Education and training can only account for so much of the longevity of someone’s career. Who you are and who you know matters in the development of self, mission and career pursuits. Establishing a personal identity can help you pursue the relationships that you wish to be defined by. The creation and maintenance of those authentic relationships and networks will impact your professional identity over time, as who you surround yourself with will be how you are perceived to others. This paper explores the aforementioned concepts by looking at the impact of intentionality of knowing one’s self, building meaningful relationships …

Instructional Leadership In Higher Education: Practicing Sound Leadership For Students And Instructors., Yassaman Raouf Dec 2024

Instructional Leadership In Higher Education: Practicing Sound Leadership For Students And Instructors., Yassaman Raouf

MAGIS: Student Development Journal

This paper addresses the historical, political, and social context of instructional leaders in higher education. Embedded within the framework of adult learning theories, I provide a unique lens to chief academic officers in their efforts to lead teams and promote learning. Too often academic leaders are overcome with administrative responsibilities, leaving them little room to improve learning for both faculty and students. This paper explores how leaders might navigate political, legal, and social landscapes while staying dedicated to student learning in an inclusive environment.

Burnout In Resident Assistants, Caroline Bubbers Dec 2024

Burnout In Resident Assistants, Caroline Bubbers

MAGIS: Student Development Journal

Alexander Astin’s (1999) theory of student involvement states that student time and energy are finite resources. Student leaders go beyond involvement and dedicate their time and energy towards creating experiences and opportunities for other students (Astin, 1999). Boundaries become hard to manage when students live and work in the same environment, such as with Resident Assistant (RA) positions. This study examines at the experiences of Resident Assistants and their relationship with burnout while in the RA position at a medium sized, private, Jesuit University in the Pacific Northwest. Through individual participant interviews the findings include that RAs face a significant …

Emotional Support Animals And University Housing: United States Of America V. University Of Nebraska At Kearney., Elisabeth Goss

MAGIS: Student Development Journal

As mental health issues such as anxiety and depression have become more prevalent on college campuses, requests for emotional support animals have also increased (Hoffman, 2015; Von Bergen, 2015). The case of United States v. University of Nebraska at Kearney has been recognized as establishing the foundational legal guidelines for how institutions should respond. This essay provides an overview of the case, discusses its implications for policy and practice, and examines its impact on students. For the purposes of this paper, emotional support animals are defined as any animal that provides “support, well-being, comfort, aid, or a calming influence through …

“The teacher is of course an artist, but being an artist does not mean that he or she can make the profile, can shape the students. What the educator does in teaching is to make it possible for the students to become themselves.” ― Paulo Freire (1991)

Baltic Journal of Health and Physical Activity

Introduction: In the literature, the effectiveness of the extracorporeal shock wave therapy (ESWT) in patients with heel spur was confirmed, but the therapy protocol has not been established when used as monotherapy. The aim of the study was to verify whether the frequency of ESWT and the number of sessions used as monotherapy in patients with heel spur have an impact on the final result of the therapy. Methods: 85 patients were divided into three subgroups. All patients were treated 5 times with different intervals between ESWT sessions, in the group I, ESWT was administered every day, in group II …

Cyr V. Michaud: Correction Of Clerical Errors With Juror Affidavits, William S. Kany Dec 2024

Cyr V. Michaud: Correction Of Clerical Errors With Juror Affidavits, William S. Kany

Maine Law Review

Cyr v. Michaud, a civil suit to recover for personal injuries, was tried before a jury and resulted in a verdict which included specific answers to five interrogatories. After a unanimous verdict for the plaintiff was entered and the jury was discharged, the defendant obtained affidavits from all of the jurors which indicated that the jury had made a mistake. The trial court rejected a motion to correct the error and the defendant appealed. The Maine Supreme Judicial Court, sitting as the Law Court, ruled that juror affidavits are not admissible to correct errors in the recording of verdicts. The …

Baybutt Construction Corp. V. Commercial Union Insurance Co.: A Question Of Ambiguity In Comprehensive General Liability Insurance Policies, Peter Alexander Meyer Dec 2024

Baybutt Construction Corp. V. Commercial Union Insurance Co.: A Question Of Ambiguity In Comprehensive General Liability Insurance Policies, Peter Alexander Meyer

