On Thursday, September 26th, 2024, the Center for the Constitution and the Catholic Intellectual Tradition at The Catholic University of America hosted a conversation between Justice Brett M. Kavanaugh and Professor J. Joel Alicea. This was the inaugural event of the new Center. The conversation covered topics such as constitutional interpretation, the separation of powers, religious liberty, and the Catholic intellectual tradition. The Illusory Coverage Doctrine, if it ever becomes a true legal doctrine, has the potential to be an incredibly useful tool in insurance law. But courts around the country take very different approaches to the doctrine, ranging from one end of the spectrum—a hard-nosed “pro-insurer” stance where coverage is not illusory so long as a policy provides any coverage—to the other—a muscular “pro-policyholder” public policy approach that requires coverage even if some other exclusion might have prevented coverage under the applicable policy. The United States Supreme Court in United States v. Paramount and the subsequent Paramount Decrees in 1948 were the federal government’s original attempt to address the consolidation and concentration of the movie production, distribution, and exhibition markets. The government reversed its decision in 2020 because of both changes in the film industry and a change in the legal application of antitrust law. There are two schools of antitrust law thought: structuralism and the consumer welfare standard. The former is concerned with market concentration and supports the Paramount Decrees, and the latter is concerned with prices for consumers and is skeptical …

Copyright Law is supposed to encourage authors to create works of authorship, both factual and fictional. However, Copyright jurisprudence has developed to only protect expression, and not idea, to ensure the continued dissemination of knowledge. In solidifying this belief, two doctrines—Fair Use and the idea/expression dichotomy—allow for individuals to utilize other works of authorship without it being considered copyright infringement. The landscape of spatial biology research has transformed drastically in recent years allowing a comprehensive understanding of cellular organization and molecular mechanisms in various biological context. This thesis presents three complementary studies that advance our understanding of spatial organization in normal tissue biology and tumor evolution, utilizing cutting-edge spatial multi-omics approaches. The first study presents a comprehensive investigation of kidney sexual dimorphism across the lifespan, integrating six distinct technological platforms: single-nucleus transcriptomics, epigenomics, Visium spatial transcriptomics, Xenium single-cell resolution spatial transcriptomics, conventional immunofluorescence imaging, and co-detection by indexing (CODEX) multiplexed protein imaging. As global energy demands continue to rise amid increasing environmental concerns, the transition to renewable energy sources, particularly solar power, has become imperative. Solar energy, driven by recent advancements in photovoltaic (PV) technology, presents a promising solution for achieving greater sustainability and efficiency. However, despite these technological advancements, the persistent issue of soiling caused by dust, bird droppings, and other contaminants remains a major obstacle, diminishing sunlight absorption and reducing energy conversion efficiency, presenting a significant obstacle to optimal PV performance.

This dissertation proposes the viability of philosophical hermeneutics as a theoretical framework for communication studies. It has five chapters that each develop this argument. The first chapter provides an overview and justification for the dissertation along with a review of the historical development of philosophical hermeneutics. This provides a sense of general themes and the theoretical basis for philosophical hermeneutics. The second chapter sets out to expound on the viability of philosophical hermeneutics to inform communication research as a form of research praxis. This dissertation analyzes the Reproductive Justice Framework to describe possible solutions to the ethical challenges related to reproductive healthcare disparities. Various frameworks to support reproductive equity fail to address the challenges marginalized individuals face in accessing reproductive health services. The four ethical principles of autonomy, beneficence, nonmaleficence, and justice serve as foundational tools to support reducing these disparities. This dissertation uses the Reproductive Justice Framework to analyze the unequal distribution of harms among marginalized women. It highlights how access to care, such as Assisted Reproductive Technologies (ART), is disproportionately inaccessible to marginalized women. This qualitative inquiry utilized semi-structured interviews with eight expert forensic evaluators to explore their lived experiences engaging in psychosexual evaluations of sex offenders with a suspected diagnosis of autism. The purpose of this study was to identify current best practices, principles, and challenges faced by forensic evaluators when assessing sex offenders with a suspected diagnosis of autism. The results provide a variety of autism-specific screening tools and assessments used by forensic evaluators in their psychosexual evaluation process. This study investigates college ESL instructors' experiences in teaching online ESL courses. It explores the differences in teaching focus and online modes for teaching speaking, listening, reading, and writing courses. It also investigates how ESL instructors' perceived level of technology competence varies across different online teaching modes and examines how teaching and learner engagement strategies differ depending on the instructional modality. Key findings include the observation that both BICS and CALP were prevalent in online reading courses. Although no significant difference in technology competence between asynchronous and synchronous modes was found, it was shown that instructors used more synchronous modes …

