Dissell V. Trans World Airlines: Constitutional Limitations On The Workers' Compensation Commission's Subject-Matter Jurisdiction, Patricia A. Nelson-Reade

To rule upon a workers' compensation claim, the Maine Workers' Compensation Commission must determine that it has both personal and subject-matter jurisdiction. Personal jurisdiction is determined by applying Maine's "long-arm" statute. Subject-matter jurisdiction derives from the Commission's status as an administrative agency authorized to administer the Maine Workers' Compensation Act (MWCA). Although subject-matter determination generally involves a choice-of-law issue, in a workers' compensation claim having extraterritorial aspects, the Commission is not free to apply the compensation acts of other states that have contacts with the claim. Implied Warranties Of Seaworthiness: Applying The Knowing Neglect Standard In Time Hull Insurance Policies, Derek P. Langhauser

Time hull marine insurance policies provide insurance for a definite period against damage to or loss of a vessel. Even in cases in which a ship owner expressly warrants to an insurer that a vessel will be seaworthy when the policy takes effect, and unless the insurer waives all warranties, American admiralty law implies a warranty of seaworthiness as a condition of the contract. This implied warranty increases the insurer's chance of recovering his premium by mitigating his risk that the vessel will be damaged or lost. International Journal of Exercise Science 17(2): 1648-1662, 2024. Gravel cycling is a relatively new cycling discipline, with the Union Cycliste Internationale (UCI) hosting their first World Championships in 2022. Gravel races combine features of road racing, cyclocross, and mountain biking, including terrain of varying technical difficulty, long distances, substantial elevation gain, obstacles, and limited opportunities to stop for in-race nutrition. This study assessed hydration responses to gravel races of three different distances. Data were collected on saliva osmolarity (SOsm), body mass (BM), fluid intake, and nutrition knowledge at a gravel cycling race in April 2023. A total of 121 participants …

A Quantitative Examination Of The Role Of Relationship Status In Asexual College Students’ Sexual Victimization, Amanda Mollet, Wayne Black, Leslie Shelton

Journal of Queer and Trans Studies in Education

This exploratory quantitative study examines sexual violence among asexual college students using the Asexual Community Survey. We conducted analyses to examine the coercive tactics used by sexual violence perpetrators against asexual college students with a focus on examining statistical differences based on characteristics of students’ relationships. Findings revealed that across multiple forms of relationships, asexual college students’ relationship experiences were significantly correlated with experiencing higher levels of multiple types of sexual violence. The study challenges existing narratives of campus-based sexual violence while highlighting the unique and specific influences of power on sexual victimization within the context of asexual college students’ …

The interplay of cooperation and competition (“coopetition”) in supply chains is well studied. However, little is known about the established and evolving scenarios that exist among supply-chain actors in the presence of coopetition. The paper draws on the resource-based view and game-theoretic reasoning to develop an integrative framework with two aims. First, to classify coopetition-based scenarios with varying levels of complementarity and lastingness and to enhance the analysis of the scenarios. This paper studies the geopolitical riskwork practices employed by Western multinational enterprises (MNEs) in response to the Russian invasion of Ukraine, focusing specifically on divestment announcements. Using a discursive riskwork framework, the study analyses how Western MNEs articulate and legitimize their divestment decisions in a novel geopolitical context. The findings reveal that Western MNEs align their corporate actions with emerging liberal geopolitical norms and values, thereby rhetorically establishing their role as responsible geopolitical actors. Tensions between control and autonomy in multinational enterprises (MNEs) have attracted considerable academic interest, which has been additionally fuelled by multiple crises following the 2008 global recession. These have intensified the exploration of interentity relationships within MNEs and their implications for risk and crisis management and resilience. Change Is In The Minds Of The Beholders: A Sociocognitive Comparison Of Crisis Perceptions And Change Predictions: Insights From China, New Zealand, And Slovenia, Zhonghui Ding, Matevž Rašković

Inspired by research on the "geography of thought" within social psychology, we present a cross-cultural comparative study of sociocognitive patterns between China, New Zealand, and Slovenia. We study COVID-19 risk perceptions and also explore predictions of economic trends under four specific economic scenarios. Our results show that the East-versus-West demarcation in terms of cultural boundaries is useful but insufficient to understand culturally driven predictions of economic trends. In times of economic downturn, such as the one caused by the recent COVID-19 pandemic, there seem to be universal tendencies towards pessimism.