Maine Law Review

A critical issue pervading the realm of commercial insurance contract law concerns the clarity of provisions contained in policy agreements. Insurance policies containing unclear or complicated language may give rise to situations in which the actual intentions of the contracting parties are not reflected in the technical terms of the policy. The parties' conflicting expectations often lead to costly litigation. In such cases, the Maine Supreme Judicial Court, sitting as the Law Court, has made it clear that it will ordinarily rule against the party who wrote the policy (the insurer) and in favor of the party whose expectations were …

Stacked Recovery Under Maine's Uninsured Motorists Statute: Connolly V. Royal Globe Insurance Company, Edward R. Benjamin Jr. Dec 2024

Stacked Recovery Under Maine's Uninsured Motorists Statute: Connolly V. Royal Globe Insurance Company, Edward R. Benjamin Jr.

Maine Law Review

Foremost among the problems of automobile travel facing state legislatures may be that of ensuring adequate compensation for injuries and deaths suffered in traffic accidents. Frequently an injured party wins an award of damages against a negligent motorist, only to find the negligent party unable to meet the financial burden which the judgment imposes. The injured party, though innocent of any wrongdoing, may receive little or no compensation for injuries suffered. State legislatures have attempted to prevent such situations by enacting mandatory liability insurance laws, creating victim compensation funds, or requiring uninsured motorist coverage. Inherent weaknesses exist, however, in both …

Proof Of Causation In A Private Action For Acid Rain Damage, Patrick J. Scully Dec 2024

Proof Of Causation In A Private Action For Acid Rain Damage, Patrick J. Scully

Maine Law Review

The acid rain problem has become one of the major environmental issues of our day. Each new report on the subject is more disturbing than the last, documenting serious and often irreversible effects of acid rain on lakes and streams, fish and other aquatic life, forests, soils, buildings, and even human health. Present federal legislation is inadequate to deal with acid rain effectively. Proposed legislation could help ameliorate the problem, but even if adopted the effects of such proposals will not be felt until early in the next century. Furthermore, the current administration, particularly the Environmental Protection Agency (EPA), has …

Aviation Law: Owner-Lessor Liability—The Need For Uniformity, Ann T. Hollyday Dec 2024

Aviation Law: Owner-Lessor Liability—The Need For Uniformity, Ann T. Hollyday

Maine Law Review

General aviation—aviation involving both private and business aircraft—is a substantial and growing industry which comprises a fleet of 211,000 planes. The number of general aviation aircraft is expected to increase to 300,000 by 1991. Moreover, there are over 760,000 private pilots in the United States. Because of the varying sources of aviation liability law among the states, there is a lack of uniformity regarding whether the owner-lessor will be held vicariously liable for the negligent acts of the pilot. The lack of uniformity concerning owner-lessor liability in the aviation context is problematic because the owner is unable to predict what …

Application Of The Federal Securities Acts To The Sale Of A Closely Held Corporation By Stock Transfer, Loftus C. Carson Ii Dec 2024

Application Of The Federal Securities Acts To The Sale Of A Closely Held Corporation By Stock Transfer, Loftus C. Carson Ii

Maine Law Review

The purchase and sale of a closely held corporation is a commonly occurring transaction which may be accomplished by a transfer of stock or a transfer of assets. Structuring such a transaction as a sale of stock, however, may offer certain advantages not attainable if the transaction is structured as a sale of assets. For example, non-assignable contracts and leases, not transferable with a sale of assets, may pass to the transferee of corporate stock. The transferor generally will be absolved of all of the enterprise's liabilities since, by law, they pass with the transfer. Transferors subject to compliance with …

The Parent-Child Privilege And The Parent-Child Crime: Observations On State V. Delong And In Re Agosto, Ellen Kandoian Dec 2024

The Parent-Child Privilege And The Parent-Child Crime: Observations On State V. Delong And In Re Agosto, Ellen Kandoian

Maine Law Review

Should a child be compelled to testify against his parent under threat of criminal punishment? Ignoring for a moment the applicable legal doctrines, there are several reasons why one might answer no. First, if we value the idea of family loyalty, and believe that loyalty of a child to his parent is particularly important for traditional, moral, and practical reasons, then measures taken by a state to undermine such loyalty must be viewed critically. Second, children tend to accumulate tremendous amounts of information about their parents' activities and are party or witness to many communications made by their parents with …

