Authoritarian International Law: An Unfinished Research Odyssey, Roda Mushkat Jan 2024

Authoritarian International Law: An Unfinished Research Odyssey, Roda Mushkat

Cardozo International & Comparative Law Review

The concept-rich international legal space has expanded in the past few years by incorporating the notion that there is a distinct form of internationalaw possessing authoritarian traits. This notion stands in contrast with the time-honored mainstream variant which is assumed to have liberal-democratic roots and dispositions. A product of the current decade, authoritarian international law has nevertheless left a palpable mark on international legal theory and is believed to have materially reshaped the international legal landscape. The primary aim of this Article is to summarize the achievements made in analyzing the dimensions of this new concept and its considerable practical …

Rulers, Victims, Educators, Or Partners? Judges' Perception Of Their Relationship With Lawyers, Boaz Shnoor, Eyal Katvan Jan 2024

Rulers, Victims, Educators, Or Partners? Judges' Perception Of Their Relationship With Lawyers, Boaz Shnoor, Eyal Katvan

Cardozo International & Comparative Law Review

Judges oftenface lawyer misbehavior in court. Such misbehavior, and the way judges address it, are pressing issues, which challenge all courts. However, the current literature on the legal profession and legal education lacks a systemic analysis of judges' perceptions of lawyers' behavior in their courtrooms, of the ways in which judges are influenced by lawyers' misbehavior, and of the ways in which they respond to it. This Article fills this gap by empirically analyzing judges' perceptions of lawyers' misbehavior, how it influences judges' work environments, the methods they use to cope with it, and the constraints they face in dealing …

Are Holocaust Denial Laws And Critical Race Theory Bans The Same?, Rob Kahn Jan 2024

Are Holocaust Denial Laws And Critical Race Theory Bans The Same?, Rob Kahn

Cardozo International & Comparative Law Review

Florida's education rules list Holocaust denial and critical race theory ("CRT") as "theories that distort the past." This is not a fair comparison. Holocaust denial laws and CRT bans are analytically distinguishable. Holocaust denial laws were originally intended to fight hate, and this is the only reason they might be legitimate today. By contrast, CRT bans, for all their well-meaning language aboutprotecting childrenfrom race-based accusations of guilt, intend to silence the past. Indeed, the CRT bans are uncannily similar to the laws used in Turkey to ban discussion of the Armenian Genocide in schools. While one might reject both sets …

Enhancing Fairness And Compassion In Military Disciplinary Proceedings, Rinat Kitai-Sangero Jan 2024

Enhancing Fairness And Compassion In Military Disciplinary Proceedings, Rinat Kitai-Sangero

Cardozo International & Comparative Law Review

This Article critically assesses the disciplinary proceedings carried out by judicial officers within the military, shedding light on the absence of crucial procedural guarantees, such as the right to legal representation and an impartial judge. After comparing the Israeli disciplinary proceedings with the Summary Court-Martial system in the United States and considering arguments used to justify the lack of procedural guarantees, the Article emphasizes the emotional distress experienced by soldiers who feel powerless due to power imbalances with their commanders and the severity ofprison sentences they may face. While the Article primarily focuses on the Israeli army, its main arguments …

Reuniting "Active" And "Direct" Participation: The International Criminal Court's Dph Divorce In Lubanga, Josef Danczuk Jan 2024

Reuniting "Active" And "Direct" Participation: The International Criminal Court's Dph Divorce In Lubanga, Josef Danczuk

Cardozo International & Comparative Law Review

Throughout treaty-making processes and turn-of-the-century international criminal tribunal decisions, scholars and judges alike determined that the terms "direct" and "active," when referring to participation in hostilities, were synonymous. However, the International Criminal Court ("ICC'), in interpreting the Rome Statute in the Lubanga case, determined that they were not, creating disparity between interpretations of the same terms within International Criminal Law ("ICL") and the Law of Armed Conflict ("LOAC"). Not only is the ICC's interpretation legally wrong, it is also practically unworkable and distorts the well-established doctrine of DPH as defined in LOAC. Lubanga may have broadened protectionfor child soldiers, but …

Constructing A Taxonomy Of Financial Consumer Protection Policy And Assessing The New Consumer Duty In The United Kingdom's Financial Sector, Iris H-Y Chiu, Wai-Yee Wan Jan 2024

Constructing A Taxonomy Of Financial Consumer Protection Policy And Assessing The New Consumer Duty In The United Kingdom's Financial Sector, Iris H-Y Chiu, Wai-Yee Wan

Cardozo International & Comparative Law Review

The article critically examines the UK's Consumer Duty, introduced by the Financial Conduct Authority (FCA), arguing that while it represents a significant step in financial consumer protection, it falls short in addressing welfare outcomes and distributive justice. The Duty focuses on consumer empowerment but neglects key aspects of consumer citizenship, such as access to essential financial services and guarantees of product quality. The article proposes a taxonomy of consumer protection levels to evaluate the Duty's effectiveness and advocates for a more robust framework that prioritizes financial inclusion and long-term consumer welfare.

