Promoting And Reforming Kenya’S Customary Justice Systems In Criminal Cases, Daniel S. Mcconkie Jr. Jan 2024

Promoting And Reforming Kenya’S Customary Justice Systems In Criminal Cases, Daniel S. Mcconkie Jr.

Emory International Law Review

Kenya’s indigenous customary justice systems developed over time to administer African justice rooted in local community harmony. British Colonialists imposed a foreign legal system, and Kenya formally retained that system even after gaining independence in 1963. Nevertheless, ordinary Kenyans today continue to resort to customary justice systems for their legal problems, including many crimes. The 2010 Constitution requires the judiciary to promote customary justice systems because they are trustworthy and accessible. Paradoxically, though, the Constitution also forbids these customary justice systems from contravening other constitutional provisions. Therein lies the difficulty. Customary justice systems’ procedures do not always comport with …

The Quest For Funding Under The Dutch Wamca: Third Party Funding And The Viability Of A Procedural Fund, Xandra Kramer Jan 2024

The Quest For Funding Under The Dutch Wamca: Third Party Funding And The Viability Of A Procedural Fund, Xandra Kramer

Emory International Law Review

A new chapter started for collective actions with the 2020 Dutch Mass Damage Settlement in Collective Actions Act (WAMCA) and the E.U. Directive on representative actions for consumer cases. The expansion of the class action mechanism has not only raised procedural and practical questions but has also triggered debates on the funding of inherently expensive collective claims for damages. Absent appropriate public legal aid schemes, third-party litigation funding has been on the rise and commercial funding has become one of the most discussed and controversial topics in European civil justice. Developments in collective actions and funding have prompted the Dutch …

The Digitalization Of Litigation, Manuel A. Gómez

Emory International Law Review

The development of digital tools that enhance communications, security and decision making have caught the attention of international development agencies, national governments, civil society organizations, and the private sector. The United Nations Development Programme (UNDP) has highlighted the importance of digital tools as a means “to improve justice sector efficiency, transparency and access to justice[,]” while the European Commission has aligned them with “a new push for European democracy in line with the political priority of a Europe fit for the digital age[.]” With these observations in mind, this article focuses on the unique advantages and challenges presented by the …

From Uniforms To Robes: Unveiling Judicial Review Practices Of The Supreme Court Of Israel In Cases Adjudicated In Military Tribunals, Yotam Berger Jan 2024

From Uniforms To Robes: Unveiling Judicial Review Practices Of The Supreme Court Of Israel In Cases Adjudicated In Military Tribunals, Yotam Berger

Emory International Law Review

While the Supreme Court of Israel has been, historically, perceived to be inclined to intervene in national security matters, this Article reveals a notable restraint in its review of criminal cases originating in military-operated tribunals. These tribunals include courts-martial (CMs), where soldiers are prosecuted, and occupied territory courts (OTCs), where Palestinians face charges. The study examines a database designed to encompass all available relevant cases decided by the Supreme Court of Israel from 2002 to 2021. It concludes that, despite its interventionist reputation, the Court exhibits a restricted, perhaps conservative stance toward criminal cases previously adjudicated by military judges. Notably, …

A Composite Cognitive Workload Evaluation Of The Hysteresis Effect, Jon Vogl Jan 2024

A Composite Cognitive Workload Evaluation Of The Hysteresis Effect, Jon Vogl

Dissertations and Theses

Advancements in technology have changed the dynamic of work as it is performed in safety-critical tasks. Today, many systems offer operators the option to ease the burden of complex tasks by offloading subtasks to automation technology. The goal of adaptive automation is to eliminate the need for operators to engage/disengage automation, and instead have automated control of subtasks adapt to the needs of the operator in real time. However, each change in automation also creates a task demand transition, which have been shown to elicit unexpected effects on cognitive workload metrics. Adaptive automation systems need to be ready to account …

Empowering Choices: A Strategy For Sexual Health And Sti Prevention Among Adolescent Girls In Fort Bend County, Texas, Mindy L. Jones Jan 2024

Empowering Choices: A Strategy For Sexual Health And Sti Prevention Among Adolescent Girls In Fort Bend County, Texas, Mindy L. Jones

Selected Social Change Portfolios in Prevention, Intervention, and Consultation

Significant Findings: In Fort Bend County, Texas, the rising rates of sexually transmitted infections (STIs) among adolescent girls, especially chlamydia, gonorrhea, and syphilis, have become a significant public health and mental health challenge. These infections not only impact physical health, leading to severe outcomes like infertility and increased HIV risk, but also affect mental health, educational attainment, and economic stability (Johnson-Minter et al., 2020; CDC, 2021). Adolescents, particularly young females aged 15-24, disproportionately bear the burden, with social and structural barriers such as stigma, lack of access to healthcare, and inadequate sexual education exacerbating the situation (Garcia et al., 2023; …

The Baby And The Big Shoes, Barbara Birch Jan 2024

The Baby And The Big Shoes, Barbara Birch

Quaker Religious Thought

This paper problematizes the premise that the Christian liturgies scrapped by early Friends were empty outer forms of little value. My queries are—Are rituals truly empty and outward, or are they full of inner sensations and experiences not easily seen or quantified? Of course, the same questions can be asked of Quaker worship, which is itself a liturgy of silence. If silence is a liturgy, is it empty or full? Moreover, does silent worship appear empty or full to newcomers and visitors?

