education’S Regulations And Impact On Title Ix In Women’S Sports, Lola-Marie Pyros

Touro Law Review

Title IX was enacted to guarantee women equal opportunities in athletics by preserving competitive fairness. That objective has been challenged by evolving policies on transgender participation in women’s sports. Proponents of inclusion frame the issue as a matter of civil rights, while opponents emphasize physiological differences between the sexes that remain even after medical transition. Shifting interpretations by the Department of Education, influenced by changes in presidential administrations, have created legal uncertainty, culminating in Tennessee v. Cardona, which rejected an expansive definition of “sex” to include gender identity. This Note argues that maintaining the integrity of women’s athletics requires recognition …

Celebrity Trademark Overload: The Rising Issue Of Excessive Registrations And Reverse Confusion, Lola-Marie Pyros Jan 2025

Celebrity Trademark Overload: The Rising Issue Of Excessive Registrations And Reverse Confusion, Lola-Marie Pyros

Touro Law Review

Celebrities use trademark law not only to protect their brands, but also to stake claims on a vast range of potential marks through intent to use (“ITU”) applications—often before any real commercial plan exists. This practice allows celebrities to reserve rights ranging from viral catchphrases to their children’s names which crowds the trademark register, delays legitimate filings by smaller businesses, and forces challengers into costly legal battles. A separate but equally troubling issue arises when a celebrity’s brand overshadows a preexisting weaker mark. In “reverse confusion” cases, courts often focus on whether the celebrity acted willfully, ignoring the fact that …

Psychology Faculty Research and Publications

Growing evidence over the last few decades has highlighted that punitive approaches in schools perpetuate violence, furthering inequities, deepening issues of safety, and negatively impacting young people’s development. These impacts are particularly felt in under-resourced urban schools situated in contexts of community violence. Partially, in response, an increasing number of schools and school districts are engaging in restorative practices. This trauma-informed, strengths-based framework focuses on relationships, healing, and accountability. This article contributes to the growing literature on the potential of restorative justice to promote equity in urban schools and educational systems by outlining the development and model of a restorative …

Testing The Waters: Expanding Chapter 9 Bankruptcy To Encourage Treatment Of Chemically Contaminated Drinking Water, Alexandra Zimmer

Emory Bankruptcy Developments Journal

Chemical contamination of drinking water supplies has become a significant issue across the globe with serious health and safety impacts. While the true extent of the impact is still being determined, costs associated with remediation efforts to clean up are astonishing. Municipalities, in particular cities, towns, and counties, suffer significant damages both through costs incurred directly for treatment of chemically contaminated drinking water supplies and through lost revenues resulting from municipal residents’ exposure.

This Comment argues Congress should expand municipal access to filing for bankruptcy under chapter 9 of the Bankruptcy Code to encourage local government efforts to clean up …

A Qualitative Study On The Cultural Adaptation Process Of Adventist Volunteers In Central Asia, Cecilia Nanni

Journal of Adventist Mission Studies

The cultural adaptation process for the volunteers who participated in this study follows, according to their own perceptions, a progressive sequence of five stages: Awe/Confusion, Denial, Observation, Integration, and Habituation. As shown, this process is not without difficulties and negative feelings such as confusion, discouragement, sadness, anger, and rejection, which are inherent to the processes of uprooting and cultural change. However, it is evident how experiences evolve as time passes, culminating in acceptance, learning, comfort, adjustment, and adaptation.

To Be Or Not To Be Controlled: The Making Of Thespians In Nineteenth-Century Asylums, Olivia Kurylo Jan 2025

To Be Or Not To Be Controlled: The Making Of Thespians In Nineteenth-Century Asylums, Olivia Kurylo

Williams Honors College, Honors Research Projects

Throughout the 1800s, superintendents of insane asylums incorporated the works of Shakespeare into their medical practices. Shakespearean plays became a conduit of power for the asylum superintendents, providing them with a literary model of sanity that they imposed on patients while simultaneously becoming a mode of communication for asylum patients to perform as ‘sane’ in accordance to the superintendents’ definitions. While the superintendents imposed a Shakespearean model of social normalcy onto the patients, the asylum patients used Shakespeare’s plays as a conduit for verbal expression. Essentially, asylums became Shakespearean plays as both the medical staff and the asylum patients employed …

In the era of generative AI, integrating video generation models into robotics opens new possibilities for the general-purpose robot agent. This letter introduces imitation learning with latent video planning (VILP). We propose a latent video diffusion model to generate predictive robot videos that adhere to temporal consistency to a good degree. Our method is able to generate highly time-aligned videos from multiple views, which is crucial for robot policy learning. Our video generation model is highly time-efficient. For example, it can generate videos from two distinct perspectives, each consisting of six frames with a resolution of 96 × 160 pixels, …

International Conference on Durability of Concrete Structures

The Beijing–Taipei Expressway (Jing-Tai Expressway) of China reconstruction and expansion project (Qihe–Jinan section) features a 12-lane dual carriageway with high traffic volume. To ensure safe winter operation, deicing salt is heavily applied, necessitating enhanced salt freeze–thaw resistance of roadside crash barriers. In this project, manufactured sand was used as the fine aggregate in structural concrete. A systematic investigation was conducted to evaluate the effects of stone powder content, air content, air-void spacing factor, and aggregate properties on concrete performance, including salt freeze–thaw resistance, rapid freeze–thaw durability, and compressive strength. The results revealed that non-air-entrained manufactured sand concrete exhibited extremely poor …
