More Than Friends: A New Theory For The Third-Party Doctrine, Eang L. Ngov
More Than Friends: A New Theory For The Third-Party Doctrine, Eang L. Ngov
American University Law Review
When a person gives information or something tangible to someone or a business, the Fourth Amendment’s third-party doctrine allows the government to obtain that evidence without a warrant or probable cause. The third-party doctrine is premised on the rationale that we hold no reasonable expectation of privacy when we voluntarily expose information to others, that we assume the risk that the third party would share the information, and that we must deal with the consequences of that misplaced trust. The doctrine originated from a series of cases where law enforcement obtained information revealed by criminals through their mistaken trust of …
Strictly Intersectional Scrutiny: A Recommendation For Transforming The Epc To Highlight Queer Black Women, Kayla M. Richardson
Strictly Intersectional Scrutiny: A Recommendation For Transforming The Epc To Highlight Queer Black Women, Kayla M. Richardson
Undergraduate Honors Theses
The purpose of this thesis is to explore the interpretation of the Equal Protection Clause by the Supreme Court of the United States (SCOTUS) and how this interpretation can become more intersectional for Black queer women. This question is explored within the scope of two theoretical frameworks: Derrick Bell’s theory of interest convergence and Kimberlé Crenshaw’s theory of intersectionality. This project examines whether any factors compel SCOTUS to be more intersectional in its approach to the Fourteenth Amendment. Simultaneously, this study also considers what social contexts make SCOTUS more likely to focus on the interests of the oppressor, a demographic …
Re/Descheduling Marijuana Through Administrative Action, Scott P. Bloomberg, Alexandra Harriman, Shane Pennington
Re/Descheduling Marijuana Through Administrative Action, Scott P. Bloomberg, Alexandra Harriman, Shane Pennington
Faculty Publications
In October 2022, President Biden requested that the Secretary of Health and Human Services and the Attorney General initiate a procedure to review how marijuana is scheduled under the federal Controlled Substances Act (“CSA”). The announcement was historic. After more than fifty years of federal prohibition, decades of advocacy and litigation from reform groups, and dozens of stalled efforts in Congress, a President finally decided to wield the Executive Power with an eye towards rescheduling or descheduling marijuana. But just how far does that power go? Given President Biden’s request, the question is in serious need of scholarly attention.

Long Overdue: The Need For An Examination Of The Specter Of Racial Bias In The Federal Death Penalty System, John Nidiry, Ruth Friedman
Long Overdue: The Need For An Examination Of The Specter Of Racial Bias In The Federal Death Penalty System, John Nidiry, Ruth Friedman
Faculty Publications
The specter of racial bias in the federal government's administration of the death penalty over the past thirty-five years has been long apparent yet insufficiently scrutinized. Scholars have studied the racially disparate application of capital punishment at the state level and linked those disparities to a history of racialized violence. The federal death penalty, especially with regard to the impact of race, however, remains largely unexamined.
It is time to bridge this gap in the research on racial bias in the criminal justice system and in the implementation of the federal death penalty specifically. There are, as this Article sets …

School of Nursing & Midwifery, East Africa
As the COVID-19 pandemic spread across the world, immunocompromised individuals such as people with HIV (PWH) may have faced a disproportionate impact on their health and HIV outcomes, both from COVID-19 and from the strategies enacted to contain it. Based on the SPIRIT guidelines, we describe the protocol for an international multisite observational study being conducted by The International Nursing Network for HIV Research, with the Coordinating Center based at the University of California, San Francisco (UCSF) School of Nursing. Site Principal Investigators implement a standardized protocol to recruit PWH to complete the study online or in-person. Questions address demographics; …

