Understanding opportunity is a crucial aspect of entrepreneurship research. Existing studies have extensively examined individual factors in facilitating entrepreneurial activities such as new venture creation. Although there are some discussions on contextual factors, few connect context with the origin of entrepreneurship—opportunity. Recognising the objectivity of entrepreneurial opportunity, this theoretical article first proposes two types of opportunities—innovative opportunity and imitative opportunity—to understand the nature of opportunity. It then proposes a systematic framework—the PETII (Population, Economic status, Technological advancement, Industry life cycle, Institutions) model—to analyse the role of context in the distribution of opportunity. The downfall of Enron Corporation often epitomizes corporate fraud. One of the world’s fastest growing and most inventive companies, Enron had engaged in a range of complex structured hedging transactions designed to achieve accounting rather than operating results. Its principal motivation, though, was to avoid the risk of incurring financial-statement losses that could impair its credit rating and thereby destroy its primary business of derivatives-based energy trading.

Do violations of contractual representations and warranties (“R&Ws”) merely shift risk by giving rise to contract-breach damages, or can they also give rise to fraud claims? This question is at the heart of numerous lawsuits, including billions of dollars of securitization-related litigation. Many agreements governing the issuance of securities in these transactions limit R&W breach claims to a sole contractual remedy—curing the violation or repurchasing nonconforming loans that caused the violation. Although parties making the R&Ws argue that this sole remedy should adequately shift risk, investor plaintiffs contend that it insufficiently shifts the risk if the violations are extensive. Commercial law, as codified by the Uniform Commercial Code ("UCC"), recognizes certain important policy goals and commercial realities as a basis to override property law. Among other provisions, § 2-509 of the UCC allocates the risk of loss to goods in transit to the party who controls and would be expected to insure the goods, whether or not that party owns the goods at the time of their loss. Promoting commercial reality over the "arbitrary shifting" of rights based on property has been widely praised. Thousands of American soldiers have lost their lives in the failed wars in Afghanistan, Iraq, and beyond—and the death toll among civilians is in the millions. After a person is arrested and charged with a crime, they may be released on bail and required to participate in a community supervision program while awaiting trial. These ‘pretrial programs’ are common throughout the United States, but very little research has demonstrated their effectiveness. Researchers have emphasized the need for more rigorous program evaluation methods, which we introduce in this article. We describe a program evaluation pipeline that uses recent interpretable machine learning techniques for observational causal inference, and demonstrate these techniques in a study of a pre-trial program in Durham, North Carolina. BACKGROUND: Opinion leadership, educational outreach visiting, and innovation championing are commonly used strategies to address barriers to implementing innovations and evidence-based practices in healthcare settings. Despite voluminous research, ambiguities persist in how these strategies work and under what conditions they work well, work poorly, or work at all. The current paper develops middle-range theories to address this gap.

Matthew Desmond made the claim in Evicted, his powerful work on housing insecurity, that those concerned with alleviating poverty should focus not merely on ensuring that poor people have higher disposable incomes, but on countering the exploitative price gouging that depresses the value of whatever income they have. Jacob’s powerful essay in Jacob chapters 4–6 ends with this statement: “I bid you farewell, until I shall meet you before the pleasing bar of God, which bar striketh the wicked with awful dread and fear. Amen” (Jacob  6:13). The essay represents Jacob’s teachings as a Nephite priest concerning the centrality of Christ in the religious and doctrinal framework of his Nephite congregation. It fits within the greater structure of the book of Jacob, which appears to be governed by Nephi1’s instructions concerning what should be included on the small plates. While social psychology has contributed much to our understanding of collective action, other forms of resistance are understudied. However, in contexts of long-standing oppression—such as ongoing colonialism—and past repression of liberation struggles, other resistance strategies are important considering the constraints on overt, collective action in such contexts. This paper reports findings from an interview study in Puerto Rico (N = 22) exploring anti-colonial resistance. We analysed participants' own resistance, future preferred strategies, and descriptive norms of other ingroup members' resistance. Through thematic analysis, we identified six distinct forms of anti-colonial resistance. Notably, none of the participants reported participating in collective …

In the aftermath of traumatic events, individuals and groups seek to make sense of these experiences. ‘Never again’ is often considered the primary lesson of genocide. Yet, people may understand this lesson in different ways, and other lessons may also be relevant. The present paper reports a qualitative content analysis of publicly available testimonies from survivors of the Holocaust, the Rwandan Genocide and the Nanjing Massacre (N = 200), examining the lessons of genocide that these survivors shared publicly. We consider rotationally driven nonlinear viscoelastic jet. In contrast to previous unrealistic planar studies with no gravity effect, we investigate here realistic three-dimensional jet with gravity effect. Using theoretical and computational methods, we develop models for such jet and its stability and determine the solutions. We find three-dimensional jet with gravity effect leads to faster and thinner jet. For jet arc length higher than its exit diameter, our calculation with typical parameter values shows that jet radius is smaller by a factor of more than 1.4 and jet speed is higher by factor of more than 2 as are compared …

