What Mediation Romantics Can Learn From The Model T (Or Maybe The Chevrolet Trax), Nancy A. Welsh
What Mediation Romantics Can Learn From The Model T (Or Maybe The Chevrolet Trax), Nancy A. Welsh
Cardozo Journal of Conflict Resolution
When mediation was reintroduced to the U.S. in the 1970s, it was infused with a democracy-and-self-determination-enhancing, social justice ethos. As the process has been very successfully institutionalized, however, these ambitions have been scaled backalthough, at least arguably, certain "mediative elements" have actually been adopted (or coopted) by other procedural innovations. Perhaps it is time for those of us frustrated with the evolution of mediation to reconcile ourselves to the reality and value of a "basic" model of mediation designed for the sole purpose of getting parties from dispute to settlement-in much the same way that the basic model of a …
Early Neutral Evaluation In Baseball Arbitration, Yakov Schwalb
Early Neutral Evaluation In Baseball Arbitration, Yakov Schwalb
Cardozo Journal of Conflict Resolution
In recent years, the contracts awarded to Major League Baseball ("MLB") players in free agency have been astronomical. In the 2023 offseason, Shohei Ohtani signed the largest contract in American sports history, a ten-year $700 million contract with the Los Angeles Dodgers. In the previous year, MLB teams spent over $3.5 billion on free agents. However, before a player is eligible for free agency, he can undergo a process called final offer arbitration ("FOA"). In this system, if a player and his professional baseball team are unable to reach an agreement for the player's salary for the upcoming season, the …
Squatters Squabbles: The Use Of Mediation To Provide Beneficial Solutions To Adverse Possession Claims In New Jersey, Bayla Zohn
Cardozo Journal of Conflict Resolution
In our society, law is a complex and ever-evolving field, constantly adapting to fit our needs. Yet, there are certain legal matters we would expect to have clear and obvious resolutions. Property ownership should be simple and unambiguous, governed by "established legal rules and precepts." Examine a deed, survey the stated legal owner of the tract of land, and your answer should be uncomplicated. Yet, there are a multitude of complex laws that allow individuals to obtain legal ownership of land in a seemingly illicit fashion.

Benzene Exposure In Reproductive Biology: A Comprehensive Analysis Of Placental Response And Molecular Mechanisms In Trophoblast Function, Anthony Maxwell
Benzene Exposure In Reproductive Biology: A Comprehensive Analysis Of Placental Response And Molecular Mechanisms In Trophoblast Function, Anthony Maxwell
Wayne State University Dissertations
The increase in environmental challenges and exposure to pollutants like benzene poses pressing concerns for reproductive health. This dissertation investigates the impact of benzene exposure during gestation on placental function, a key determinant for fetal development and pregnancy outcomes. Our work establishes that benzene exposure during pregnancy induces maternal immune activation, leading to increased rates of fetal resorptions, compromised fetal growth, and abnormal placental development. Intriguingly, we identify a sexual dimorphic response in male and female placentas to benzene exposure, attributable to inherent differences between male and female placental biology. On a molecular level, benzene is metabolized into hydroquinone in …
The New American Conspiracism: The Conspiracy Mentality And The Consequences For American Democracy, Jennifer M. Seech Seramur
The New American Conspiracism: The Conspiracy Mentality And The Consequences For American Democracy, Jennifer M. Seech Seramur
Wayne State University Dissertations
This research is at the forefront of a developing field of inquiry into the psychological impacts of an American media environment plagued with mis- and disinformation. Many have suggested that we have entered a "post-truth" era and this phenomenon will have disastrous consequences for the stability of American democracy. However, few have empirically tested these notions. This research seeks to fill part of this gap in knowledge by analyzing a survey with over 8,000 participants to bring empirical evidence to bear on these assertions. Through an assessment of the effects of a conspiracy mentality (or one’s proclivity to endorse and …
Ion Current Analysis And Misfire Prediction During Cold Start In A Compression Ignition Engine, Manan Jyotin Trivedi
Ion Current Analysis And Misfire Prediction During Cold Start In A Compression Ignition Engine, Manan Jyotin Trivedi
Wayne State University Dissertations
In future, compression ignition engines are anticipated to continue powering heavy-duty trucks and certain machinery, while passenger vehicles and light-duty vehicles will increasingly be battery powered. However, compression ignition engines face challenges such as combustion instability, misfiring, and high unburnt hydrocarbon emissions when started under severe cold conditions. These issues can be mitigated through the use of real-time feedback to the engine's control module.
The ion current signal, reflective of combustion and emissions characteristics, has proven to be a reliable feedback signal under warmed-up conditions. In this dissertation, the potential of the ion current signal as a feedback mechanism during …