Excessive Alcohol Use In Charlotte County, Florida, Lindsay Tomaras Jan 2024

Excessive Alcohol Use In Charlotte County, Florida, Lindsay Tomaras

Selected Social Change Portfolios in Prevention, Intervention, and Consultation

Significant Findings: Charlotte County in southwest Florida is a rapidly growing area for residents and vacationers alike. Although a naturally beautiful destination, excessive alcohol use is higher here than the state average, and motor vehicle crash deaths involving alcohol are significantly greater than both state and national averages (County Health Rankings & Roadmaps, 2024). Alcohol use is a contributing factor to a multitude of physical and mental illnesses, resulting in a massive economic burden on society. These negative consequences disproportionately impact marginalized populations such as LGBTQ+ community members and Hispanic males. The county can reduce this financial strain through increased …

Awareness & Prevention Of Eco-Anxiety In Cook County, Illinois, Susan M. Lloyd Jan 2024

Awareness & Prevention Of Eco-Anxiety In Cook County, Illinois, Susan M. Lloyd

Selected Social Change Portfolios in Prevention, Intervention, and Consultation

Goal Statement: To reduce the prevalence of eco-anxiety in adolescents and young adults from Chicago’s western neighborhoods and close suburbs Significant Findings: Eco-anxiety, “a chronic, [pervasive] unspecfied fear of environmental doom” (Dodds, 2021, p. 22) is emerging as a mental health issue among youth and young adults worldwide. Spurred by global warming, 53 percent of Americans are now “very” or “extremely” concerned about climate change (Leiserowitz, et al., 2023). Chicagoans are encountering more storms, poorer air quality, more health problems, and higher rates of high school depression and age-adjusted drug overdose (e.g., National Weather Service, n. d.; Chicago Department of …

Georgian Orthodoxy: Navigating The Middle Eastern Landscape, Leons Gabriels Taivans Jan 2024

Georgian Orthodoxy: Navigating The Middle Eastern Landscape, Leons Gabriels Taivans

Occasional Papers on Religion in Eastern Europe

This paper explores the complex sentiments among Georgian Orthodox believers, who simultaneously exhibit unwavering allegiance to the "spiritual power" of former imperialistic Russia alongside discontentment due to its military aggression. The author contends that the prevailing scholarly perspective is incomplete, stemming from a Eurocentric approach, and advocates instead for a broader consideration of Georgia, along with Azerbaijan and Armenia, within the cultural milieu of the Middle East rather than the European context. In the Middle Eastern cultural sphere, characterized by Islam, distinctions between secular and religious realms are blurred—a feature similarly reflected in Georgian Orthodox Christianity. Shaped by historical encounters …

Ban Of The Ukrainian Orthodox Church-Moscow Patriarchate In Ukraine: Limitation Of Religious Freedom Or The Fight Against Russian Influence, Bohdan Synchak Jan 2024

Ban Of The Ukrainian Orthodox Church-Moscow Patriarchate In Ukraine: Limitation Of Religious Freedom Or The Fight Against Russian Influence, Bohdan Synchak

Occasional Papers on Religion in Eastern Europe

The article reviews the activity of the Moscow Patriarchate in Ukraine and abroad, particularly in the EU and the USA. The main problem this study deals with is the probable ban of the Ukrainian Orthodox Church-Moscow Patriarchate (UOC MP) in Ukraine, which is potential against the background of the consideration in the 2nd reading of draft law No. 8371, which refers to “impossibility of the activity of religious organizations in Ukraine, the management center (management) of which is located in the state that carries out armed aggression against Ukraine.” In the course of our review, the key question is whether …

Becoming A Good Creature (2020) By Sy Montgomery, Samantha Piede Jan 2024

Becoming A Good Creature (2020) By Sy Montgomery, Samantha Piede

Picture Books

Becoming a Good Creature outlines moral lessons Sy Montgomery has learned from interactions with animals, both domestic and wild, such as “Love Little Lives,” “Don’t Be Afraid,” and “Make Your Own Family.” Our willingness to be attentive to other creatures – not just the ones like us with “two legs,” but also “four or even eight” – opens up the possibility of finding something ethically significant in these encounters. She tells us that “all have taught me something important about how to be a good creature in the world.”