One Size Does Fit All: A Quasi-Federal Solution To The Euro-Centric Structural Shortcomings Of The Icc, Anivesh Bharadwaj Jan 2024

One Size Does Fit All: A Quasi-Federal Solution To The Euro-Centric Structural Shortcomings Of The Icc, Anivesh Bharadwaj

Cardozo International & Comparative Law Review

The article critiques the International Criminal Court's (ICC) centralized structure in The Hague, arguing that it undermines transparency, accessibility, and legitimacy, particularly for victims and witnesses in remote regions. The author proposes a "quasi-federal" framework to decentralize the Court, enabling regional proceedings while maintaining a central Appeals Chamber and Presidency. This restructuring aims to address structural flaws, enhance deterrence, and improve justice delivery by bringing proceedings closer to affected communities.

Leading From The Middle: Arts Administrators' Beliefs About The Impact Of Arts Education On High-Needs Students, Sofia Fojas Jan 2024

Leading From The Middle: Arts Administrators' Beliefs About The Impact Of Arts Education On High-Needs Students, Sofia Fojas

Dissertations

Research on arts education notes the positive impact of arts education on educational outcomes for students, particularly students of color, students in poverty, and students needing additional academic support. Students living in low-income communities receive different educational opportunities than those in high-wealth districts. This disparity is especially true for highly mobile and high-needs students of color. Arts education has made positive differences in student outcomes. This qualitative study examined the beliefs of county arts leads, leaders in the middle, situated between the California Department of Education and their local school districts, and how they can be empowered to be change …

The Impact Of Changing Joining Rates On The Western Australian Sheep Flock, Kate Pritchett Jan 2024

The Impact Of Changing Joining Rates On The Western Australian Sheep Flock, Kate Pritchett

Animal production and livestock research reports

Given the poor seasonal conditions and low prices experienced in 2023/24, the Western Australian (WA) sheep industry is experiencing a period of very poor industry sentiment often compared to that seen in the 1990’s following the collapse of the wool reserve price scheme.

These difficult times mean producers have had to make production decisions for their businesses which may have flow on effects for the entire state flock. One commonly discussed option by industry and consultants was to join less ewes to reduce the feed burden on farm and help mitigate losses due to low prices. This computer modelling aimed …

Loose Smut Of Barley And Its Management, Department Of Primary Industries And Regional Development, Western Australia Jan 2024

Loose Smut Of Barley And Its Management, Department Of Primary Industries And Regional Development, Western Australia

Grains and other field crops factsheets

The fungal disease loose smut of barley parasitises the host plant and produces masses of soot-like spores that infect the seed head, reducing the yield and quality of harvested grain.

Smut diseases are host specific, meaning that smut of one cereal crop will not infect others (for example, loose smut of barley does not infect wheat or oats).

In many cases grain receival points have low or zero tolerance of smut contaminated grain.

Identification Of Cellulose Synthase Structural Features Involved In Cellulose Synthesis Complex Formation, Jamie Lamkin Jan 2024

Identification Of Cellulose Synthase Structural Features Involved In Cellulose Synthesis Complex Formation, Jamie Lamkin

Open Access Dissertations

Cellulose is a microfibrillar polysaccharide component of plant cell walls and consists of bundles of β-1,4-linked glucan chains. In addition to being important for plant cell walls, cellulose is also used by humans for a variety of purposes such as biofuels and building materials. Cellulose is produced by the integral plasma membrane enzyme Cellulose Synthase (CESA) and multiple CESA proteins can combine to form a six-lobed rosette structure called a Cellulose Synthesis Complex (CSC). In seed plants CSCs appear to be hetero-oligomeric, comprising three different CESA isoforms. However some non-seed plants, such as the bryophyte Physcomitrium patens, can form …

Role Of Wave3 As An Actin Binding Protein In The Pathology Of Triple Negative Breast Cancer, Lamyae El Khalki, Khalid Sossey-Alaoui Jan 2024

Role Of Wave3 As An Actin Binding Protein In The Pathology Of Triple Negative Breast Cancer, Lamyae El Khalki, Khalid Sossey-Alaoui

