The Origins Of The Major Questions Doctrine, Rachel Rothschild
The Origins Of The Major Questions Doctrine, Rachel Rothschild
Articles
In a series of recent cases, the Supreme Court has invoked the newly named “major questions doctrine” to strike down agency regulations that protect public health and the environment. Several Justices have argued that while the name “major questions” may be new, these decisions are simply the latest iteration in a longstanding effort of the courts to curtail the explosive growth of the administrative state since 1970. The first paradigmatic example of this line of cases is the 1980 “Benzene” case, in which the Supreme Court set aside the Occupational Safety and Health Administration (OSHA)’s new workplace standards for the …

2024 Fall Reports (Clinton)
This report presents a comprehensive plan to revitalize a historical building in Clinton, which has long served as a community hub. Originally home to a JC Penney store, the building now functions as an event space and a public resource, including hosting the Kids Kare facility that provides daycare and learning support for children. The city’s goal is to preserve the building's legacy while enhancing its role in the community by introducing new features that promote economic growth and broaden its accessibility. Our team worked closely with city staff to explore opportunities for expanding the building’s use while preserving its …
Behind Every Strong Man Is An Even Stronger Woman: Women In The Wwe, Jenna Roberts
Behind Every Strong Man Is An Even Stronger Woman: Women In The Wwe, Jenna Roberts
Honors Theses
Women in World Wrestling Entertainment (WWE) have come to the forefront of WWE programming form out of nowhere. This honors thesis sets out to show that this narrative is false and that the progression of women in the WWE began long before the company had its current name. This thesis uses the theory of the four waves of feminism to show the correlation of the evolution of women in society to the evolution of women in the WWE. In doing so, this project shows both the similarities and differences between the women in the WWE and women in the United …

Voicing Experience: Learning About And Understanding The Latina Experience In The United States Through Coming-Of-Age Literature, Audrey G. Childress
Honors Theses
This thesis analyzes the works of Latina female authors from the United States of America in the coming-of-age genre and how the themes addressed in the novels provide readers with insight into what aspects of the Latino culture in the United States affect the decisions Latina women make when it comes to deciding whether to pursue higher education. The thesis examines three novels by Latina authors from the United States in the coming-of-age genre. These novels include The House on Mango Street, The Poet X , and I Am Not Your Perfect Mexican Daughter. It discusses themes such as …
Highs And Hollows: Exploring The Overall Drug Use Of Kentucky Universities From Urban To Appalachian, Venessa Miller
Highs And Hollows: Exploring The Overall Drug Use Of Kentucky Universities From Urban To Appalachian, Venessa Miller
Honors Theses
Drugs cause chemical changes to a person’s mental and physical state and the misuse of such substances is a problem that affects not only strangers but our community and those closest to us. It is of utmost importance to determine the root and depth of the drug problem, especially among populations where the risk is highest. College students, also known as emerging adults, are a vulnerable group due to their unique environment that fosters higher exposure rates and the normalization of substance use. The current study focuses on students in higher educational institutions throughout Kentucky, a state known for being …

Lies, Counter-Lies, And Disinformation In The Marketplace Of Ideas, Enrique Armijo
Lies, Counter-Lies, And Disinformation In The Marketplace Of Ideas, Enrique Armijo
Indiana Law Journal
The First Amendment’s main theoretical account has been as consistent as it has been influential. As John Stuart Mill wrote in On Liberty in 1859, and as First Amendment theory and doctrine, following Mill, have maintained since, the truthfinding process requires that truth and falsity collide in an open marketplace of ideas. Because false speech clarifies truth, and government cannot be trusted to decide for knowledge-seekers what is true, counterspeech is the proper—indeed in most cases the only—remedy for correcting falsity. However, this account itself relies on several false premises. Participants in knowledge production environments are often not motivated by …
The Rise And Fall Of The Consideration Of Race And Ethnicity In The Admissions Process: The Long-Term Negative Consequences Of The Fall, Kevin Brown
Indiana Law Journal
Chief Justice Roberts wrote the majority opinion for the Supreme Court that struck down the affirmative action policies of Harvard College and the University of North Carolina. While Justices Thomas, Gorsuch, and Kavanaugh each wrote separate concurring opinions, they also joined Chief Justice Roberts’s opinion along with Justices Alito and Barrett. Thus, unlike the Court’s prior significant decisions that narrowly upheld affirmative action by one vote, this decision’s six-Justice majority allowed Chief Justice Roberts to write an opinion that more definitively rejected affirmative action than the Court’s tentative and cautious opinions upholding it. Despite what many may think about the …