The intrinsic chemistry of actinide elements, particularly uranium, remains a key challenge in understanding f-block reactivity due to the complexity introduced by solvent interactions, counter-ions, and complex equilibria in the condensed phase. In this dissertation, a systematic gas-phase study utilizing preparative tandem ion-trap mass spectrometry (PTMSⁿ) is presented, focusing on the reactivity of uranium-centered species, specifically [OUCH]⁺, an oxy uranium methylidyne species, and [UH]⁺ ions. By stripping away solvent effects and isolating the ions, PTMSⁿ provides a powerful platform to probe the fundamental chemical behavior of uranium species in their intrinsic state.

While medicine makes visible symptoms of disease, phenomenology provides a different tool for making illness experience visible. Phenomenology offers a tool for a new kind of description and a different kind of knowledge of disease. It holds a unique epistemic power through the descriptions it generates through the application of the transcendental phenomenological method. Husserl’s method, outlined in Ideas I, provides the steps for its implementation in clinical research. It is generally accepted by scholars of humor that humor requires an observer to take on a perspective of “critical distance” – or a perspective through which the observer can be critical of the target of humor. Consequently, work in the field is dominated by an assumption – whether implicit or explicit - that humor (and, especially, twentieth century American humor) necessitates that the observer disengages emotionally from the target of humor. In this dissertation, I examine Gilles Deleuze’s philosophy of time as presented in Difference and Repetition and use it to construct a concept of freedom, which is notably absent in his work. I argue that Deleuze’s exposition of the three syntheses of time provides significant insights for exploring the ontological possibility and structure of freedom. Through an analysis of his theory of the three syntheses of time, I investigate the meanings of agency, destiny, and choice within Deleuze's framework. I demonstrate that free choice necessitates both involuntary and creative action. Given the apparent tension between freedom and involuntariness, I explore …

Identifying adaptive mutations in genetic data is challenging due to the low frequency of occurrence of such events, and because signatures of selection are intertwined with the footprints of various other evolutionary forces that shape our genomes. Even when a larger region appears to be under selection, genomic sites that are linked to adaptive mutations have similar statistical signals, and thus can obfuscate the identification of the actual adaptive mutation. This study sought to explore the lived experiences of licensed counselors who experienced personal suicide loss and the impact of their loss on their professional lives. Of particular interest was the impact of the loss on countertransference, professional direction and choices, and self-disclosure with clients and other professionals in the field (e.g., supervisors, professors, and colleagues). The concept of the wounded healer, as described by Zerubavel and Wright (2012), served as the theoretical framework used to understand the participants’ stories. Nitrogen-containing heterocycles are ubiquitous in bioactive molecules, pharmaceutical drugs, and natural products. For this reason, finding new and efficient ways to make such compounds remains a high priority for the organic and medicinal community. Our current endeavors build upon previously established work by our group, where we generated 1,2-diamines by coupling commercially available aldehydes with trimethylamine N-oxide (TMAO) in two steps. This route proved to be effective in generating 20+ novel 1,2-diamines and imidazolidines with a demonstrated ability to undergo transformations.