The Enduring Enigma Of Tom Bombadil: From Riddlic Styling To Metaphorical Encounter, Derek Simon Dec 2024

The Enduring Enigma Of Tom Bombadil: From Riddlic Styling To Metaphorical Encounter, Derek Simon

Journal of Tolkien Research

Conversationalists and critics alike continue to take delight in Tom Bombadil, yet remain perplexed by his enduring enigma. Interpretive positioning appears to be determined by the semantics of the term enigma deployed and how it intersects with any of the several textual standpoints adopted. The primary contention of this article is that the enigma is intentionally both a riddle (noun) and a riddling (verb). Reading the enigma through literary features of the Old English riddle-song can yield an alternate interpretation of Tom Bombadil that has received scant attention in critical commentary. In support of this contention, I propose to read …

Analysis Of The Longitudinal Effect Of Home Advantage In The Brazilian Football Championship – Série A, Werlayne Leite, Marcelo C. Zanetti Dec 2024

Analysis Of The Longitudinal Effect Of Home Advantage In The Brazilian Football Championship – Série A, Werlayne Leite, Marcelo C. Zanetti

Baltic Journal of Health and Physical Activity

Athletes and teams typically obtain an advantage when competing at home, a phenomenon known as home advantage (HA). This study investigates the longitudinal effect of HA in the Brazilian Football Championship (Série A) over 21 seasons, analyzing 8,405 matches from 2003 to 2023. The results showed that the average HA was 35.1 ± 7.7%, while the competitive balance (CB) was 0.838 ± 0.145. A negative, non-significant correlation (r = -0.321, p = 0.157) was found between HA and CB, with CB explaining 10.3% of HA variation in the Brazilian league. HA de-creased over time, likely due to improved logistics, …

This piece was adapted from a workshop that I presented at a department retreat in December 2014.

Graduation Rates Among Student-Athletes: Research To Practice, Alexa Forster Dec 2024

Graduation Rates Among Student-Athletes: Research To Practice, Alexa Forster

MAGIS: Student Development Journal

Student-athlete graduation rates and, in particular, graduation rates for African American male student-athletes are dismal compared to other student populations on college campuses. This text examines factors that have the potential to increase graduation rates among this population through a literature review. These factors include providing student-athletes a scholarship to the institution that they attend, as well as their engagement through career and other support services offered at colleges and universities. In addition, career development with student-athletes and peer mentorship are discussed as ways that a graduate student can intervene with student-athletes to improve the likelihood of obtaining an undergraduate …

First-Generation Spiritual Formation, Eden C. Tullis

MAGIS: Student Development Journal

This article examines the correlation between identifying with a specific faith, religion, or spirituality and being a first-generation college student at Seattle University (SU). The Office of Campus Ministry at SU was utilized to inform this research. At the end of this project’s duration, recommendations were given to the entire staff of Campus Ministry. The findings were also presented at NASPA’s Western Regional Conference in November 2014. For this particular research, “first-generation college student” was defined as someone whose guardians and/or siblings did not attend a four-year institution. It was even encompassing of students with guardians who may have went …

Accessible Services For Underserved Populations, Kjirsten Eisentrout, Alexa Forster, Amy Bergstrom Dec 2024

Accessible Services For Underserved Populations, Kjirsten Eisentrout, Alexa Forster, Amy Bergstrom

MAGIS: Student Development Journal

Many student services on college and university campuses cater to the needs of full time, residential students who are 18 to 24 years old and White. These services often do not address the needs of students who do not fit those demographics. This paper investigates what good practices institutions are using to better support traditionally underserved and underrepresented students. These practices include co-location, online services, and targeted programs. By implementing these practices, students are able to feel more integrated into the college environment, which research shows can help support persistence and retention.

Navigating The Student Affairs Profession, Rachel H. Betron

MAGIS: Student Development Journal

This article provides a reflection on an illustration designed to embody the author’s perception of the professional field of student development. The illustration, titled, “Navigating the Student Affairs Profession,” is a visual exploration of the competencies, skills, and challenges of the career field as defined by contemporary practitioners and researchers. The author explains that the geographical map of professional practices derives from the author’s Jesuit and social justice education in a Student Development Administration master’s program. The author also discusses how this visual representation of the profession allows other practitioners to become more cognizant of their own identities and experiences …