The study focuses mainly on counselors-in-training self-efficacy and the impact of clinical supervision. The sample size of 227 counselors-in-training all received some type of clinical supervision. The deliverance of clinical supervision did not have any significance between them. Therefore, virtual clinical supervision is just as effective as face-to-face clinical supervision. Also, the counselors-in-training who were in internship class had a much higher level of self-efficacy than the counselors-in-training in the technique …

Literature Unbound: Black Carceral Consciousness From 1965 – 1975, Allan L. Ford
Wayne State University Dissertations
Genre has the capacity to help readers my closely understand certain writings; however, strict reliance on genre alone can cloud or betray the author's intentions. This is especially true when the author is imprisoned. From autobiographic writings by Huey Newton and Rubin Carter, to the collected letters and essays of Angela Davis, George Jackson, and Eldridge Cleaver, to certain works of poetry by Ericka Huggins and Etheridge Knight, a certain expression of humanity is alive in their words. I use a method of analysis for these works called Black carceral consciousness to perform close readings of these works in an …

The global population is aging rapidly, with the total percentage of older adults (65 years and older) projected to increase from 10\% of the total population in 2022 to 16\% by 2050, according to the World Population Prospectus 2022 issued by the United Nations. For certain parts of the world such as Europe and North America, this translates to 1 in every 4 persons is projected to be 65 years or older by 2060. This trend raises concerns about providing quality long-term care for the older population. Moreover, according to the 2021 survey by the American Association of Retired Persons …

Examining The Impact Of Yoga And Mindfulness On Perceived Caregiver Stress And Burden, Michelle Renaud
Wayne State University Dissertations
PURPOSE: In the United States, there are approximately 34 million informal caregivers; defined as individuals who provide unpaid help to older adults (Lavela & Ather, 2010). Among this population, there is a growing health concern focusing on the potential physical and psychological risks linked to caregiving. Therefore, the purpose of this study was to investigate how a yoga and mindfulness intervention may influence changes in caregivers’ perceptions of stress and burden as well as their resting heart rate (HR) and blood pressure (BP). METHODS: Eight caregivers participated in an eight-week yoga and mindfulness intervention, with 60- minute sessions featuring gentle …

Essays On The Urgent Care Market, Thomas Wilk
Wayne State University Dissertations
This dissertation examines aspects of the urgent care market. We first explore the history and recent trends of urgent care, from its inception in the 1970 to its growing competition with primary care physicians and retail clinics in the 2010s. We examine aspects of how urgent care can impact a patient’s medical home and its use of pricing transparency that is sweeping the nation. We examine the growing need for patient convenience and flexibility in care with retail clinics encroaching the urgent care service space. We also cover the development of technology to better facility telehealth visits and to disrupt …
Crossing The “Valley Of Death”: How Climate Technology Entrepreneurs Navigate Relationships With Venture Capital Investors, Allison Lucas
Crossing The “Valley Of Death”: How Climate Technology Entrepreneurs Navigate Relationships With Venture Capital Investors, Allison Lucas
Wayne State University Dissertations
As the world faces the ongoing and intensifying impacts of climate change, a group of innovative changemakers known as climate tech entrepreneurs (CTEs) are working on climate adaptation, mitigation, and/or resilience efforts by brining innovative technologies to the global market (UNFCC, 2018; Endeavor 2022). To realize the full potential of these technologies—tools, techniques, specialized knowledge or skillsets—they must be developed, deployed, and implemented at scale (IPCC, 2000). To do this, CTEs require external funding support, especially during a crucial period of the start-up lifecycle known as the “valley of death”. In this period between development and commercialization, production costs and …