Faculty Scholarship

Breast cancer, a prevalent global health concern, has sparked extensive research efforts, particularly focusing on triple negative breast cancer (TNBC), a subtype lacking estrogen receptor (ER), progesterone receptor, and epidermal growth factor receptor. TNBC's aggressive nature and resistance to hormone-based therapies heightens the risk of tumor progression and recurrence. Actin-binding proteins, specifically WAVE3 from the Wiskott–Aldrich syndrome protein (WASP) family, have emerged as major drivers in understanding TNBC biology. This review delves into the intricate molecular makeup of TNBC, shedding light on actin's fundamental role in cellular processes. Actin, a structural element in the cytoskeleton, regulates various cellular pathways essential …

Medieval Art, Modern Politics, Brigitte Buettner, William J. Diebold Jan 2024

Medieval Art, Modern Politics, Brigitte Buettner, William J. Diebold

Art: Faculty Books

Medieval Art, Modern Politics is an innovative volume of twelve essays by international scholars, prefaced by a comprehensive introduction. It examines the political uses and misuses of medieval images, objects, and the built environment from the 16th to the 20th century. In case studies ranging from Russia to the US and from catacombs, mosques, cathedrals, and feudal castles to museums and textbooks, it demonstrates how the artistic and built legacy has been appropriated in post-medieval times to legitimize varied political agendas, whether royalist, imperial, fascist, or colonial. Entities as diverse as the Roman papacy, the Catholic Church, local arts organizations, …

How And Why Teachers Taught About The 2020 U.S. Election: An Analysis Of Survey Responses From Twelve States, Paul G. Fitchett, Brett L.M. Levy, Jeremy D. Stoddard Jan 2024

How And Why Teachers Taught About The 2020 U.S. Election: An Analysis Of Survey Responses From Twelve States, Paul G. Fitchett, Brett L.M. Levy, Jeremy D. Stoddard

Educational Theory and Practice Faculty Scholarship

This study explores social studies teachers’ self-reported instruction about teaching the 2020 election in U.S. secondary schools. We analyzed survey responses from 1,723 secondary social studies teachers from 12 states (3 left-leaning, 3 rightleaning, 6 battleground) collected in the weeks after the election, examining self-reported pedagogies, topics taught, and overall frequency of teaching about the election. Respondents reported teaching about the election more frequently if they taught courses in civics or government and/or if they had greater control over their curricula. Analyses indicated that teachers’ demographic characteristics, teaching contexts, and ideologies about civic education were related to the election-related topics …

How Can Educators Motivate Young People To Participate In Civic Life?, Brett L.M. Levy Jan 2024

How Can Educators Motivate Young People To Participate In Civic Life?, Brett L.M. Levy

Educational Theory and Practice Faculty Scholarship

Introduction:

In a democratic society, why do some people engage in civic and political action while others sit on the sidelines? What — if anything — can educators do to support informed civic participation among a wider segment of the population, even at a time of political cynicism?

These are challenging and vital issues, as we see during each election cycle and the periods in between, and I’ve tried to address them from various angles.

As a middle school social studies teacher in the early 2000s, I aimed to motivate young people to be civically engaged — sometimes succeeding, sometimes …

Battling The Form: A Front-End Approach To Default-Use Noncompetes, Rachel Arnow-Richman Jan 2024

Battling The Form: A Front-End Approach To Default-Use Noncompetes, Rachel Arnow-Richman

University of Florida Journal of Law & Public Policy

A growing consensus holds that employer overuse of noncompete agreements adversely affects workers and the economy. But there is little agreement on how best to regulate these instruments. States have experimented with an array of idiosyncratic reforms that capture the most egregious misuses, while the Federal Trade Commission (FTC), has issued an outright ban that would prohibit all employee noncompetes and comparable instruments nationwide.

This Article argues that any effective reform strategy must target what it terms “default-use” noncompetes—boilerplate restraints imposed by employers as a matter of course without close consideration of their underlying justification. Some unlawful noncompetes are clearly …

Non-Competition Clauses In Canadian Employment Law And The Doctrine Of Inequality Of Bargaining Power, David J. Doorey Jan 2024

Non-Competition Clauses In Canadian Employment Law And The Doctrine Of Inequality Of Bargaining Power, David J. Doorey

University of Florida Journal of Law & Public Policy

In 2021, the Ontario government legislatively prohibited most noncompetition clauses, the first Canadian government to take this step. The move was unexpected because the political party in power (the Progressive Conservative Party, or PCP) has not traditionally been a strong supporter of workers’ rights. However, the PCP wanted to demonstrate a new commitment to the working class, and it knew that banning non-competition clauses would attract little backlash from its business constituency since the common law renders almost all noncompetes illegal in Canada anyway. The common law approach to the enforceability of non-competition clauses is similar in Canada and the …