A Phenomenological Exploration Of Intracommunity Attitudinal And Experiential Barriers To The Utilization Of Psychotherapeutic Services In Bipoc Populations, Jade Turner
Calvert Undergraduate Research Awards
This study used Interpretative Phenomenological Analysis to explore the role that intracommunity attitudes and beliefs and negative mental healthcare experiences play in determining treatment-seeking behavior in BIPOC communities. Through in-depth semistructured interviews, five participants shared their perspectives and experiences, providing rich and nuanced insight into the subjective landscape of mental healthcare avoidance among racial and ethnic minority populations. The analysis revealed five overarching themes (pray it away, isolated and invisible, fear, perceived importance of racial matching, and therapeutic experiences profoundly impact treatment-seeking) shedding light on the nuanced ways in which BIPOC individuals make sense of and navigate mental health within …

Adhd Symptoms As A Moderator For The Relationship Between Childhood Maltreatment And Adolescent Delinquency, Demy Alfonso
Adhd Symptoms As A Moderator For The Relationship Between Childhood Maltreatment And Adolescent Delinquency, Demy Alfonso
Graduate Research Theses & Dissertations
Childhood maltreatment (i.e., physical abuse, emotional abuse, and neglect) has consistently been shown to be a significant predictor of engagement in subsequent delinquent behaviors during adolescence. ADHD symptoms have also been shown to be both a risk factor for experiencing childhood maltreatment, as well as a potential consequence of having been exposed to maltreatment. Additionally, concurrent symptoms of ADHD and experiences of maltreatment are significantly associated. ADHD symptoms have also been shown to be related to delinquency. Further, research has found that the prevalence of these difficulties (e.g., ADHD symptoms, delinquent behaviors) may differ according to an individual’s gender. The …
Unmasking Challenges Of African American Women At Predominantly White Institutions (Pwis) Unveiling Phenomenological Realities And Prioritizing Well-Being, Alicia C. Perry
University of the Pacific Theses and Dissertations
This dissertation addresses African American women's intricate challenges at predominantly white institutions (PWIs), exploring the outcomes of navigating a sense of belonging which eventually affects one's well-being within this professional context. The study employs a qualitative approach to delve into the experiences of those who work or have worked in the environment. By capturing the personal narratives of African American women in various roles at PWIs, the research aims to understand the intersectionality of race and gender dynamics impacting their professional lives. The literature review contextualizes the study by discussing the challenges identified in existing research, including the marginalization experiences …

On The Whitewashing Of Third Space In Teacher Education, Or Don’T Cite This Manuscript, Jori S. Beck
On The Whitewashing Of Third Space In Teacher Education, Or Don’T Cite This Manuscript, Jori S. Beck
Teaching & Learning Faculty Publications
Since the 1980s, there has been a push in teacher education to increase clinical experiences and build closer relationships between school districts and colleges of education. In 2010, Zeichner introduced the theory of Third Space to school-university partnership research. This was followed by a number of other articles in which the researchers applied the same theory—including in much of the work on teacher residencies. In this theoretical critique and brief systematic literature review, I connect Third Space theory back to its postcolonial roots and attribute the scholars of color who created the theory. I unpack the theory’s original intent and …
The Role Of Feedback In Accurate Delivery Of Skill Acquisition Programs In Applied Behavior Analysis, Cyndy Wollenweber
The Role Of Feedback In Accurate Delivery Of Skill Acquisition Programs In Applied Behavior Analysis, Cyndy Wollenweber
Research Papers
Feedback is commonly used to increase and maintain employee performance. Although the effectiveness of feedback is frequently studied in applied behavior analysis (ABA), there are various considerations when it comes to providing feedback, such as the type of feedback, delivery method, and timing of feedback. For instance, although the feedback sandwich is commonly used, where positive feedback is delivered followed by corrective feedback and more positive feedback, empirical findings are mixed (Henley & DiGennaro Reed 2015; Parkes et. al., 2013). Therefore, the current paper will review ABA, organizational behavior management, the role of feedback in the aforementioned areas, and provide …

Identification Of The Synthetic Cannabinoids Bzo-Poxizid And Mda-19 Using Gas Chromatography- Mass Spectrometry, Samantha Way
All ETDs from UAB
Synthetic cannabinoids are synthetic compounds created to mimic the effects of naturally derived cannabis. They are up to 100 times more potent than natural cannabis, and due to their cannabinoid-like activity, they are considered schedule one drugs in Alabama. They are also the most common new psychoactive substance in the state of Alabama. The possible threat to public health and their schedule one status makes it necessary to develop a method for the detection of these substances. BZO-POXIZID and MDA-19 are two synthetic cannabinoids of recent interest. This study was conducted to validate a method for the detection of these …