Feathers Together (2022) By Caron Levis, Maughn Rollins Gregory Jan 2024

Feathers Together (2022) By Caron Levis, Maughn Rollins Gregory

Picture Books

Feathers Together tells the story of a mated couple of white storks who live and migrate together between Croatia and South Africa, until the female is wounded and can no longer fly. An elderly man builds a rooftop nest for them with a walkway for the injured female and cares for her when the male migrates. On one level, this story is standard animal fable that conveys truths and moral values about the human condition. But the book’s afterword, explaining that this is a true story, raises philosophical questions about the emotional lives of wild animals, the ethics of hunting …

Ugly Place (2022) By Laura Deal, Samantha Piede Jan 2024

Ugly Place (2022) By Laura Deal, Samantha Piede

Picture Books

Many of us can recall moments when we were stopped dead in our tracks and experienced selfless awe – sometimes in nature, sometimes in art, sometimes in the beauty of another person. The inarticulacy of these moments may present an interesting philosophical struggle for both children and adults trying to capture these phenomena. Still, the recognition that these moments are possible – and ethically significant – presents opportunities for rich discussion. The Ugly Place highlights the importance of moments in which we are reminded that we are not, in fact, the center of the universe – for it is more …

Southwest Sunrise (2020) By Nikki Grimes, Maughn Rollins Gregory Jan 2024

Southwest Sunrise (2020) By Nikki Grimes, Maughn Rollins Gregory

Picture Books

A genuine philosophical inquiry into the natural world has to begin with a genuine encounter with that world. In this arresting picture book by Nikki Grimes, a young boy named Jayden from New York City is forced into such an encounter when his parents relocate to the desert of New Mexico. This review focuses on suggestions the book offers for experiencing a natural landscape deeply, like slowing down, using all the senses, trying ‘beginner’s mind,’ making art, and using a field guide.

Implementing A Stepped Care Model: A Case Study Of Two College Counseling Centers, Stephanie L Johnson-Kane Jan 2024

Implementing A Stepped Care Model: A Case Study Of Two College Counseling Centers, Stephanie L Johnson-Kane

Dissertations and Theses

The demand for mental health counseling services has surged, but the capacity of college counseling centers to meet this demand has not kept pace. The effects of COVID-19 have exacerbated this already fragile system of care. College students are enrolling in college with increased levels of anxiety, depression, disordered eating, suicidal ideation, and substance use. College counseling center staff are facing burnout. The waitlist to receive mental health services is at critical capacity. This multi-site case study was designed to foster an understanding of two college counseling centers' implementation of the stepped care approach as a mental health service delivery …

Nonprofit Corporations & Politics: The Entity/Coordination Tension, Lloyd Hitoshi Mayer Jan 2024

Nonprofit Corporations & Politics: The Entity/Coordination Tension, Lloyd Hitoshi Mayer

Journal Articles

Federal tax law treats separate nonprofit corporations as distinct legal entities for almost all purposes, in common with most other areas of law. With respect to political activity, this means that one nonprofit corporation’s lobbying or election related actions are generally not attributed to another nonprofit corporation. This is the case even if the two entities have overlapping or even identical boards of directors. It is also the case even if the two entities collaborate regarding their respective activities and share employees, facilities, outside vendors, and other resources, as long as the entities reasonably allocate the costs for those shared …

Predatory Publishing And Global Scholarly Communications, Monica Berger Jan 2024

Predatory Publishing And Global Scholarly Communications, Monica Berger

Publications and Research

redatory publishing is a complex problem that harms a broad array of stakeholders and concerns across the scholarly communications system. It shines a light on the inadequacies of scholarly assessment and related rewards systems, contributes to the marginalization of scholarship from less developed countries, and negatively impacts the acceptance of open access.   To fix what is broken in scholarly communications, academic librarians must act as both teachers and advocates and partner with other stakeholders who have the agency to change how scholarship is produced, assessed, and rewarded. Predatory Publishing and Global Scholarly Communications is a unique and comprehensive exploration of …

Legal Education's Role In Combating Automation Bias And Complacency With Generative Ai In The Practice Of Law, Anna C. Conley Jan 2024

Legal Education's Role In Combating Automation Bias And Complacency With Generative Ai In The Practice Of Law, Anna C. Conley

Faculty Law Review Articles

Market-driven efficiencies will result in generative AI as an integral part of the practice of law. Despite this reality, however, recent judicial decisions highlight the risks of generative AI in the practice of law. In each case, an attorney filed documents with the court that included nonexistent cases “hallucinated” by generative AI. The attorneys did not confirm the cases’ actual existence before relying on them and were subsequently sanctioned by the court.

These cases illustrate that, like aviation, self-driving vehicles and healthcare, the legal industry is not immune from automation bias and complacency. Automation bias is the blind reliance on …