Exploring The Contribution Of Cancer Palliative Care Development Toward Alleviating The Human Crisis Of Suffering In Low- And Middle-Income Countries: A Framework Synthesis Protocol, Shrikant Atreya, Arathi Rao, Vijay Shree Dhyani, Mebin Mathew
Open Access archive
Objectives. Inadequate access to cancer care, high mortality, and out-of-pocket expenditure contribute to health-related suffering in low- and middle-income countries, making palliative care a relevant option. How palliative care development has alleviated suffering is not systematically studied, necessitating this review’s conduct. The objective of this systematic review with a framework synthesis approach is to identify and map the dimensions and indicators of cancer palliative care development and the components of integration between cancer and palliative care in LMICs. Methods. Uni- and multi-disciplinary databases like Cochrane, MEDLINE (PubMed), EMBASE, CINAHL Complete, and PsycINFO will be systematically searched for eligible studies exploring …
Role Of Absolute Versus Relative Voice Rest In Post-Operative Management Of Benign Vocal Fold Lesions, Mihika Sinha, Suresh Pillai, Shama Shetty, Usha Devadas
Role Of Absolute Versus Relative Voice Rest In Post-Operative Management Of Benign Vocal Fold Lesions, Mihika Sinha, Suresh Pillai, Shama Shetty, Usha Devadas
Open Access archive
Objective Most otolaryngologists advocate absolute voice rest after laryngeal surgery, which proves difficult for patients, so we decided to evaluate the role of absolute voice rest versus relative voice rest in the post-operative management of benign lesions. Methods Forty patients were recruited and divided in two groups: absolute voice rest and relative voice rest. Pre- and post-operative voice analysis (fundamental frequency, jitter, shimmer, voice handicap index, voice-related quality-of-life scale scores and compliance) were noted at one week and one month. Results Voice analysis parameters including jitter (p = 0.035), shimmer (p = 0.020), voice handicap index (p < 0.001) and compliance (p < 0.001) were better in the relative voice-rest group. Frequency, number of voice breaks and voice-related quality of life showed no statistically significant results. Conclusion There was no significant benefit of absolute voice rest on post-operative outcomes as determined by acoustic variables. Compliance and quality-of-life scores were low in the strict voice-rest group. Therefore, we should reconsider post-surgical voice-rest protocol.

Masih Takut: The Psychology Of Fear In The Development Of Indonesian Social Movements, Loren Andrea Lacruz
Masih Takut: The Psychology Of Fear In The Development Of Indonesian Social Movements, Loren Andrea Lacruz
Indonesia: Arts, Religion, and Social Change
This thesis offers a contemporary investigation of the extent to which historical contexts contribute to Indonesian people’s reservations towards political conversations and social movements, such as protests and demonstrations. The historical contexts in question are focused on the Soeharto dictatorship from 1966-1999 and its long reign of censorship, citizen violence, and general human rights violations. The research employs a mixed-methods approach focused on cultural and participant observation, social media analysis, and interviews. Social media analyses offer insights into activism, particularly that of students and the youth, that are not generally available in scholarly sources. Interviews with Indonesian citizens and local …

Perceptions Of Non-Using College Students’ Likelihood To Use Nonprescription Or Prescription Stimulants, Judith Frazier
Perceptions Of Non-Using College Students’ Likelihood To Use Nonprescription Or Prescription Stimulants, Judith Frazier
Walden Dissertations and Doctoral Studies
The Substance Abuse and Mental Health Services Administration has highlighted the risk of non-users among college students using illegal prescription stimulants due to misinformation and incorrect assumptions. This qualitative study aimed to explore the perspectives of college students who do not use stimulants on perceived risks, social acceptability, opportunity experiences, and likelihood of using stimulants. The study addressed factors that either encourage or discourage students from using stimulants, as well as the internal and extrinsic incentives associated with this activity, using a phenomenological paradigm. Twelve southern Ohioan students who were not users were interviewed using a structured interviewing technique, which …

What Freedom? Freedom-A Disease Without Cure. Slavoj Žižek. London: Bloomsbury Academic. 2023. Pp. 328., Edward Sankowski, Betty J. Harris
International Dialogue
Slavoj Žižek's outpouring of books continues, including the volume, Freedom-A Disease Without Cure (2023). The title is somber, but the contents do not signal an unrelievedly depressed attitude on the part of the author. Rather, the book manifests expanding curiosity and far-reaching originality. That is, however, supplemented by some self-criticism, e.g., when the author broods about the apathy in himself and others that he claims is a result of the hyperactivity enjoined by and observed in contemporary capitalism. We hope to go beyond critical interpretation and evaluation of Žižek, to express our own new insights beyond those formulated or hinted …
The Geopolitics Of Shaming: When Human Rights Pressure Works—And When It Backfires Rochelle Terman. Princeton: Princeton University Press, 2023. Pp. 216., Brett J. Kyle
International Dialogue
In The Geopolitics of Shaming: When Human Rights Pressure Works—and When It Backfires (Princeton University Press, 2023), Rochelle Terman takes on the important and interesting question of the effectiveness of states’ denunciation of each other in the enforcement of human rights. “Naming and shaming” states for their human rights abuses has long been a feature of international relations. Despite its consistent presence in the international arena, it is often met with skepticism by IR scholars and seen as nothing more than power politics in disguise. Rather than seeking to downplay or push back against this criticism of norm enforcement, Terman …
Ethnocratizing The “Holy Land” The Politics Of Sacred Places: A View From Israel-Palestine Nimrod Luz. London, New York And Dublin: Bloomsbury Academic, 2023. Pp. 223., Curtis Hutt
International Dialogue
In this review essay, I will engage with some critical issues raised by Nimrod Luz in his recent book, The Politics of Sacred Places: A View From Israel-Palestine. This is a follow up to earlier articles that I have written for ID: International Dialogue and elsewhere related to holy sites as well as pilgrimage to, from, and within what is commonly known in the Western Christian world for the last one thousand years as the “Holy Land.” 1 It is also a companion piece to a recent review I have written of Marshall J. Breger and Leonard M. Hammer’s landmark …