QR code phishing, or "quishing," exploits the widespread adoption of QR codes to embed malicious URLs that lead users to phishing sites or initiate malware downloads. Unlike traditional phishing methods, QR phishing is uniquely deceptive, leveraging the inherent trust and convenience associated with QR codes while bypassing standard detection mechanisms. This thesis presents the SEQR scanner, a novel solution tailored to detect and prevent QR phishing attacks, specifically focusing on Android platforms. By integrating multiple detection mechanisms—machine learning prediction, fuzzy logic algorithm, and third-party blacklisting APIs—the solution effectively identifies malicious QR codes with precision. เอกัตศึกษานี้มีวัตถุประสงค์เพื่อกำกับดูแลการนำเทคโนโลยีมาใช้ในตลาดหลักทรัพย์ ในรูปแบบการซื้อขายหลักทรัพย์โดยใช้ Program Trading ให้มีความโปร่งใสและเท่าเทียมกันระหว่างนักลงทุน และทำให้ตลาดหลักทรัพย์มีสถาพคล่องที่ดีและมีประสิทธิภาพ โดยได้ศึกษาเกณฑ์การกำกับดูแลการใช้ Program Trading รวมถึงได้ศึกษากฎหมายและระเบียบการกำกับดูแลการใช้งานที่เกี่ยวข้องและศึกษาผลกระทบต่อนักลงทุน ซึ่งการวิจัยนี้ใช้วิธีวิเคราะห์ข้อมูลจากเอกสารของหลักทรัพย์ สถิติและข้อมูลจากตลาดหลักทรัพย์ บทความและระเบียบต่าง ๆ บนเว็บไซต์ตลาดหลักทรัพย์แห่งประเทศไทยและเว็บไซต์ของต่างประเทศ เป็นต้น รวมถึงบทสัมภาษณ์จากผู้มีประสบการณ์และเชี่ยวชาญในการซื้อขายและดูแลหลักทรัพย์ และศึกษากฎหมาย แนวทางการกำกับดูแลของต่างประเทศ เพื่อนำมาเปรียบเทียบมาตราการการกำกับดูแลการใช้งาน จากการศึกษาพบว่าหลักเกณฑ์การกำกับดูแลของตลาดหลักทรัพย์ไทยในปัจจุบันยังไม่เพียงพอ เช่น การไม่มีกฎหมายดูแลเฉพาะสำหรับการใช้ Program Trading แบบรายงานของลักษณะการซื้อขายด้วยความถี่สูงซึ่งเป็นสาเหตุในการก่อให้เกิดความผันผวนของราคาหลักทรัพย์ในตลาด บทลงโทษที่ยังไม่เข้มงวดมากเท่ากับต่างประเทศ ซึ่งเมื่อเปรียบเทียบกับมาตรฐานในประเทศที่มีการกำกับดูแลอย่างเข้มงวด เช่น สหรัฐอเมริกา เกาหลีใต้ และสาธารณรัฐประชาชนจีน พบว่าของประเทศไทยยังไม่คลอบคลุมผู้เขียนจึงได้ศึกษาและเทียบเคียงแนวทางการกำกับดูแลจากต่างประเทศ เพื่อนำมาปรับใช้ให้เหมาะสมกับบริบทของประเทศไทย และเสนอว่าควรมีการเพิ่มและแก้ไขกฎเกณฑ์การกำกับดูแลและกฎหมายให้ครอบคลุมในด้านการซื้อขายด้วยความถี่สูง ด้านการกำหนดระยะเวลาการระงับการซื้อขายชั่วคราวเพื่อชะลอความตื่นตระหนกของตลาด ด้านแบบรายงานที่ต้องแจ้งให้กับตลาดหลักทรัพย์รับทราบเพื่อเป็นการป้องกันความเสี่ยง รวมถึงด้านการกำหนดบทลงโทษที่มีความเข้มงวดมากขึ้น เพื่อเป็นการป้องกันพฤติกรรมที่ไม่เหมาะสมในตลาดหลักทรัพย์ และพัฒนากลไกที่ช่วยรองรับความก้าวหน้าทางเทคโนโลยีในอนาคต และสร้างความเชื่อมั่นให้แก่นักลงทุนตลาดหุ้นไทย

