California Public Defense Workloads And Staffing, Malia N. Brink, Pamela R. Metzger, Andrew L.B. Davies, Cynthia G. Lee

This report assesses the current workloads and staffing of California public defense providers. The report concludes that California’s public defense attorneys are almost universally burdened by workloads that far exceed nationally recommended standards. Additionally, compared to district attorneys’ offices in the same jurisdictions, public defender offices typically have 20-45% fewer attorneys.
This report also details how public defense providers in California also lack the appropriate support staff – investigators, social workers, paralegals, and administrative assistants – necessary to efficiently and effectively represent their clients. A criminal conviction can prohibit a noncitizen from accessing certain forms of relief from deportation in immigration court. Notably, certain convictions may bar a noncitizen from asylum. But what happens when that conviction is based on the manifestation of mental health disabilities? This Article is the first to explore and critique the current immigration law framework for accounting for the criminalization of a noncitizen’s mental health disability, focusing primarily on the Attorney General’s recent decision In re B-Z-R- and the missed opportunity it represents to ensure that criminalized, disabled noncitizens are still able to access justice in the form of …

Finding a space for reproductive rights within constitutions that are silent on them has been a perennial challenge. Most common responses fall into one of three categories. First, reading them into the right to privacy (or liberty). Second, and more recently, eschewing privacy and turning to the right to equality. And third, and most comprehensively, adding or combining privacy and equality. I argue that while rights addition avoids the need to choose between privacy and equality in framing reproductive rights, it falls short of capturing the intertwined lived reality of rights infringement. More than 53 million Americans are informal caregivers. These family members, friends, and acquaintances provide social, medical, transportation, and other support to individuals because of illness or disability without getting paid. Additionally, at least 2 million grandparents, not counting other kinship caregivers, provide care for children who cannot remain with their parents.1

Dentistry And The Law: We Forgot To Renew Our Employment Agreement —Now What?, Daniel Schulte Jd

This Q&A addresses the legal implications when a fixed-term dental employment agreement expires without formal renewal. MDA Legal Counsel explains that if the employee continues working under the same conditions, an oral employment agreement is implicitly formed, retaining the original terms but becoming terminable without cause by either party at any time. A key consequence is that any post-termination provisions, such as a covenant not to compete, begin their restricted period countdown from the original agreement's expiration date, regardless of continued employment. This dissertation has two chapters.In Chapter 1, I develop a model of international trade with innovation and trade surplus to examine the effects of China’s large trade surplus on productivity. I abstract from future benefits from holding a present trade surplus and focus on the present gains in productivity. I find that the average productivity increase caused by trade surplus ranges from 1.2 percentage points to 5.46 percentage points when the innovation cost changes. These results explain China’s long-term export promotion policies and align with its new policy goal of developing “new productivity forces”. I also identify a negative effect …

Over the last century, dams and diversions on the Colorado River have devastated the Colorado River Delta and the Sea of Cortez-a crisis exacerbated by climate change. While Minutes 319 and 323 of the 1944 Treaty between the United States and Mexico have achieved some success, they have failed to adequately protect or restore the ecosystem in the face of our changing climate. The research is clear: the Delta continues to be in serious trouble. As Minute 323's expiration rapidly approaches, negotiations regarding its successor are ongoing. The International Boundary and Water Commission (IBWC) has the power to ensure this …

The final Immigration and Customs Enforcement (“ICE”) detainees were released from the Irwin County Detention Center in early September 2021.2 A court did not order the end of ICE detention at Irwin. A social movement, led by people detained at Irwin, had a pronounced impact on the epistemological landscape and changed both normative principles and public opinion.3 Those detained at Irwin organized and acted to create new understanding of law and protect their rights in ways that courts and legislatures could not. The immunity against Crown liability was abolished in the United Kingdom in 1948 based on the Diceyan notion of rule of law and deemed equality under the law between public officials and private persons. This paper analyses government vicarious liability in respect of the acts and omissions of public officers under the Singapore Government Proceedings Act with reference to the concept of deemed equality. The International Council on Hotel, Restaurant & Institutional Education (ICHRIE), founded in 1946, has a long history, although in the 1970s the future of the association was in doubt. This manuscript documents the crisis that nearly derailed the association, and details how this dilemma was resolved. How Personality Shapes Workplace Incivility: A Theoretical View, Mazni Alias, Nor Shazleen Eshak, Chew Sze Cheah, Nur Farhana Lyana Ameruddin
International Journal of Management, Finance and Accounting
Workplace incivility, characterised by low-intensity, ambiguous behaviour such as disrespect, rudeness, and discourtesy, disrupts workplace harmony and erodes organisational culture. Although these behaviours may appear minor, their cumulative impact can significantly harm individuals and organisations, manifesting in decreased morale, productivity, and well-being. Personality traits play a crucial role in shaping how employees perceive, experience, and respond to workplace incivility, influencing its outcomes and associated costs. However, existing literature offers limited insights into how these personality differences exacerbate experiences of workplace incivility, leaving a critical gap in understanding this phenomenon. In this nonpayment case, the tenant's attorneys made an oral motion for a civil penalty under CPLR § 5020(c) against the landlord for failing to file a satisfaction of judgment within 20 days after receiving full payment. The court dismissed the application, holding that Housing Court, a special proceeding, lacks jurisdiction to hear this claim. The court reasoned that CPLR § 5020(c) specifies that such a penalty is "recoverable by the judgment debtor" in a separate plenary action, not within the confines of a summary proceeding.