Development Of Advanced Multi-Nozzle Multi-Material 3d Printing, Mohammed Al Ali
Wayne State University Dissertations
Extrusion-based 3D printing methods, such as Direct Ink Writing, are extensively utilized across sectors like biomedical, energy, and electronics, employing a diverse range of materials. However, the lengthy printing times associated with single-nozzle systems limit their application in complex mass production and rapid prototyping. While multi-nozzle systems have attempted to address this issue, they often result in costly, and bulky setups with limited material options. This research introduces a novel multi-nozzle multi-material system that allows for simultaneous 3D printing using bent nozzles. The system is cost-effective, simple in design, and capable of printing a wide range of materials. Its universal …

Occupational Therapy Capstone Presentations
Occupational therapy (OT) practitioners have a wide scope of practice due to the versatility of the profession. Some OT practitioners practice in traditional healthcare settings, such as hospitals, clinics, and schools, while other therapists find locations that are considered less conventional. The utilization of OT in nontraditional practices is an opportunity for practitioners to expand their scope of practice and benefit more people within the community. No matter the setting, OT practitioners provide services to promote patient health, independence, and quality of life. A specific factor that can negatively affect these areas is age progression. One way to combat this …
The Rise Of General Jurisdiction Over Out-Of-State Enterprises In The United States, Peter Hay
The Rise Of General Jurisdiction Over Out-Of-State Enterprises In The United States, Peter Hay
Emory International Law Review
In June 2023, the U.S. Supreme Court continued its revision of personal jurisdiction law, in this case by refining, thereby perhaps expanding, the law of when a court may exercise general personal jurisdiction – that is, jurisdiction over all claims – over a non-resident person or an out-of-state enterprise. In Mallory v. Norfolk Southern Railway Co., it held in a 4+1:4 decision that, when a state requires a non-resident company to register to do business in the state and such registration constitutes consent to jurisdiction over all claims against it, such exercise is permitted. In reaching its conclusion, the Court …

Taiwan's Medical Injury Law In Action, Chih-Ming Liang, Robert B Leflar, Chih-Cheng Wu
Emory International Law Review
Taiwan’s healthcare system, lauded internationally for its universal insurance coverage, moderate costs, and high quality of care, has one significant group of detractors: its physicians. Overworked, squeezed financially by the nation’s global budgeting system’s annual payment restrictions, and oppressed by both criminal prosecutions and civil malpractice actions, doctors and hospitals raised criticisms that culminated in legislative reforms enacted in 2017 and 2022. Are the reforms making any difference?
This Article offers the first comprehensive examination in English of how Taiwan’s medical injury law works. The Article is based on interviews with judges, attorneys, physicians, scholars, and other citizens, literature reviews, …

Inflation Expectations And Political Polarization: Evidence From The Cooperative Election Study, Ethan Struby, Christina Farhart
Department of Economics Working Paper Series
Using a unique, nationally representative survey from the 2022 midterm elections, we investigate the partisan divide in beliefs about inflation and monetary policy. We find that party identity is predictive of inflation forecasts even after conditioning on beliefs about both past inflation and the Federal Reserve’s long-run inflation target. Partisan forecast differences are driven by respondents who express low generalized trust in others and have a high degree of political knowledge; high-trust and low- knowledge partisans make similar forecasts all else equal. This finding is consistent with the literature in political psychology that examines the endorsement of conspiracy theories and …