News Media Coverage Of Court Matters Involving Children In Kenya., Lenox Omondi Otieno
Master of Arts in Digital Journalism
The pivotal role of news media as the fourth estate in society cannot be overstated; it profoundly influences public opinion, shapes perceptions, and mirrors a nation's values. Much like in other countries, in Kenya, media assumes a central role in reporting legal proceedings, especially those involving children. The manner in which these events are covered carries significant consequences, directly impacting the welfare and rights of the children concerned. This study critically examines the news media's coverage of court proceedings involving children in Kenya, focusing on mainstream television channels, namely Citizen TV, NTV, and KTN News, owing to their substantial viewership. …
Self-Induced Extreme Intoxication: Brown And Section 33.1 Of The Criminal Code, Michelle S. Lawrence
Self-Induced Extreme Intoxication: Brown And Section 33.1 Of The Criminal Code, Michelle S. Lawrence
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
Parliament enacted section 33.1 of the Criminal Code in 1995, in direct response to the Supreme Court of Canada’s 1994 decision in R. v. Daviault. Through this provision, it set out to remove the reach of the extreme intoxication defence from accused persons charged with personal violence offences, where their intoxication was self-induced. Parliament justified the imposition of criminal responsibility in these cases on the moral blameworthiness of voluntary intoxication, notwithstanding the majority’s ruling in Daviault that doing so offends the Charter. It was not until 2021 — more than 25 years after the enactment of section 33.1 — that …

Forensic Archaeology Protocols for Wildfires and Fire-Related Scenes
Forensic archaeology is a relatively new area of study and focuses on the medical legal aspects of archaeology. This paper will focus on how forensic archaeology should be used for wildfire and other fire-related fatalities or investigations, what happens to bone when exposed to heat, what protocols should be in place and how an excavation should look, and finally the challenges of fire-related investigations. This report will focus on the larger scale of the investigation and will be using several sources from different wildfire and fire fatality reports.

During his 2018 campaign to become Dallas County District Attorney, John Creuzot promised to decline prosecution of low-level marijuana misdemeanors. After his election, District Attorney Creuzot (DA Creuzot) honored this campaign promise, issuing policies designed to radically reduce misdemeanor marijuana prosecutions. Analyzing qualitative and quantitative data, the authors describe police enforcement changes associated with the Dallas County District Attorney's Office's (DAO) marijuana prosecution policies. The authors also explore how the
DAO's Intake Unit successfully implemented and enforced these marijuana prosecution policies.
The authors show that DA Creuzot's policies were associated with a significant decrease in marijuana misdemeanor arrests and an …

This book provides a comprehensive examination of the rapidly evolving role of artificial intelligence (AI) in the patent law profession. Rather than a traditional legal text, this work offers an in-depth exploration of the profound impacts AI will have on patent attorneys' workflows and practices.
The central inquiry posies whether AI will ultimately replace patent attorneys or serve as a powerful complementary technology. This study contends that AI is poised to become an indispensable tool that augments and enhances the patent attorney's capabilities rather than renders them obsolete. Through detailed analysis of a patent attorney's typical workweek utilizing AI assistance, …

War Crimes As Vocabulary Shaping The Visible, Rebecca Mignot-Mahdavi
Saint Louis University Law Journal
The traditional exclusion of sexual violence and rape from the ambit of international humanitarian law stems from the long-established masculinist perception of war and the exacerbated invisibility of women and girls in that context. International criminal law tried to recognize this traditionally invisible suffering and pain in armed conflicts by characterizing rape and sexual violence as war crimes. This contribution explores the effect of the recognition of rape and sexual violence as war crimes on conflicts and societies as a case study to explore the use of war crimes and international criminal law—rather than International Humanitarian Law (“IHL”) norms—as a …