เอกัตศึกษาฉบับนี้ มีวัตถุประสงค์เพื่อมีมาตรการ หรือแนวคิดริเริ่มเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืชในประเทศไทยให้เติบโตมากขึ้น เพื่อสร้างประโยชน์ในระยะยาวให้กับเศรษฐกิจและสังคมไทยอย่างยั่งยืน ประโยชน์ของธุรกิจดังกล่าวส่งผลกระทบในด้านต่าง ๆ ดังนี้ (1) ประโยชน์ด้านสุขภาพ สามารถช่วยให้มีสุขภาพดีขึ้น รวมถึงลดความเสี่ยงต่อโรคต่าง ๆ (2) ประโยชน์ด้านสิ่งแวดล้อม การรับประทานอาหารทางเลือกจากพืชใช้ทรัพยากรต่าง ๆ เช่น ที่ดิน แหล่งน้ำ และพลังงาน น้อยกว่าอาหารที่มีส่วนผสมจากเนื้อสัตว์ จึงถือเป็นการประหยัดพลังงานและช่วยรักษาสิ่งแวดล้อมได้เป็นอย่างดี (3) ประโยชน์ด้านความมั่นคงทางอาหาร สามารถช่วยลดความเสี่ยงจากการขาดแคลนอาหาร เนื่องจากกระบวนการผลิตอาหารทางเลือกจากพืชใช้ทรัพยากรด้านต่าง ๆ น้อยกว่าผลิตภัณฑ์จากสัตว์ และ (4) ประโยชน์ด้านสวัสดิภาพสัตว์ การรับประทานอาหารทางเลือกจากพืชถือเป็นการคุ้มครองสัตว์ เพราะเป็นการลดการผลิตผลิตภัณฑ์จากเนื้อสัตว์ในฟาร์มเอกัตศึกษาฉบับนี้ มีการดำเนินการวิจัยด้วยวิธีการศึกษาเชิงเอกสาร (Documentary Research) โดยการศึกษาค้นคว้า รวบรวม วิเคราะห์ข้อมูล จากหนังสือ บทความ ตำรา วิทยานิพนธ์ เอกัตศึกษา เอกสารสิ่งพิมพ์ หลักภาษีอากร โดยมีการใช้ฐานข้อมูลออนไลน์ ที่มีบุคคลอื่นได้บันทึกหรือตีพิมพ์เผยแพร่ไว้เกี่ยวกับมาตรการเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืช ทั้งในประเทศไทยและต่างประเทศ จากนั้นนำข้อมูลที่รวบรวมได้มาทำการศึกษา เรียบเรียง และวิเคราะห์อย่างเป็นระบบ เพื่อเสนอแนวทางการสร้างแรงจูงใจให้กับผู้ประกอบธุรกิจอาหารทางเลือกจากพืชจากการศึกษา พบว่า ในปัจจุบัน ไทยยังขาดมาตรการส่งเสริมธุรกิจอาหารทางเลือกจากพืชที่ชัดเจนและครอบคลุม เมื่อเทียบกับหลายประเทศที่ให้ความสำคัญกับเรื่องนี้ เช่น สหรัฐอเมริกา สหภาพยุโรป และสิงคโปร์ ทั้งนี้ เพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืชในไทยให้เติบโตอย่างยั่งยืน ควรมีการดำเนินการดังนี้ (1) จัดทำแผนยุทธศาสตร์ระดับชาติ และกฎหมายเฉพาะเพื่อส่งเสริมอาหารทางเลือกจากพืช: กำหนดเป้าหมายและแนวทางการดำเนินงานที่ชัดเจน (2) บูรณาการนโยบาย เชื่อมโยงนโยบายด้านอาหารกับนโยบายอื่น ๆ เช่น สุขภาพ สิ่งแวดล้อม และเศรษฐกิจ รวมถึงการสนับสนุนการวิจัยและพัฒนา เพื่อส่งเสริมการพัฒนานวัตกรรม ซึ่งจะเป็นองค์ประกอบสำคัญในการพัฒนาผลิตภัณฑ์ใหม่ ๆ และเทคโนโลยีที่เกี่ยวข้อง (3) ส่งเสริมด้านสิทธิประโยชน์ทางภาษีเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืช ทั้งในส่วนที่ส่งผลกับอาหารทางเลือกจากพืชโดยตรง เช่น การพิจารณาปรับลดอัตราภาษีมูลค่าเพิ่มสำหรับอาหารทางเลือกจากพืช และส่วนที่เกี่ยวข้องกับการให้สิทธิประโยชน์ทางภาษีทางอ้อม เช่น การหักค่าใช้จ่ายที่ใช้สำหรับการวิจัย (4) สร้างความตระหนักรู้ และประชาสัมพันธ์ข้อมูลเกี่ยวกับประโยชน์ของอาหารจากพืช ทั้งต่อผู้บริโภคเอง และต่อสังคมในภาพรวม (5) สนับสนุนเกษตรกร และส่งเสริมการปลูกพืชที่ใช้เป็นวัตถุดิบในการผลิตอาหารจากพืชการดำเนินการเหล่านี้จะช่วยให้ไทยมีอุตสาหกรรมอาหารทางเลือกจากพืชที่แข็งแกร่ง สามารถแข่งขันในตลาดโลก และตอบสนองความต้องการของผู้บริโภคที่ใส่ใจสุขภาพและสิ่งแวดล้อมมากขึ้น นอกจากนี้ …
